[ 1 ggg-o020558 NOT APPROVED FOR DEVELOPMENT CERTIFICATE OF COMPLIANCE (Section 66499.35 of the Government Code) IN COMPLIANCE: The Director of Community Development of the City of Encinitas has determined that the parcels of real property described below have been divided or have resulted from a division in compliance with the Subdivision Map Act and with provisions of the City of Encinitas Municipal Code. Section 30.16.010 of the City of Encinitas Municipal Code specifies a minimum lot size of 3,950 sq. ft. for the subject R-11 Zone. This Certificate of Compliance creates one legal lot of 3,986 sq. ft. which is in compliance with development regulations pertaining to lot size and design. The second lot will be slightly nonconforming at 3,487 sq. ft. in net lot area. Pursuant to Chapter 30.76 of the Encinitas Municipal Code, this lot line adjustment establishes lots that are more consistent with the regulations of the Code and will not increase or intensify any inconsistency with applicable development regulations. This Certificate of Compliance is adjusting and consolidating the lots described herein, thereby reducing the degree of the existing nonconformity by establishing two legal lots, as compared with three existing, substandard lots of 2,500 sq. ft. each.
