RESOLUTION NO. 2001-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS, CALIFORNIA, APPROVING
THE SUMMARY VACATION OF THE EXISTING IRREVOCABLE OFFERS OF DEDICATION FOR
PUBLIC ROADWAY PURPOSES OVER PARCEL 1 OF PARCEL MAP 3150 AND LOT 1 OF MAP
4308 AND RESERVING THEREFROM EASEMENTS FOR PUBLIC SEWER, WATER, STORM
DRAIN, ELECTRIC, GAS, TELEPHONE, AND CABLE TELEVISION PURPOSES, OVER THE FULL
WIDTH OF SAID IRREVOCABLE OFFER OF DEDICATION.
WHEREAS, a request for the vacation of the irrevocable offers of dedication over Parcel 1 of
Parcel Map 3150 and Lot 1 of Map 4308 has been received from Daniel and Mary Valhalla, owners of
Parcel 1 of Parcel Map 3150; and Bonnie Marsh and Jeff Hauptman, owners of Lot I of Map 4308,
and;
WHEREAS, the vacation proceedings are conducted under Chapter 4 of Part 3 of the State of
California Streets and Highway Code, and
WHEREAS, on November 27, 2000 city staff distributed notices to residents within 300 feet of
the proposed vacations and to all public utility companies, and
WHEREAS, the San Dieguito Water District, Leucadia Water District, San Diego Gas & Electric
Co., Pacific Bell, and Cox Cable have requested reservation of easement rights for existing water,
sewer, gas, electric, telephone, and cable television improvements and access respectively; and
WHEREAS, the City Council of the City of Encinitas on May 9, 2001, heard all persons
interested in the proposed vacation at 6:00 p.m., in the City of Encinitas Council chambers, 505 South
Vulcan Avenue, Encinitas, CA 92024;
NOW BE IT THEREFORE RESOLVED that the City Council of the City of Encinitas approves
summary vacation of the Irrevocable Offers of Dedication for public roadway purposes over Parcel 1 of
Parcel Map 3150 recorded October 23, 1974, as Document No. 74-282785, and Lot 1 of Map 4308,
recorded August 19, 1959 (as part of Map 4308) reserving public sewer, water, gas, electric,
telephone, and cable television easements over the full width of the vacated IOD's, in accordance with
the following:
The project as proposed is consistent with the City of Encinitas General Plan and
General Circulation Element,
The project as proposed complies with the California Environmental Quality Act since it
is exempt from environmental review,

3. There is no present or prospective public use for the right-of-way.
BE IT ALSO RESOLVED that the City Clerk of the City of Encinitas shall cause a
certified copy of the Resolution of Vacation, attested by the Clerk under seal, to be recorded
without acknowledgment or further proof, in the Office of the County Recorder. Upon such
recordation, the vacation process shall be deemed complete.
PASSED AND ADOPTED this 9th day of May, 2001, by the following vote, to wit:
AYES: Guerin, Holz, Hou]ihan, Stocks.
NAYS: None.
ABSENT: Bond.
ABSTAIN: None.
