27, 1996.
Motion: Boardmember Fullwood - To adopt consent calendar as presented.

2. Public hearing for a proposed Major Use Pennit, Coastal Development Pennit, and Environmental
Initial Assessment for the legalization of a previous conversion of greenhouses to a packing plant
for agricultura1/horticultural products as derIDed in Chapter 30.16.040 of the Encinitas Municipal
Code, along with an associated family day care facility for employee children within an existing
single-family dwelling. LOCATION: 1613 Lake Drive. CASE NO.: 95-078 MUP/CDPÆIA;
APPLICANT: The Green House; ENVIRONMENTAL STATUS: Negative Declaration pending
certification; CONTACT PERSON: Senior Planner Cuniden.
STAFF RECOMMENDATION: Receive public testimony, review project design issues discussed
in staff report, and recommend that the Planning Commission adopt the draft resolution with
findings and conditions as presented by staff, or as modified by the Board, denying application 95-
078 MUP/CDPÆIA.
Motion: Boardmember Sarkozy - To recommend that the Planning Commission adopt the
draft resolution denying Case # 95-078 MUP/CDPIEIA based upon the fmdings presented by
8 staff in the draft resolution.

Mr. Cuniden briefed the Board that the appeal of their approval of a medical office building at
1801 Montgomery (applicant: Sinclair) was to be heard by the City Council on March 27,1996, and
8 that the Planning Commission would be hearing the application for a residence at 2531 Manchester
(applicant: Borow) recommended for approval by the Board at the Planning Commission's meeting
of march 28, 1996.

Encinitas, CA. Item # 2 above lies within the Coastal Zone of the City of Encinitas, but the decision of the
Planning Commission is not appealable to the Coastal Commission.
