A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS,
CALIFORNIA, APPROVING THE SUMMARY VACATION, OF IRREVOCABLE OFFER
OF DEDICATION FOR PUBLIC ROAD PURPOSES FOR A PORTION OF LAND THAT
IS NORTH OF VIA DI FELICITA.
WHEREAS, Matthew J. and Joyce M. Roberts submitted an
application to vacate Irrevocable Offers of Dedication for
public road purposes for a portion of land that is north of
Via Di Felicita, in the community of Olivenhain; and
WHEREAS, the vacation proceedings are conducted under Chapter 4 of
Part 3 of the State of California Streets and Highway Code, and
WHEREAS, On November 27, 2001, City staff distributed notices to
residents within 575 feet of the proposed vacation (in order to
meet the minimum requirement of notifying a minimum of 20 property
owners) and to all public utility companies, and
WHEREAS, the City Council of the City of Encinitas on February 13,
2002, heard all persons interested in the proposed vacation at
6:00 p.m. in the City of Encinitas Council Chambers, 505 South
Vulcan Avenue, Encinitas, CA 92024; and
NOW BE IT THEREFORE RESOLVED that the City Council of the City of
Encinitas, has adopted the resolution to summary vacate
Irrevocable Offers of Dedication north of Via Di Felicita in the
community of Olivenhain; said lands were granted per documents:
Doc. No.74-231941 Recorded 08-26-1974
In accordance with the following:
RES-ROBERTS 7197 VA-dg.doc
The project as proposed is consistent with the City of
Encinitas General Plan and General Circulation Element.

The project as proposed complies with the California
Environmental Quality Act since it is exempt from
environmental review.
There is no present or prospective public use for the
right-of-way.
RESERVING AND EXCEPTING from vacation and abandonment all existing
easements pertaining to said property.
PASSED AND ADOPTED this 13th day of February,
following vote, to wit:
AYES: Bond, Guerin, Holz, Houlihan, Stocks.
NAYS: None.
ABSENT: None.
ABSTAIN: None.
