OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED

WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on 04/13/88, as Resolution No. 8814,
for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on 07/11/88, and this
District was designated as the conducting district and
authorized by resolution to order said annexation without
notice or hearing and without an election pursuant to
Government Code, Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seq.;
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated DA 8815
by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as
hereinafter described.
c. The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described
in Health and Safety Code Section 4830.

d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial, purposes and
provision for sewage disposal facilities for said
territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: Payment of annexation and state Board fees.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, Section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution ordering
the annexation without notice and hearing and without an
election, as provided in Government Code, Section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to state CEQA Guidelines Section 15074
(California Environmental Quality Control Act of 1970),
the board finds in accordance with the Negative
Declaration dated 04/21/87, prepared with respect to the
proposed annexation and the project designated TPM 18897
Log No. 87-7-5 that the project would have no
significant impact on the environment.

IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described
incorporated territory in the City of Encinitas, State of
California, be and it hereby is annexed to and made a part of
the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government

On motion of Commissioner Hersom, seconded by Commissioner Sasso. the following
resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was adopted
by the Board of Directors of said District as Resolution No, 88-14, dated April 13, 1988,
pursuant to Title 5. Division 3, commencing with Section 56000 of the Government Code;
and
WHEREAS. the territory proposed for annexation is as described in the application
on file with the Local Agency Formation Commission; and
WHEREAS. the Executive Officer of the Commission has filed her report on said
annexation. which report was received and considered by the Commission; and
WHEREAS. all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED. that this Commission hereby finds.
determines, and orders as follows:
(I) The Commission certifies that it has reviewed and considered the information
contained in the Negative Declaration prepared by the County of San Diego.
(2) The Commission hereby approves the annexation with modified boundaries. as
described in Exhibit A attached hereto, subject to the following condition:
Payment by the property owner of district annexation fees and State
Board of Equalization charges,
(3) The boundaries of the territory as described in Exhibit A are definite and
certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 1.52 acres and is uninhabited.
(7) The. territory proposed for annexation is hereby designated the "Elizabeth
Barnes Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

This is a request to annex 1.52 acres into the Cardiff Sanitation District.
Annexation is required in order to provide sewer service for three single
family dwellings (TPM 18897).
RECOMMENDATIONS: That your Board
1. Find pursuant to State CEQA Guidelines, Section 15074 (California Envir-
onmental Quality Control Act of 1970), that this project would not have
a significant effect on the environment (Negative Declaration, dated
April 27, 1987, Log No. 87-7-5).
2. Adopt the resolution of the Board of Directors of the Cardiff Sanitation
District annexing territory to the District.
Discussion:
On June 24, 1987, your Pl anni ng Commi ssi on adopted a resolution approving
Tentative Parcel Map (TPM 18897) for this project.
On April 13, 1988 your 8oard adopted the Resolution of Application.
On July 15, 1988 the Local Agency Formation Commission adopted a resolution

The following filings to be made after the conducting authority has ordered the
change(s) of organization [boundary change(s) must be processed by the LAFCO
office:

5. State Board of Equalization
Any other filings remain the responsibility of the conducting authority. Proceedings
must be initiated within 35 days after adoption of the Commission's resolution, and
completed within one year after LAFCO approval, or the proposal must be considered
abandoned (Government Code Sections 57001 and 57002).

the following materials must be forwarded to the LAFCO office:

hereinafter described territory to be annexed to the Cardiff
Sanitation District (hereinafter referred to as the Sanitation
District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code Sections 56800 and 56700,
application is hereby made to the Local Agency
Formation Commission of the County of San Diego for
a proposed change of organization as follows:
A. This proposal is made pursuant to the
Cortese-Knox Local Government Reorganization
Act of 1985 (S. 56000, et. seq., Govt. Code).
B. The nature of the proposed change of
organization and the names of all districts for
which any such change of organization is
proposed as follows: The annexation of the
hereinafter described territory to the
Sanitation District.
C. The names of all other affected counties, cities
and districts are: city of Encinitas.
D, A description of the exterior boundaries of the
territory proposed to be annexed to the
Sanitation District is described in Exhibit "A"
hereto attached.
E. Said territory is uninhabited and comprises
approximately 0,92 acres.
F. It is proposed that said territory be annexed
subject to the following condition: Payment of
district annexation and State Board fees.
G. All the owners of land within such territory
have given their written consent to such

