A RESOLUTION OF THE NEW ENCINITAS
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
PERMIT FOR 3 COMMERCIAL OFFICE/PROFESSIONAL ONE STORY
BUILDINGS TOTALLING 37,500 SQ. FEET,
PREPARATION OF 3 PADS OF 9,600 SQ. FEET FOR
COMMERCIAL OFFICE/PROFESSIONAL USE;
LANDSCAPING~ PARKING AND SIGN PROGRAM
FOR GARDEN VIEW PLAZA,
FOR PROPERTY LOCATED AT THE INTERSECTION OF
GARDENVIEW ROAD AND N. EL CAMINO REAL
AND AS FURTHER DESCRIBED IN ATTACHMENT A

WHEREAS, Byron White, applied for a Design Review permit for
3 commercial office/professional one story buildings totalling
37,500 sq. feet; preparation of 3 pads of 9,600 sq. ft. for
commercial office/professional use~ landscaping~ and parking for
the first phase of Garden View Plaza, for property of 5.112 acres
8 in the Office Professional (OP) Zone, located at the intersection
of Gardenview Road and N. El Camino Real, as required by Chapter
23.08, the City of Encinitas Design Review Ordinance~ and
WHEREAS, public hearings were conducted on the application
by the New Encinitas Community Advisory Board on June 4, July 2,
and 16, and August 6, 1990, and all persons desiring to be heard
were heard~ and
WHEREAS, evidence was submitted and considered to include
without limitation:
a. site Plan (sheet 1); Floor Plans (sheets 2-5) ~ Elevations
(sheets 6-8) ~ Landscape plan (sheets L-1 & L- 2) ~
Irrigation plans (sheets L-3 & L- 4) ~ Electrical plans
(sheets L- 3 & L-4); and Line of Sight drawings (sheets
1 & 2 of 2)
b. written information submitted with the application~

8 c. Oral testimony from staff, applicant, and public made a
part of the record at said public hearings;
d. CA~ staff reports (90-067-DR) dated May 29, June 27, and
July 11 and 20, 1990 which are on file in the office of
Planning and community Development; and
e. Additional written documentation.
NOW THEREFORE, BE IT RESOLVED by the New Encinitas community
Advisory Board of the City of Encinitas that the Design Review
permi t for 90-067-DR for 3 commercial office/professional one story
buildings totalling 37,500 sq. feet~ preparation of 3 pads of 9,600
sq. ft. for commercial office/professional use; landscaping; and
parking for the first phase of Garden View Plaza, for property of
5.112 acres in the Office Professional (OP) Zone, located at the
intersection of Gardenview Road and N. El Camino Real is hereby
approved subject to the following findings:

A. The project design is consistent with the General Plan,
a Specific Plan or the provisions of the Municipal Code.
Evidence:
The final map for the project was approved by the County of
San Diego. The modifications to the design of the project as
reviewed by the New Encinitas Community Advisory Board are
consistent with the City of Encinitas General Plan, Design
Review Ordinance and the Zoning Code, in land use allowing for
office professional uses and some retail in the office
professional zone.
B. The project is consistent with the Design Review
Guidelines.
Evidence:
The project was reviewed by the New Encinitas Community
Advisory Board and was modified to be in conformance with the
City of Encinitas Design Review Guidelines.

8 C. The project would not adversely affect the health, safety
or general welfare of the community.
Evidence:
The project would not adversely affect the health, safety or
general welfare of the community since the project has all
required utility connection approvals and will be developed
within City standards.
D. The project would not cause the surrounding neighborhood
to depreciate materially in appearance or value.
Evidence:
The proposal reflects a compatible level of design appearance
in conformance with the Design Review Guidelines and Design
Review Ordinance and is compatible with the design of other
office and commercial structures in the adjacent General
Commercial Zone on El Camino Real. Additionally, the proposed
design incorporates a high quality of design materials and
landscaping and will not be materially detrimental to
surrounding properties in this respect.
E. The proposed project is in conformance with section
23.08.74 of the Design Review Ordinance, Design and site
8 Layout, since the project has provided for adequate traffic
circulation on site and safe access to the existing streets
adjacent to the site, adequate size, location and number of
parking spaces, loading zones, trash enclosures, motorcycle
and handicap parking spaces, and provided vehicular and
pedestrian access to the adjacent properties. The project
provides dense landscaping for the graded slopes approved by
the Cümty of San Diego prior to City of Encinitas
incorporation, and the project has been designed to screen a
portion of the slope from the roadway by placing the
structures close to the base of the slope.
F. The proposed project is in conformance with section
23.08.76 of the Design Review Ordinance, Building Design,
since the exterior materials for the project have been
coordinated to be compatible with each other and the
surrounding area, the proposed structures are preserving views
to the extent possible, the roof top equipment is proposed to
be screened by planting on the slopes and louvered screening
around the equipment, a considerable amount of wood has been
introduced into the building design and the accent hardscape
for the project, and the size proposed for the structures is
comparable and even smaller than the existing commercial
projects to the south and southwest of the subject site.

