Approval of Minutes: Regular Meeting of March 21, 1995. Contact Person: Assistant
Planner Olson.
Motion: Board Member Beck - To adopt the Consent Calendar
approving the Minutes of March 21, 1995 as presented by staff.
Second: Board Member Weinstein.
Vote: Ayes - Beck, Weinstein, Felker and Van Reusen
Nays - None
Abstain - None
Absent - Edde

G. REGULAR AGENDA
. 1. Revised Variance request to encroach four (4) feet (formerly 5 feet) into the 25-
foot Rear Yard Setback for a proposed addition (formerly an Accessory
Apartment) to add additional living area to an existing Single Family Residence.
Applicant: Alphonso Hernandez. Location: 146 Five Crowns Way. Case No.:
95-035 V. Contact Person: Assistant Planner Olson.
STAFF RECOMMENDATION: Determine if Findings can be made for the
revised Variance request and, if so, adopt the Resolution presented in the Agenda
Report with conditions as presented by staff or as may be amended by the Board.
Motion: Board Member Weinstein - To make the required Findings and
adopt the Resolution approving the Variance request with the conditions
presented by staff.
Second: Board Member Beck.
Vote: Ayes - Beck, Weinstein, and Felker
Nays - Van Reusen
Abstain - None
Absent - Edde
. 2. Design Review request for the construction of an outdoor children's play area in
conjunction with an existing Burger King Restaurant. Applicant: Julian Josephson
/ Burger King. Location: 242 North El Camino Real. Case No.: 95-072 DR.
Contact Person: Assistant Planner Olson.
STAFF RECOMMENDATION: Approve the Design Review Permit with the
conditions recommended by staff or as may be amended by the Board.
Motion: Board Member Van Reusen - To make the required Findings
and approve the Design Review Permit with the conditions presented by staff.
Second: Board Member Weinstein.
Vote: Ayes - Weinstein, Beck, Felker and Van Reusen
Nays - None
Abstain - None
Absent - Edde

I. COMMUNITY ADVISORY BOARD/DIRECTOR REPORTS
. Virginia Felker reported to the Board on the items discussed at the Mayor/Chairman
breakfast meeting including an update on the planned library project, the timing of the
Encinitas Ranch public improvements, the Local Coastal Program status, and the
Commission/Boards training session scheduled for April 29th.
1. BUSINESS
The Board elected Mark Weinstein as Chair, Gerald Van Reusen as Vice-Chair, Cindy
Beck as Arbitration Committee Member, and Virginia Felker as Vice-Arbitration
Committee Member.
K. ADJOURNMENT:
Meeting to be adjourned to the next regularly scheduled meeting to be held Tuesday,
May 16, 1995. (The meeting of May 16th was cancelled due to a lack of Agenda items
and a special meeting was conducted on May 30th to hear the Design Review application
for the Encinitas Ranch Green Valley Commercial Center.)
Motion: Board Member Beck - To adjourn the meeting at 7:55 PM to the next
scheduled meeting.
Second: Board Member Van Reusen.
Vote: Ayes - Weinstein, Van Reusen, Beck, and Felker

filing the appeal within fifteen (15) calendar days after the hearing (except for
