A RESOLUTION OF THE BOARD OF DIRECTORS Ii'
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
DE LA TORRE ANNEXATION NO. 8710.0
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on March 18, 1987, as Resolution No.
87-13, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on September 14, 1987,
and this District was designated as the conducting district and
authorized by resolution to order said annexation without
notice or hearing and without an election pursuant to
Government Code, Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seq.;
a. The manner in which and by whom preliminary
proceedings were commenced was by resolution of
application by this Board as stated above.
b. The territory to be annexed has been designated 8714
by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as
hereinafter described.
c. The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described
in Health and Safety Code Section 4830.

d. The for the proposed anntlltion as set forth
in the resolution of application referred to above
are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used
for residential and/or commercial purposes and
provision for sewage disposal facilities for
said territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have
given their written consent to such annexation, as
provided in Government Code, section 56837; and
therefore, as approved and authorized by the Local
Agency Formation Commission, this Board may adopt its
resolution ordering the annexation without notice and
hearing and without an election, as provided in
Government Code, Section 57002.
g. The regular County assessment role will be utilized
and the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to state CEQA Guidelines Section 15303
(California Environmental Quality Act of 1970), the
Board finds that this annexation is not subject to
the environmental impact evaluation because it is
categorically exempt as a project initiated for the
purpose of making sewer service available to new
construction or conversion of small structures.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described
unincorporated territory in the County of San Diego, State of
California, be and it hereby is annexed to and made a part of
the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government
Code Section 54902.5 to the Executive Officer of the Local
Agency Formation Commission of San Diego County, so that the

OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"DE LA TORRE/KELLY ANNEXATION" TO THE
CARDIFF SANITATION DISTRICT
On motion of Commissioner Hersom, seconded by Commissioner Mahr, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sani ta tion District, which resol u tion was
adopted by the Board of Directors of said District as Resolution No. 87-13, dated
March 18, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Governmen t Code; and
WHEREAS, the terri tory proposed for annexation is as descri bed in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that the determination by the City of Encinitas
that this annexation is exempted by State CEQA Guidelines Section 15303 from the
requirements of CEQA has been reviewed and considered.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 2.7 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "De La
Torre/Kelly Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conduGting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

This is a request to annex 2.7 acres into the Cardiff Sanitation District.
Annexation is required in order to provide sewer service for two single family
dwellings.
RECOMMENDATIONS: That your Board
Adopt the resolution of the Board of Directors of the Cardiff Sanitation
District annexing territory to which the owners have consented.
Discussion:
This proposed annexation is in conformance with your Board's policy on annex-
ations, as two legal lots requesting service for a single family dwelling
on each lot (Condition 4). One lot (1.40 acres) has an existing single family
dwelling on a septic system. The other lot (1.13 acres) is vacant and the
owner plans to build a single family dwelling.
On March 18, 1987, your Board adopted a Resolution of Application for the
Annexation of Territory to the Sanitation District.
On September 14, 1987, the Local Agency Formation Commission adopted a reso-
lution approving this annexation and authorizing your Board to initiate pro-
ceedings in compliance with their resolution, without notice or hearing (DA
87-14).

Attorney Krauel noted that the Section number in the ordinance
should be changed from 3.16.260 to 3.16.268.

7. STAFF REPORTS
A. ci:-y Manaqer status Report: Number of Capacity Letters and
Waste Discharqe Permit~
As requested by the Board, Board Manager Shafer had submitted a
report showing 282 EDUs of outstanding sewer capacity commitments
as of January 31, 1987, and a total of 6704 EDUs of waste discharge
permits.
B. Interim City Engineer's Report: Reply to Cardiff Chamber
Question Reqardinq Several Adiacent Areas Not in Cardiff Sanitation
District
Interim City Engineer Hoffland explained that on the map which was
displayed there were areas shown in orange. Those adjacent to
Solana Beach are in the Solana Beach Sanitation District but
outside the City of Solana Beach. Those adjacent to Encinitas are
in Cardiff Sanitation District but outside the City of Encinitas.
Bei:ty Knutson, represen::ing the Cardiff by ::he Sea Chamber of
Commerce, asked why Seaside Park is not in the City and was told
that it is in the City but in the Solana Beach Sanitation District.

OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
JESSE DE LA TORRE ET AL ANNEXATION
On motion of Director. Luke seconded by Director Ornsted ,
following resolution is adopted:
WHEREAS, this Board of Directors has received a request from
JESSE DE LA TORRE AND LINDA KELLY (Document No. ) that the
hereinafter describ ed territor y to be annexed to the Card iff
Sanitation Distr ict (hereinafter referred to as the Sanitation
Distr ict); and
WHEREAS, this Board of Directors desires to initiate proceedings
to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code Sections 56800 and 56700,
application is hereby made to the Local Agency Formation Commission of
the County of San Diego for a pro po sed chang e of 0 rg ani za t ion as
follows:
A. This pro posal is made pursuant to the Cor te se-Knox Local
Government Reorgani zation Act of 1985 ($56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization and the

(1) The Sanitation District is empowered to and is engaged
in furnishing sewerage disposal facilities.
(2 ) The ten i tor y pro po sed to be ann ex ed to said Di s tr ict
is pro posed to be develo ped and used for residential and/or commercial
purposed and provision for sewage disposal facili ties for said
territory is essential for such purposes.
1. It is hereby requested that proceedings be taken for the
annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of influence of
the Sanitation District, which is the only affected city or district.
2. The Board finds, pursuant to Article 19, Section 15303 of the
State ErR Guidelines, that this annexation is not subj eat to the
env ironmental impact evaluation process because it is categorically
ex em pt a s a pro j ec t in it i a ted for the purpose of making sewer serv ice
available for new construction or conversion of small structures.