(1) The Sanitation District is empowered to and
is engaged in furnishing sewerage disposal

disposal facilities for said territory is
essential for such purposes.
I. It is hereby requested that proceedings be taken
for the annexation of territory as hereinabove
proposed.
J. This annexation is consistent with the sphere of
influence of the Sanitation District.
2. Pursuant to State CEQA Guidelines section l5074
(California Environmental Quality Act of 1970), the
Board finds in accordance with the Negative
Declaration dated 04/2l/87, prepared with respect to
the proposed annexation and the proj ect designated
TPM 18897, Log No. 87-7-5, that this proj ect would
have no significant impact on the environment.
3. The Clerk of the Board of Directors is hereby
authorized and directed to file a certified copy of
this resolution with the Executive Officer of the
Local Agency Formation Commission of the County of
San Diego.

PROJECT DESCRIPTION AND LOCATION:
The project is a subdivision of 0.92 acres into three parcels of 10,005, 10,077
and 15,758 square feet in size. The project is located at 1804 Oxford Avenue at
the intersection of Oxford Avenue and Brighton Avenue, north of Birmingham
Dri ve.

ENVIRONMENTAL SETTING:
The project site is a moderately sloping property covered by a mature growth of
planted trees and shrubs; soils are moderately erosive loamy sands. There is an
existing single-family home in proposed, Lot I. The site is surrounded by
single-family homes on the north, east and south. Adjacent to the west of the
project site are the upper slopes of a canyon containing undisturbed dense
riparian woodland growth. The portion of the canyon adjacent to the property is
currently vacant but is approved for construction of Rossihi Drive and
single-family homes. Individual gradin9 permits may require additional
environmental review to insure that drainage to the canyon is appropriately
controlled.

COMMUNITY ADVISORY BOARD
APPROVING A TENTATIVE PARCEL MAP (TPK lS897)
WHEREAS,proposed Tentative Parcel Map application for a division
of a .92 acre lot at l804 Oxford Avenue into three separate
parcels of 16,758 square feet, 12,805 square feet, and 10,077
square feet and each parcel shall be limited to one single family
residence thereon,
WHEREA~" a public hearing was conducted on the application
on June 24, 1987; and
WHEREAS, the CAB considered:
1. The staff report dated June 24, 1987;
2 The Tentative Parcel Map dated and received March 2, 1987;
3. written testimony submitted at the public hearing; and
4. Oral testimony submitted at the public hearing; and
WHEREAS, at said hearing the Cardiff-by-the-Sea CAB made the
following findings:
a. That the proposed map is consistent with applicable
general and specific plans as specified in Section

shall be prepared to show the offer being accepted.
b. Offer to dedicate the right-of-way required to complete
a thirty foot (30') wider one-half right-of-way plus
the right to construct and maintain slopes and drainage
improvements as required beyond the thirty foot (30' )
limit for that portion within the land division for
Brighton Avenue, including a 20-foot radius property
line corner rounding at street intersections. The
parcel map shall be prepared to show the offer being
rejected.
c. Offer to dedicate the right-of-way required to complete
a thirty-foot (30') wide one-half right-of-way plus the
right to' construct and maintain slopes and drainage
improvements as required beyond the thirty-foot (30')
limit for that portion within the land division for
Rossini Drive, including a 20 foot radius property line
corner rounding at street intersection. The parcel map
shall be prepared to show the offer being rejected.
d. Any offer of dedication or grant of right-of-way shall
be free of all encumbrances or subordinated at the time

