A RESOLUTION OF THE CITY COUNO~G~AL DOC' LOST
OF THE CITY OF ENCINITA8
APPROVINO A SUMMARY VACATION OF AN
IRREVOCABLE OFFER OF DEDICATION
(OLD ALIGNMENT OF QUAIL OARDEN8 ROItD)
WHEREAS, a request for vacation of an Irrevocable Offer of
Dedication along the old alignment of Quail Gardens Road has been
submitted by Dave Wall of Conway Associates on behalf of William
Brown;
WHEREAS, Quail Gardens Road has been superseded by relocation
by the adoption of the General Circulation Element by the City
Council;
WHEREAS, this vacation will not cut off all access to a
person's property which, prior to relocation, adjoined Quail
Gardens Road.
WHEREAS, the Irrevocable Offer of Dedication has not been used
for the purpose for which it was dedicated or acquired for five
consecutive years immediately preceding this proposed vacation;
WHEREAS, there are no other public facilities located within
the Dedication;
WHEREAS, the Irrevocable Offer of Dedication lies within
property under one ownership and does not continue through such
ownership or end touching property of another.
NOW, THEREFORE, BE IT RESOLVED that the city Council of the
city of Encinitas approves a summary vacation of the Irrevocable
Offer of Dedication recorded as File/Page No. 74-309926 on November
25, 1974 in the office of the County Recorder of San Diego County
(See Exhibit "B"), in accordance with the following:
1. The project as proposed is consistent with the City of
Encinitas General Plan and General Circulation Element.

The project as proposed complies with the California
Environmental Quality Act since it is exempt from
environmental review.
There is no present or prospective public use for the
Irrevocable Offer of Dedication.
PASSED AND ADOPTED this 14th day of June, by the following
vote, to wit:
AYES: Gaines, Hano, Omsted, Shea, Slater
NAYS: None
ABSENT: None
