It has been determined that the subject property meets the standards of conforming lots pursuant to Section 30.16.010 of the City of Encinitas Municipal Code. Assessor Parcel Numbers 73 and 74 will be standard for the Zoning Ordinance requirements for net lot area (2-8 acres depending on slope and flood plain) in the RR Use Regulations as of this date with Assessor Parcel Number 73 having approximately 10.98 acres and Assessor Parcel Number 74 having approximately 14.71 acres. The applicant seeks to establish two legal lots based upon information submitted to the Community Development Department. Staff reviewed past planning case files as well as evidence submitted by the applicant which included the following: an original Land Grant, Certificate #1510, dated June 29, 1885, a Grant Deed dated July 8, 1959 (document #7834,374), Parcel Map 924, Boundary Adjustment case no. 262-060-21B/C, Final Map 11055, Parcel Map 15474, and Parcel Map 11245. Based upon the evidence provided, parcels 262-061-73 and 262-061-74 were two legally established lots and determined to be adequately documented. Legal descriptions have been provided for the two parcels and a certificate of compliance is hereby issued for the subject parcels.
