1987-04 . . RESOLUTION NO. NE 87-04 8 A RESOLUTION OF THE NEW ENCINITAS COMMUNITY ADVISORY BOARD OF THE CITY OF ENCINITAS APPROVING DESIGN REVIEW OF A 191 UNIT RESIDENTIAL SUBDIVISION FOR PROPERTY LOCATED AT 1700 OLIVENHAIN ROAD KNOW AS: AS PORTION OF LOT 12 RANCHO LAS ENCINITAS IN THE COUNTY OF SAN DIEGO, STATE OF CALIFORNIA WHEREAS, McMillin Development, Inc., and Great American Development Company applied for a Design Review of a 191 unit Subdivision located at 1700 Olivenhain Road; and WHEREAS, a public hearing was conducted on application 87-056 DR on September 23, 1987 by the New Encinitas Community Advisory Board, at which time all persons desiring to be heard were heard; and, e WHEREAS, evidence was submitted and considered to include without limitation: 1. The application submitted (Attachment A) by McMillin Development, Inc., and Great American Development Company including all plans for development and other written information, which is incorporated by this reference as though fully setforth herein; and 2. The staff reports (Attachment B) dated September 23, 1987, which are incorporated by this reference as though fully set forth herein; and 3. Oral information submitted at the hearing; and 4. Additional written documentation. NOW THEREFORE, BE IT RESOLVED by the New Encinitas Community Advisory Board of the City of Encinitas that: 8 RF/dc/CM5-422 (12-9-87-4) -1- . 1. The project design is consistent with the General Plan and Zoning Ordinance as the property is Zoned RS4 with 8 General Plan designation of Residential 5; and 2. The project design is substantially consistent with the Design Review Guidelines, for the reasons set forth in Appendix A of the staff report; and 3. The project will not adversely affect the health, safety or general welfare of the community, for the reasons set forth in Appendix A of the staff report; and 4. The project will appreciate materially the appearance and value of the surrounding neighborhood, for the reasons set forth in Appendix A of the staff report. BE IT RESOLVED that the New Encinitas community Advisory Board of the City of Encinitas hereby approves Design Review Application 87-056 DR subject to the following conditions: A. Prior to obtaining any building or other permit pursuant to this approval and prior to commencement or construction or 8 use of the property in reliance on this approval, the applicant shall: 1. Submit detailed and complete development plans for the proj ect to the Planning and Community Development Department for verification. 2. Obtain a Coastal Permit or finding of exemption from the California Coastal Commission prior to building permit issuance. B. Prior to final occupancy of any structure the applicant shall: 1. Submit a statement from a licensed landscape architect that all landscaping has been installed as shown on the approved landscape plan, including the watering system. 2. Obtain from the Planning and community Development Department certification that specified conditions of the site plan have been met. Final inspection shall not be performed or permanent clearance of utilities authorized until the Director of the Planning and Community Development Department has certified that all conditions of the subject site plan have been satisfactorily met. 8 RF/dc/CM5-422 (12-9-87-4) -2- l . 8 c. Upon certification by the Director of the Planning and Community Development Department for occupancy or establishment of use allowed by this Design Review approval, the following conditions shall apply: 1. All light fixtures shall be designed and adjusted to reflect light downward, away from any road or street, and away from any adj oining premises, and shall otherwise conform to sections 6322 or 6324 of the Zoning Ordinance. 2. The landscaping shall be well maintained at all times. 3. Any solar panels installed by applicant or future owner shall be built into the roof plane and not protrude from it. 4. Any mechanical equipment placed on the roof or on the ground shall be screened from public view. 5. Any off-site temporary signs used to market the subdivision shall be approved by the city. D. This Deign Review expires on September 23, 1988 (one year from date of approval except where construction or use of the property in reliance on such site plan approval has 8 commenced prior to its expiration). If construction and use of the property in reliance on a site plan approval has not commenced within the one year period, said period may be extended by the Director of the Planning and Community Development Department at any time prior to the original expiration date. BE IT FURTHER RESOLVED that this approval is for lots 31 through 35 as shown on TM 4579 subject to the following conditions: 1. Lot 31 to be used as a temporary parking lot adjacent to the model homes. 2. Lots 32 through 35 to be used for construction of model homes. 3. Lots 31 through 35 shall be converted to comply with the Zoning ordinance once the developer has ceased to use them as model homes. 8 RF/dc/CM5-422 (12-9-87-4) -3- L_n . . 8 BE IT FURTHER RESOLVED that the applicant must receive Design Review of lots 1 through 30 and 36 through 196; which review will be made (or continued) at the October 5, 1987 New Encinitas community Advisory Board Public Hearing.
