NE 87-05 A RESOLUTION OF THE NEW ENCINITAS COMMUNITY ADVISORY BOARD OF THE CITY OF ENCINITAS APPROVING DESIGN REVIEW OF A 191 UNIT RESIDENTIAL SUBDIVISION FOR PROPERTY LOCATED AT 1700 OLIVENHAIN ROAD KNOWN AS: A PORTION OF LOT 12, RANCHO LAS ENCINITAS IN THE COUNTY OF SAN DIEGO, STATE OF CALIFORNIA WHEREAS, McMillin Development, Inc., and Great American Development Company applied for a Design Review of a 191 Unit Subdivision located at 1700 Olivenhain Road; and WHEREAS, a public hearing was conducted on application 87-056 DR on September 23, 1987 and October 5, 1987 by the New Encinitas Community Advisory Board, at which time all persons desiring to be heard were heard; and 8 WHEREAS, evidence was submitted and considered to include without limitation: 1. The application submitted (Attachment A) by McMillin Development, I nc ., and Great American Development Company including all plans for development and other written information, which is incorporated by this reference as though fully setforth herein; and 2. The staff reports (Attachment B) dated September 23, 1987, and October 2, 1987 which are incorporated by this reference as though fully setforth herein; and 3. Oral information submitted at the hearing; and 4. Additional written documentation. NOW THEREFORE, BE IT RESOLVED by the New Encinitas community Advisory Board of the City of Encinitas that: 8 RFjC/CAB7-375 (12-9-87) -1- . 1. The project design is consistent with the General Plan and Zoning Ordinance as the property is Zoned RS4 with 8 General Plan designation of Residential 5; and 2. The project design is substantially consistent with the Design Review Guidelines, for the reasons set forth in Appendix A of the staff report; and 3. The project will not adversely affect the health, safety or general welfare of the community, for the reasons set forth in Appendix A of the staff report; and 4. The project will appreciate materially the appearance and value of the surrounding neighborhood, for the reasons set forth in Appendix A of the staff report. BE IT RESOLVED that the New Encinitas Community Advisory Board of the City of Encinitas hereby approves Design Review Application 87-056 DR subject to the following conditions: A. Prior to obtaining any building or other permit pursuant to this approval and prior to commencement or construction or use of the property in reliance on this approval, the applicant shall: 8 1. Submit detailed and complete development plans for the project to the Planning and Community Development Department for verification. 2. Fence materials for the property lines abutting the creek open space easement shall be five foot wrought iron with five inch spacing and fence posts placed on eight foot centers. The four lots abutting both the creek and Armagosa Drive shall have solid fencing. A wall similar in design and height to the wall adjacent to Olivenhain Road shall be built along the eastern property line of the public park; such wall shall have pedestrian access provided to the development. 3. Improvements placed within any public right-of-way and street paving treatment, materials and colors shall be to the approval of the City Engineer. 4. obtain a Coastal Permit or finding of exemption from the California Coastal Commission prior to building permit issuance. 8 RFjc/CAB7-375 (12-9-87) -2- ~ ~ , . . B. Prior to final occupancy of any structure the applicant shall: e 1. Submit a statement from a licensed landscape architect that all landscaping has been installed as shown on the approved landscape plan, including the watering system. 2. Street trees throughout the development shall be pine and Liquid Amber. Along Armagosa drive between willowhaven Road and Orchard Wood Road the street trees shall be blended in an equal planting mix in order to tie the two different street tree patterns together between each phase of the development. Trees shall be a minimum of 15 gallon size with a majority of trees planted along Armagosa Drive being 24 inch box specimen trees. 3. Obtain from the Planning and Community Development Department certification that specified conditions of the site plan have been met. Final inspection shall not be performed or permanent clearance of utilities authorized until the Director of the Planning and Community Development Department has certified that all conditions of the subject site plan have been satisfactorily met. C. Upon certification by the Director of the Plannign and Community Development Department for occupancy or 8 establishment of use allowed by this Design Review approval, the following conditions shall apply: 1. All light fixtures shall be designed and adjusted to reflect light downward, away from any road or street, and away from any adj oining premises, and shall otherwise conform to Sections 6322 or 6324 of the Zoning Ordinance. 2. The landscaping shall be well maintained at all times. 3. Any solar panels installed by applicant or future owner shall be built into the roof plane and not protrude from it. 4. Any mechanical equipment placed on the roof or on the ground shall be screened from public view. 5. Any off-site temporary signs used to market the subdivision shall be approved by the city. 8 RFjc/CAB7-375 (12-9-87) -3- . ., . .. D. Within one year of this approval the applicant shall record an irrevocable offer to dedicate the open space easement 8 along the creek. The offer shall be subject to the review and approval of the Director of Planning and community Development, the Public Works Director, the Director of Community Services and the City Attorney who may, require conditions or improvements which are in the publics best interest. E. This Deign Review expires on October 5, 1988 ( one year from date of approval except where construction or use of the property in reliance on such site plan approval has commenced prior to its expiration.) If construction and use of the property in reliance on a site plan approval has not commenced within the one year period, said period may be extended by the Director of the Planning and Community Development Department at any time prior to the original expiration date.
