A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS,
CALIFORNIA, APPROVING THE SUMMARY VACATION, OF IRREVOCABLE OFFERS
OF DEDICATION~ ON DOUBLE LL RANCH ROAD IN THE COMMUNITY OF
OLIVENHAIN
WHEREAS, the City of Encinitas made an application to vacate
Irrevocable Offers of Dedication on Double LL Ranch Road in the
community of Olivenhain; and
WHEREAS, the vacation proceedings are conducted under Chapter 4 of
Part 3 of the State of California Streets and Highway Code, and
WHEREAS, On January 21, 1998, City Council determined that Double
LL Ranch Road would only be retain for public use as an emergency
access road to connect to Carlsbad; and
WHEREAS, On April' 9, 1998, city staff distributed notices to
residents within 300 feet of the proposed vacation and to all
public utility companies; and
WHEREAS, the City Council of the City of Encinitas on May 13,
1998, heard all persons interested in the proposed vacation at
6:00 p.m. in the City of Encinitas Council Chambers, 505 South
Vulcan Avenue, Encinitas, CA 92024; and approved the vacation
subject to conditions for the retention and construction of an
emergency access road; and
WHEREAS, On December 6, 2000, City Council awarded a construction
contract to complete the connection of the emergency access road;
and

NOW BE IT THEREFORE RESOLVED that the City Council of the City of
Encinitas, has adopted the resolution to summary vacate
Irrevocable Offers of Dedication on Double LL Ranch Road in the
community of Olivenhain; said lands were granted per documents:
Doc. No.1991-0146056 Recorded 04-02-1991, in the office of
the San Diego County Recorder;
Map No. 12819 Recorded May 21, 1991, as File No. 91-238890 in
the office of the San Diego County Recorder, said dedication over
Lot 1 and Lot 7,
in accordance with the following:
The Project as proposed is consistent with the City of
Encinitas General Plan and General Circulation Element.

The project as proposed complies with the California
Environmental Quality Act since it is exempt from
environmental review.
o
There is no present or prospective public use for the
right-of-way, except as reserved.
RESERVING AND EXCEPTING from vacation and abandonment, a perpetual
easement for the public for emergency access upon, through, under,
over and across the above describe real property for the
installation, construction, operation, maintenance, repair,
replacement, and reconstruction of an emergency access road;
excluding from the reservation the westerly 334.19 feet of the
Irrevocable Offer of Dedication on Lot 7 of said Map No. 12819, to
the said line being described as the westerly limit of Double LL
Ranch Road.
