8 A RESOLUTION OF THE
NEW ENCINITAS COMMUNITY ADVISORY BOARD
CITY OF ENCINITAS, APPROVING A
DESIGN REVIEW PERMIT TO ALLOW A
6 FOOT HIGH SOUND ATTENUATION WALL
LOCATED AT 1445-1451 SANTA FE DRIVE
(CASE NUMBER 88-285 DR/V)
WHEREAS, a request for consideration of a Design Review Permit
was filed by Jen Rose Development Co. to allow a six foot high
sound attenuation wall pursuant to Chapters 23.08 and 30.16 of the
City of Encinitas Municipal Code, for the property located at 1445-
1451 Santa Fe Drive, legally described as:
Parcels 1-4 of Parcel Map 14633
8 WHEREAS, public hearings were conducted on the application on
October 17, 1988, December 5, 1988, March 6, 1989, May 1, 1989,
and June 5, 1989.
WHEREAS, the New Encinitas Community Advisory Board
considered:
1. The staff report dated June 5, 1989;
2. The application and maps submitted by the applicant;
3. Oral evidence submitted at the hearing; and
4. Written evidence submitted at the hearing.

WHEREAS, the New Encinitas Community Advisory Board made the
following findings pursuant to the Municipal Code:
8 SEE ATTACHMENT "A"
NOW, THEREFORE, BE IT RESOLVED by the New Encinitas Community
Advisory Board of the City of Encinitas that the Design Review
Permit is hereby approved subject to the following conditions:
- That the wall be landscaped per landscaping plan submitted on
May 12, 1989 and approved by the New Encinitas Community
Advisory Board on June 5, 1989.
- That the landscaping be installed prior to final inspection;
- That all maintenance of the wall/gate in the common access
area be incorporated into the CC & R's or Road maintenance
agreement for this housing project.
- That the wall and gate be installed 35' from centerline of
Santa Fe Drive to comply with the zoning code setbacks.
- That the linear breaks in the wall occur at no less than every
20 I.
BE IT FURTHER RESOLVED by the New Encinitas Community Advisory
Board of the City of Encinitas:
8 That this project was found to be exempt from environmental
review Section 15305 (a) (CEQA).
PASSED AND ADOPTED this 5th Day of June, 1989, by the
following vote, to wit:

8 Findings For Design Review
(Section 23.08.076 and Section 30.16.19 G(2) Municipal Code)
23.08.072 Requlatory Conclusions - Generally.
A. The wall as approved has been found to be a sound
attenuation wall and as such may be placed on the property line
along Santa Fe Drive; this location will be at least 35 feet from
centerline of Santa Fe Drive.
Evidence to Consider:
The Environmental Impact Report prepared by the County of San
Diego for the extension of Santa Fe Drive to El Camino Real
(known as EAD Log #80-7-57) established that an increase in
noise levels would result which would expose residents living
along Santa Fe Drive to a "normally unacceptable" category of
noise level which may reach a peak of 68 dBA if the traffic
count on the road is 12,000 trips per day; the City of
Encinitas General Plan estimates that traffic in front of the
site may reach 15,000 ADT's by the year 2010. Traffic counts
published in March, 1988 indicated 13,000 ADT's at the time
of study. (Encinitas General Plan Traffic Analysis (II-I).)
8 The report (88-094) completed by San Diego Acoustics, Inc. for
the site established that the 6 ft. high wall would reduce
noise for the re?idents from 0.0 to 6-7 dBA, with the average
reduction being 5-7 dBA over much of the site.
B. The project design is inconsistent with the General
Plan, a Specific Plan or the provisions of this Code.
Evidence to Consider:
The project is consistent with the General Plan and other
provisions of the Municipal Code in that the wall will adhere
to the setbacks and walls are a permitted use in residential
zones.
C. The project design is substantially consistent with
the Design Review Guidelines.
The project design is substantially consistent with the design
guidelines as it reflects an acceptable level of design
appearance, will incorporate landscaping as conditioned in the
resolution, the tan slump stone is consistent with some of the
existing residences and otherwise substantially conforms with
the city's adopted design criteria by the design incorporating
features to "break up" the linear appearance of an ordinary

D. The project would adversely affect the health, safety
or general welfare of the community.
8 Evidence to Consider:
The project as proposed will not adversely effect the health,
safety or general welfare of the community in that the sound
attenuation wall will reduce the noise, fumes and dust
generated by automobile traffic and otherwise act as a buffer
from the traffic on Santa Fe Drive for those property owners
to the south. The wall will also provide privacy and security
to the property owners.
E . The proj ect would tend to cause the surrounding
neighborhood to depreciate materially in appearance or value.
Evidence to Consider:
The project would tend to have a positive impact on the
appearance and value of the neighborhood as most homes in the
area have fences/walls of similar height to act as a buffer
to traffic impacts. with required landscaping the wall could
be an attractive addition to the neighborhood.
