WHEREAS, a request for vacation of an utility easement ha~

been submitted by Boczanowski, Inc.;
WHEREAS, a public hearing was conducted on the application on
July 27, 1987, as required by law and all persons requesting to
be heard were heard; and
WHEREAS, the city Council considered:

Staff report dated July 27, 1987;
Oral information submitted at hearing; and
Written information submitted at hearing.
NOW THEREFORE, BE IT RESOLVED that the City Council of the
City of Encinitas approves a summary vacation of utility
easements within C Street between llth Street & 12th Street & the
northerly 10' of llth Street west of Rancho Santa Fe Road,
Encinitas, in accordance with the following findings:
The project as proposed is consistent with the city of
Encinitas General Plan since the reservation of utility
easements is not addressed.
The project as proposed complies with the California
Environmental Quality Act and State and County
Guidelines since it is exempt from environmental
review.

The utility easement reservation cannot be used as a non- ~
motorized transportation facility.
There is no present or prospective public use for the
utility easement reservation.
