8 RESOLUTION NO. NE-90-06
A RESOLUTION OF THE NEW ENCINITAS
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
MODIFICATION PERMIT FOR THE ENTRY GATE AND LANDSCAPING
FOR THE FLAIR ENCINITAS SUBDIVISION LOCATED AT
THE INTERSECTION OF MOUNTAIN VISTA DRIVE AND
SHADOW MOUNTAIN DRIVE, ENCINITAS
(89-268-DR/MOD)
WHEREAS, Flair Encinitas Homeowners Association, applied,for
a Design Review Modification for the entry gate and landscaping for
the Flair Encinitas Subdivision located at the intersection of
Mountain Vista Drive and Shadow Mountain Drive, Encinitas, as
required by Chapter 23.08, the City of Encinitas Design Review
Ordinance; and
WHEREAS, a public hearing was conducted on the application
8 by the New Encinitas Community Advisory Board on April 2, 1990 and
all persons desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a. Elevation drawings submitted by the applicant;
b. Written information submitted with the application;
c. Oral testimony from staff, applicant, and public made a
part of the record at said public hearing;
d. CAB staff report (89-2 68-DR/MOD) dated March 27, 1990
which is on file in the office of Planning and Community
Development; and
e. Additional written documentation.
NOW THEREFORE, BE IT RESOLVED by the New Encinitas Community

8 Advisory Board of the City of Encinitas that the Design Review
Modification Permit for 89-268-DR/MOD for the entry gate and
landscaping for the Flair Encinitas Subdivision is hereby approved
subject to the following findings:
1. That the proposed project is in conformance with section
23.08.72 of the Design Review Ordinance, since the
project is consistent with the existing General Plan in
land use since the gate is a proper accessory use for a
residential development;
2. That the proposed project is in conformance with section
23.08.74 of the Design Review Ordinance, since the
project has been constructed to be compatible with the
surrounding area and the visual impact is minimal due to
the open style fencing~
3. That the proposed project is in conformance with section
23.08.76 of the Design Review Ordinance, since the
exterior materials for the project have been coordinated
to be compatible with each other and the surrounding
area, and the proposed structure is compatible with the
8 size and scale of other single family accessory
structures in the surrounding neighborhood;
4. That the proposed project is in conformance with section
23.08.077 of the Design Review Ordinance, since the
landscaping is well maintained and of high quality, does
not block the vehicular or pedestrian visual access,
draught tolerant planting is being utilized, and graded
slopes are well planted to minimize erosion~
5. That the impact of the proposed gate on the site and the
surrounding area is being mitigated by the automatic
emergency access control device that has been installed
and has been inspected and approved by the Encinitas Fire
District.
NOW, THEREFORE, BE IT RESOLVED by the New Encinitas Community
Advisory Board of the City of Encinitas that the Design Review
Modification is approved subject to the following conditions:
1. This approval will expire on April 2, 1992, two years
after the approval of this project, unless the conditions
have been met or an extension has been approved by the
Authorized Agency~ and

8 2. That one shrub no less than three feet in height and no
taller than the wall shall be planted in front of the
wall such that it will not interfere with the opticon
sensor.
PASSED AND ADOPTED this 2nd day of April, 1990, by the
following vote, to wit:
AYES: Boardmembers Patton, Beck, Grajek, white and Quinn
