NE89-03 A RESOLUTION OF THE NEW ENCINITAS COMMUNITY ADVISORY BOARD CITY OF ENCINITAS, APPROVING A DESIGN REVIEW PERMIT TO ALLOW A GARAGE/CARPORT FOR A 9 UNIT BUILDING, RELOCATION OF 5 VISITOR PARKING SPACES, WROUGHT IRON GATE AND THE OPTION TO CONSTRUCT A GATE HOUSE LOCATED AT THE 500 BLOCK OF FORREST BLUFF STREET (CASE NUMBER 89-004 DR) WHEREAS, a request for consideration of a Design Review Permit was filed by Eugene Johnston to allow a garage/carport for 9 unit building, relocation of 5 visitor parking spaces, wrought iron gate and the option to construct a gate house pursuant to Chapter 23.08 of the City of Encinitas Municipal Code, for the property located 8 at the 500 block of Forrest Bluff Street, legally described as: Lots 1 through 30 of Final Map 11429, as recorded in the Office of the County Recorder. WHEREAS, a public hearing was conducted on the application on March 6, 1989; and WHEREAS, the New Encinitas community Advisory Board considered: 1. The staff report dated March 1, 1989 2. The application and maps submitted by the applicant; 3. Oral evidence submitted at the hearing; and 4. written evidence submitted at the hearing. 8 MB/04/CRO5-250wp5 (4-18-89-4) 8 WHEREAS, the New Encinitas Community Advisory Board made the following findings pursuant to the Municipal Code: SEE ATTACHMENT "A" NOW, THEREFORE, BE IT RESOLVED by the New Encinitas Community Advisory Board of the City of Encinitas that the Design Review Permit is hereby approved subject to the following conditions: - That the landscaping be installed prior to final inspection; - That the tree height be between 10' and 25' within the species with at least one tree 25' in height; - Shrub screening is to be located within the 5' setback at the entrance to Forrest Bluff on the visitor parking lot; - The gate is to be black wrought iron with contrasting colors for the monument sign and must conform to all standards; and - The concrete on top of the carport is to be painted beige. 8 BE IT FURTHER RESOLVED by the New Encinitas Community Advisory Board of the City of Encinitas: That this project will not have a significant effect on the environment in that a negative declaration was previously certified, pursuant to the California Environmental Quality Act (CEQA) on October 19, 1984 in conjunction with the approval of TM4461 and P84-31 by the Planning Commission of the County of San Diego. 8 MBj04jCRO5-250wp5 (4-18-89-4) . 8 PASSED AND ADOPTED this 3rd day of April, 1989, by the following vote, to wit: AYES: Beck, Colgan, Quinn, Patton, White NAYS: None ABSENT: None ABSTAIN: None Charles Colgan, Ch an of the New Encinitas Commu 'ty Advisory Board ATTEST: ~~ W~ L~~ Bill Weedman city Planner 8 8 MB/O4/CRO5-250wp5 (4-18-89-4) . ATTACHMENT nAn NEW ENCINITAS COMMUNITY ADVISORY BOARD RESOLUTION NO. 8 CASE NO. 89-004 DR Findings For Design Review (Section 23.08.076 Municipal Code) 23.08.072 Reaulatorv Conclusions - Generally. A. The project design is inconsistent with the General Plan, a Specific Plan or the provisions of this Code. Evidence to Consider: The project is consistent with the General Plan and other provisions of the Municipal Code in that the density, setbacks, open space and improvements are consistent with the Use Permit previously granted by the County of San Diego. B. The project design is substantially inconsistent with the Design Review Guidelines. Evidence to Consider: The project design is substantially consistent with the design review guidelines as it incorporates several of the design elements of Buildings 1 and 2, reflects an acceptable level of design appearance, incorporates landscaping into the proj ect and otherwise 8 substantially conforms with the City's adopted design criteria. C. The project would adversely affect the health, safety or general welfare of the community. Evidence to Consider: The proj ect as proposed would not adversely affect the health, safety or general welfare of the community in that the garage is replacing the previously approved carport and is being developed consistent with the uses in the community. The proposed visitor parking is located off of private street, Forrest Bluff and maintains adequate si te distance for ingress and egress. The proposed parking will also be grass block, thus avoiding unnecessary and unsightly paving. D. The project would tend to cause the surrounding neighborhood to depreciate materially in appearance or value. Evidence to Consider: The project would tend to have a positive impact on the appearance and value of the neighborhood given that the site has been in a disturbed state for several years with the installation of the infrastructure for the development. - MB/O4/CRO5-250wp5 (4-18-89-4)
