RESOLUTION NO. 2003-10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS
VACATING VARIOUS PORTIONS OF 4TM STREET
BETVVEEN "F" STREET AND "G" STREET
WHEREAS, a request for the vacation of various portions of 4th Street between "F" Street and
"G" Street has been received by various individuals who are the owners of the properties adjoining the
above mentioned street; and
WHEREAS, on March 19, 2003, the City Council adopted Resolution No. 2003-10 expressing an
intention to vacate various portions of 4th Street, between "F" Street and "G" Street;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Encinitas approves
the vacation of public right-of-way over the various portions of 4th Street, between "F" Street and "G"
Street as shown in Exhibit "A", in accordance with the following:
The project as proposed is consistent with the City of Encinitas General Plan and
General Circulation Element and the Downtown Specific Plan.
The project as proposed complies with the California Environmental Quality Act since it is
exempt from environmental review.
There is no present or prospective public use for the public right-of-way.
RESERVING AND EXCEPTING therefrom the easement and right at any time, or from time to
time, to construct, maintain, operate, replace, remove, and renew sanitary sewers, storm drains and any
other utilities and appurtenant structures in, upon, over and across the above described portions of
highways proposed to be vacated.
NOW BE IT THEREFORE RESOLVED that the City Council of the City of Encinitas shall cause a
certified copy of the Resolution of Vacation, attested by the Clerk under seal, to be recorded without
acknowledgement, or further proof in the Office of the County Recorder. Upon such recordation, the
vacation process shall be deemed complete.
PASSED AND ADOPTED this 19th day of March, 2003, by the following vote, to wit:
AYES: Bond, Guerin, Houlihan, Stocks.
NAYS: None.
ABSENI: Dalager.
ABSTAIN: None. ~~~
