Approval of Minutes: Regular Meeting of February 28, 1995. Contact Person:

Consensus of the Board to adopt the Minutes of February 28, 1995 as presented by
staff.

1. Public Hearing to consider a Varian~e request to encroach five (5) feet into the
25-foot Rear Yard Setback and to exceed by approximately 180 square feet the
Municipal Code standard which limits Accessory Apartments to 30% of the
square footage of the living area of the principal residence for a proposed 609
square foot attached Accessory Apartment (Granny Flat) to an existing Single
Family Residence. Applicant: Alphonso Hernandez. Location: 146 Five Crowns

STAFF RECOMMENDATION: Determine if Findings can be made for
Variance approval and, if so, adopt the Resolution presented in the Agenda
. Report with conditions as presented by staff or as may be amended by the Board.
Motion: Board Member Beck - To deny the Variance request without
prejudice to re-submit a revised request due to the inability to make Findings
for project approval based on the fact that an alternate design which would
have less impact to surrounding property owners is feasible and that the
degree of Variance requested to exceed the 30% size standard of the principal
residence for the proposed Accessory Unit is self-induced and would allow a
privilege not enjoyed by other property owners within the neighborhood.

Vote: Ayes - Beck, Weinstein, Edde, Felker and Van Reusen

2. Public Hearing to consider a request for Modification of Design Review Permit
No. 94-145 for the addition of a 5,000 square foot retail structure on the
southeast portion of the approved Circuit City project. Applicant: Nottingham
Associates. Location: 333 North EI Camino Real. Case No.: 95-051 DR-MOD.
Contact Person: Assistant Planner Olson.
. STAFF RECOMMENDATION: Approve the Design Review Permit
Modification with the conditions recommended by staff or as may be amended by
the Board.
Motion: Board Member Edde - To make the required Fmdings and
approve the Design Review Permit Modification with the conditions presented
by staff and the added stipulation that an alternate material for the awnings
may be approved by staff should the proposed material and color be in
substantial conformance with the originally approved awning material.
Second: Board Member Weinstein.
Vote: Ayes - Edde, Weinstein, Beck, Felker and Van Reusen
Nays - None

Motion: Board Member Weinstein - To adjourn the meeting at 8:30 P.M. to
the next regularly scheduled meeting.
Second: Board Member Van Reusen.
Vote: Ayes - Weinstein, Van Reusen, Edde, Beck, and Felker
