1987-02 Sewer Service Provision L 8' Resolution No. 87-02 ) A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARDIFF SANITATION DISTRICT REGARDING PROVISION OF SEWER SERVICE WHEREAS, the moratorium on sewer service was repealed on January 7, 1987, and there is a present need to establish procedures for reinitiating service. NOW THEREFORE BE IT RESOLVED by the Board of Directors of the cardiff Sanitation District that: 1. commencing at 8:00 a.m. on January 9, 1987, a person in possession of a sewer capacity commitment letter may apply for and receive a wastewater discharge permit and a person in possession of a wastewater discharge permit may connect to the 8'i sewer system. 2. After 8:00 a.m. January 16, 1987, any person may apply for and receive a sewer capacity commitment letter and/or a wastewater discharge permit in accordance with the general procedures, policies and regulations of the District. 3. Between January 9, 1987 and July 7, 1987, all persons receiving a wastewater discharge permit shall, as a condition precedent to such receipt or reinstatement, be required to pay a $10 processing fee and to execute a written covenant as follows: In consideration of the issuance of the wastewater discharge permit, property Owner agrees to pay whatever additional and/or increased fees that may be lawfully enacted by the Cardiff Sanitation District after the issuance of the permit and prior to July 7, 8 1987, which are imposed upon persons connecting to the Cardiff Sanitation District system. Book # ~Page if t~ . l. 8\ 4. The following persons are not required to execute the covenant described in Section 3 above: A. Permittees with a wastewater discharge permit issued prior to January 7, 1987, which was reinstated by the repeal of the District's moratorium; and B. Persons who apply for a wastewater discharge permit after January 7, 1987, and before July 7, 1987, for a Class B project as defined by the city of Encinitas moratorium and who possess a sewer capacity commitment letter issued before January 7, 1987. BE IT FURTHER RESOLVED that when it is calculated, based upon outstanding sewer capacity commitment letters and wastewater discharge permits, that there remains only 250,000 8~ gallons per day of unused sewer system capacity, the District staff is directed to so advise the Board of Directors.