2. ROAD MAINTENANCE/COVENANTS/DEVELOPMENT FEES (DPW)
a. The subdivider shall sign a covenant agreeing not to
oppose formation of a road improvement and maintenance
district.
3. FACILITY/UTILITY ARRANGEMENTS (DPW)
a. The subdivider shall comHly with section 66436 of the
Government Code by furnishing to the city Department of
Puþlic works a certification from each public utility
and each public entity owning easements within the
proposed subdivision stating that: (a) they have
received from the subdivider a copy of the proposed
parcel map without their signature.
b. Plans and specifications for the installation of a
sewer serving each lot must be approved by the Director
of, the Department of Public Works. The subdivider
shall dedicate all necessary easements for that portion
, of the sewer system which is to be public sewer.
c. The subdivider shall cause all of the land within this
subdivision to be annexed to the Cardiff sanitation
District.
d. A commitment to serve each parcel must be obtained from
the Cardiff Sanitation District.
e. No sewer commitment shall be issued until all
conditions in this Resolution of Approval have been
satisfied, the final map or parcel map, grading plan
and improvement plan has been approved by the
Department of public Works and all fees and deposits
paid and improvement security posted.
B. THE FOLLOWING PUBLIC IMPROVEMENTS MUST BE COMPLETED OR A
SECURED AGREEMENT EXECUTED, PRIOR TO RECORDING A PARCEL MAP. THE
AGREEMENT REQUIRES POSTING OF SECURITY IN THE FORM OF A CASH
DEPOSIT, IRREVOCABLE LETTER OF CREDIT OR AN INSTRUMENT OF CREDIT
VALUED AT, OR MORE THAN THE ESTIMATED IMPROVEMENT COST. IT ALSO
REQUIRES IMPROVEMENTS BE COMPLETED WITHIN 24 MONTHS FROM THE DATE
OF RECORDING THE PARCEL MAP OR PRIOR TO THE ISSUANCE OF A PERMIT
OR OTHER GRANT OF APPROVAL FOR THE DEVELOPMENT OF A PARCEL
CREATED BY THIS MAP, WHICHEVER OCCURS FIRST UNLESS OTHERWISE
NOTED.
4. FLOODING/DRAINAGE IMPROVEMENTS

a. The subdivider shall pay flood control fees as
established under city Council of Encinitas Resolution
No. 87-19.
5. FACILITY/UTILITY IMPROVEMENTS
A. The subdivider shall install the sewer system and
dedicate the portion of the sewer system which is to be
public sewer as shown on the approved plans and
specifications.
c. OTHER REQUIREMENTS
1. Prior to the approval of the Parcel Map by the
Department of Public Works the subdivider shall provide
the Department of Public ~orks with a copy of the deed
by which the subject property was acquired and a Parcel
Måp report from a qualified title insurance company.
2. At the time of recordation of the Parcel Map, the name
of the person authorizing the map and whose name
appears on the SURVEYOR's CERTIFICATE as the person who
requested the map, shall be the name of the owner of
the subject property and shall be the same party or
parties as shown on the Tentative Parcel Map unless the
Director of the Department of Planning and Land Use has
approved the substitution of a successor-in-interest to
such party or parties.
3. Prior to the approval of the Parcel Map by the
Department of Public works with a copy of the deed by
which the subj ect property was acquired and a Parcel
Map report from a qualified title insurance company.
4. Prior to approval of a Parcel Map the subdivider shall
obtain a permit or exemption from the California
Coastal commission for the parcel which lies in whole
or in part within the permit area of the coastal zone
as defined in the California Coastal act of 1976.
6. WAIVER AND EXCEPTIONS
a. This subdivision is hereby approved pursuant to the
provisions of the State Subdivision Map act, the city
Subdivision Ordinance, the city Public and Private Road
Standards and all other ordinances of the city of
Encinitas except for a waiver or modification of the:
1. city subdivision Ordinance, Title 24 to dedicate
and improve streets in accordance with city
standards. This modification is granted because
of the following reasons:

and widening the road to ultimate width would be
inconsistent with existing roads in the area.
NOTE: within ten (10) calendar days after the date of final
approval, these findings ~nd conditions may be appealed
in accordance with Section 81. 615 of the Subdivision
Ordinance to the Planning commission. No parcel map
shall be approved no grading permit issued and no
building permits shall be issued pursuant to said
tentative subdivision map until after the expiration of
the tenth (lOth) calendar day following final approval
of these conditions, or if an appeal is taken, until
the Planning Commission has acted.