8 G. The proposed project is in conformance with section
23.08.077 of the Design Review Ordinance, Landscape Design,
since the landscaping proposed will help create a lush
appearance and a diverse assortment of planting between the
street and the parking lot by providing scattered berming in
the landscape strip, a higher percentage of planting than
required in the parking lot, and adjacent to the buildings and
on the steep slope behind the buildings. The amount of
planting also creates an inviting atmosphere to the project
and encourages a return to nature by providing considerably
more planting that enhances the character of the community and
provides more of a village atmosphere.
H. The proposed project is in conformance with section
23.08.079 of the Design Review Ordinance, Privacy and
Security, since the project has been designed to observe fire
safety regulations, and the landscaping helps maintain the
privacy for the projects to be constructed in the future to
the north, east and south.
BE IT ALSO RESOLVED, that the Design Review Permit is approved
with the following conditions:
1. The project is approved as submitted on the site Plan
8 (sheet 1) ~ Floor Plans (sheets 2-5) ~ Elevations (sheets
6-8) ~ Landscape plan (sheets L-1 & L-2) ~ Irrigation plans
(sheets L-3 & L-4) ~ Electrical plans (sheets L-3 & L-4) ~
and Line of Sight drawings (sheets 1 & 2 of 2) and on
file in the Department of Planning and Community
Development, and shall not be altered without community
Advisory Board review and approval.
2. A plan shall be submitted for approval by the Director
of Planning and Community Development, the City Engineer,
and the Encinitas Fire Protection District regarding the
treatment of the site during the construction phase, and
the circulation and parking of construction workers'
vehicles and any heavy equipment needed for the
construction of the project.
3. Th~ wall options approved are options 1, 3, and 5 only,
with a restriction that no more than 50% of the tenant
spaces utilize the all glass option (option 5) at any
one time. The entry doors are approved to be constructed
with one lite and a clear fir frame surrounding the lite.
4. The design of the clock in the clock tower shall be
submitted prior to issuance of a building permit and the
sign program shall be submitted prior to final occupancy

8 approval for Design Review through the community Advisory
Board. The Board requested that the applicant consider
and return with an appropriate lighting design when the
signs are submitted other than interior lit signs.
5. A covenant shall be recorded agreeing to provide
rc.-::iprocal access to the property adjacent and to the
north of the subject site.
6. The roof-top screening shall be accomplished with
louvered screening and with trees on the easterly slope
behind the building as submitted in the revised screening
and landscape plan.
7. A wood trellis shall be added around the clock tower.
8. The first leg of a stairway leading to the upper easterly
pads is approved with trees and other planting to be
installed to the property line with trees and planting
for the rest of the slope on the easterly lot to be
submitted with the upper lot submittal.
9. The property owner shall record a landscape covenant in
the office of the County Recorder to run with the land,
agreeing that all required plantings and irrigation
systems shall be in place prior to use or occupancy of
8 new buildings or structures. All required plantings
shall be maintained in good growing condition and
irr-igation systems shall be maintained in good condition,
and whenever necessary, shall be replaced with new
equipment and/ or plant materials to ensure continued
compliance with applicable landscaping, buffering, and
screening requirements. All landscaping shall be
maintained in a manner that will not depreciate adjacent
property values and otherwise adversely affect adjacent
properties.
FIRE
10. Prior to delivery of combustible building materials on
site, water and sewer systems shall satisfactorily pass
all required tests and be connected to the public water
and sewer systems. In addition, the first lift of
asphalt paving shall be in place to provide adequate,
permanent access for emergency vehicles. Said access
shall be maintained to the satisfaction of the Fire
Department.

