A RESOLUTION OF THE NEW ENCINITAS
COMMUNITY ADVISORY BOARD APPROVING THE DESIGN REVIEW
FOR A SIGN PROGRAM FOR
PHASE I OF GARDEN VIEW PLAZA
FOR PROPERTY LOCATED AT THE INTERSECTION OF
GARDENVIEW ROAD AND N. EL CAMINO REAL
AND AS FURTHER DESCRIBED IN ATTACHMENT A
(CASE NO. 90-067-DR, BYRON WHITE)
WHEREAS, Byron White, applied for Design Review for a sign
Program for Phase I of Garden View Plaza for property of 5.112
acres in the Office Professional (OP) Zone, located at the
intersection of Gardenview Road and N. El Camino Real, as required
by Chapter 23.08, the city of Encinitas Design Review Ordinance,
and Chapter 30.60 the City of Encinitas sign ordinance; and
-- WI!EREAS, public hearings were conducted on the application
by the New Encinitas Community Advisory Board on June 4, July 2,
and 16, August 6, October 1, and November 5, 1990, and all persons
desiring to be heard were heard; and
WHEREAS, evidence was submitted and considered to include
without limitation:
a. Garden View Plaza Comprehensive sign Plan for Phase I;
and Exhibits A, B, C, D, and E.
b. written information submitted with the application;
c. Oral testimony from staff, applicant, and public made a
part of the record at said public hearings;
d. CAB staff reports (90-067-DR) dated May 29, June 27, July
11 and 20, September 27, and November 1, 1990 which are
on file in the office of Planning and community
Development; and
e. Additional written documentation.

8 NOW THEREFORE, BE IT RESOLVED by the New Encinitas community
Advisory Board of the city of Encinitas that the Design Review for
the Sign Program for 90-067-DR for Phase I of Garden View Plaza,
for property of 5.112 acres in the Office Professional (OP) Zone,
located at the intersection of Gardenview Road and N. El camino
Real is hereby approved subject to the following findings:
A. The project design is consistent with the General Plan,
a Specific Plan or the provisions of the Municipal Code.
Evidence:
The final map for the project was approved by the County of
San Diego. The modifications to the design of the project as
reviewed by the New Encinitas Community Advisory Board are
consistent with the city of Encinitas General Plan, Design
Review Ordinance and the zoning Code, in land use allowing for
office professional uses and some retail in the office
professional zone.

B. The project is consistent with the Design Review
Guidelines.
Evidence:
The project was reviewed by the New Encinitas Community
Advisory Board and was modified to be in conformance with the
city of Encinitas Design Review Guidelines.
C. The project would not adversely affect the health, safety
or general welfare of the community.
Evidence:
The project would not adversely affect the health, safety or
general welfare of the community since the project has all
required utility connection approvals and will be developed
within City standards.

8 D. The project would not cause the surrounding neighborhood
to depreciate materially in appearance or value.
Evidence:
The proposal reflects a compatible level of design appearance
for the signing in conformance with the Design Review
Guidelines and Design Review Ordinance and is compatible with
the design of other office and commercial structures in the
adjacent General Commercial Zone on El camino Real since the
sign design, colors and materials are designed so as to be an
integral part of the architecture and ambiance of the
structures and the site layout.
E. The proposed proj ect is in conformance with section
23.08.078 of the Design Review Ordinance, Signs, since the
project has been designed to provide signing that is in scale
with the buildings~ the buildings have been designed so as to
afford adequate space and location to allow signing to be in
harmony with the architectural design of the structure and for
appropriate display of the signs~ the signs are designed so
as to be constructed of materials that appear integral to the
design of the structures~ the proposed design incorporates a
high quality of design materials with lighting designed so as
to be J..ess intense unobtrusive by utilizing a halo type
8 lighting that shines onto the building, rather than out from
the lettering, and accomplishes a silhouetting of the
lettering~ and the materials proposed ar durable and weather
resistant.
BE IT ALSO RESOLVED, that the Design Review for the Sign
Program is approved with the following conditions:
1. Garden View Plaza Comprehensive Sign Plan for Phase I ~
and Exhibits A, B, C, D, and E, and on file in the
Department of Planning and community Development, and
shall not be altered without Community Advisory Board
review and approval.
2. All illegal leasing signs shall be removed from the site
prior to submittal for building plan check.