8 11. All designated emergency access roads shall be posted per
the Fire Department.
12. All two-way traffic aisles shall be a minimum of 24 feet
wide and aemergency access shall be provided, maintained
free and clear a minimum of 24 feet wide at all times
during construction in accordance with Fire District
requirements.
13. Submit a letter from the Encinitas Fire Protection
District stating satisfaction with the type and location
of Fire hydrants and the minimum required water flow in
gallons per minute together with a letter from the
appropriate agency certifying that the fire department's
mi~imum required water flow is available to serve the
project. provisions shall be made to ensure a maximum
water pressure at the hydrant of 250 psi. The
installation of a pressure reducing station may be
required. Fire hydrants shall be of ,a bronze type and
shall be identified by installing a "blue" reflective dot
on the street surface pursuant to Fire District
Standards.
14. Address numbers shall be clearly visible from the street
fronting the structure. Where structures are located off
8 a roadway on long driveways, a monument shall be placed
at the entrance where the driveway intersects the main
roadway. Address numbers shall be displayed on this
monument.
15. Structures shall be protected by automatic fire sprinkler
systems. Sprinkler systems shall be installed to the
satisfaction of the Encinitas Fire Protection District.
16. Prior to final recordation, the applicant shall submit
a letter from the Fire District stating that all
de~elopment impact, plan check and/or cost recovery fees
have been paid or secured to the satisfaction of the
District.
17. The owner/developer shall sign a covenant agreeing to pay
to the Encinitas Fire Protection District a fee to
mitigate the project impacts on Emergency Services.
Grading Conditions
18. The developer shall obtain a grading permit prior to the
commencement of any clearing or grading of the site.
19. The grading for this project is defined in Chapter 23.24

8 of the Encini tas Municipal Code. Grading shall be
pE':r-formed under the observation of a civil engineer whose
responsibility it shall be to coordinate site inspection
and testing to ensure compliance of the work with the
approved grading plan, submit required reports to the
City Engineer and verify compliance with Chapter 23.24
of the Encinitas Municipal Code.
20. No grading shall occur outside the limits of the PROJECT
unless a letter of permission is obtained from the owners
of the affected properties.
21. A soils/geological/hydraulic report (as applicable) shall
be prepared by a qualified engineer licensed by the state
of California to perform such work at first submittal of
a grading plan.
Drainaqe Conditions
22. The developer shall exercise special care during the
construction phase of this proj ect to prevent any offsi te
siltation. The developer shall provide erosion control
measures and shall construct temporary
desiltation/detention basins of type, size and location
as approved by the City Engineer. The basins and erosion
control measures shall be shown and specified on the
8 grading plan and shall be constructed to the satisfaction
of the City Engineer prior to the start of any other
grading operations. Prior to the removal of any basins
or facilities so constructed the area served shall be
protected by additional drainage facilities, slope
erosion control measures and other methods required or
approved by the City Engineer. The developer shall
maintain the temporary basins and erosion control
measures for a period of time satisfactory to the City
Engineer and shall guarantee their maintenance and
satisfactory performance through cash deposit and bonding
in amounts and types suitable to the city Engineer.
23. A drainage system capable of handling and disposing, of
all surface water originating within the project, and all
surface waters that may flow onto the proj ect from
adjacent lands, shall be required. Said drainage system
shall include any easements and structures as required
by the City Engineer to properly handle the drainage.
24. co'lcentrated flows across driveways and/or sidewalks
shall not be permitted.

8 street Conditions
25. Prior to any work being performed in the public right-
of-way, a right-of-way construction permit shall be
obtained from the Public Works office and appropriate
fees paid, in addition to any other permits required.
26. The developer shall obtain the city Engineer's approval
of the project improvement plans and enter into a secured
agreement with the city for completion of said
iIll¡)rovements prior to issuance of any building permit
within this project. The improvements shall be
constructed and accepted for maintenance by the city
council prior to occupancy of any building permit for any
unit within the project. The improvements are:
Construct standard concrete drive approaches.
27. street trees, a minimum of (15 gallon size or 24" box)
or larger, shall be installed in accordance with the city
of Encinitas standards.
utilities
27. The developer shall comply with all the rules,
regulations and design requirements of the respective
8 utility agencies regarding services to the project.
28. The developer shall be responsible for coordination with
S.D.G. & E., Pacific Telephone, and Cable TV authorities.
29. All proposed utilities within the project shall be
ip.~talled underground including existing utilities unless
exempt by the Municipal Code.
Code Enforcement
30. All illegal leasing signs shall be removed from the site
prior to submittal for building plan check.
