ANNEXING TERRITORY TO WHICH OWNERS HAVE. CONSENTED
LIVENICK ANNEXATION
WHEREAS, pursuant to the cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedin,gs were commenced by resolution of

application by this Board on April 1, 1987 as Resolution No.
8714, for annexation to the Cardiff sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation co~mission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation commission of San Diego county on September 14, 1987,
and this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an election pursuant to Government Code,
section 56837;
NOW THEREFORE IT IS RESOLVED, ORDERED AND DETER11INED,
pursuant to Government Code section 57025 et seq.;
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
(b) The terr i tory to . be annexed has been designated the
Livenick Annexation by the Local Agency Formation
commission, and the exterior boundaries of such
territory are as'hereinafter described.

will be benefited by such annexation as described in
Health and Safety Code section 4830. \
(d) The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The terr i tory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial purposes and
provision for sewage disposal facilities for said
territory is essential for such purposes.
(e) The terms and conditions of the proposed annexation
are: None.
(f) All owners of land within such territory have given
their written consent to such annexation, as prov ided
in Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
commission, this Board may adopt its resolution
ordering the. annexation without notice and hearing and
without an election, as provided in Government Code,
section 57002.
(g) The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
(h) Pursuant to state CEQA Guidelines section 15303
{California Environmental Quality Act of 1970), the
Board finds that this annexation is not subject to the
environmental impact evaluation because it is
categorically exempt as a proj ect initiated for the
purpose of making sewer service available to new
construction or conversion of small structures.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code section 57002, the following described territory
in the City of Encinitas, state of California, be and it hereby
is annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government
Code section 54902.5 to the Executive Officer of the Local Agency

OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND AP})ROVING THE
"LIVENICK ANNEXA TION" TO THE CARDIFF SANITATION DISTRICT
On motion of Commissioner Hersom, seconded by Commissioner Mahr, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District,. which resolution was
adopted by the Board of Directors of said District as Resolution No. 87-14, dated
April 1, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation is as described in the
appljcation on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE. BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(I) The Commission certifies that the determination by the City of Encinitas
that this annexation is exempted by State CEQA Guidelines Section 15303 from the
requirements of CEQA has been reviewed and considered.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the t~rritory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
'ownership.
(5) The district is a registered-voter district.
(6) The territory includes 0.75 acre and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "Livenick
Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby'authorized and directed to mail certifieq
copies of this resolution as provided in Section 56853 of the Government Code.

2. ORAL COMMUNICATION
Public Works Director August informed the council that the
San Elijo Water Pollution Control Facility Joint Powers
Authority had been served with a notice from the Regional
Water Quality Board stating that Cardiff Sanitation District
v.'ill be receiving a change in permit in February. As part
of the permit transfer in February there will be a cease and
desist order which in essence instructs the District to stop
what they are currently doing and to proceed with going to
secondary treatment. Public Works Director August handed
out a tentative pre:iminary upgrade anò expansion
implementation schedule which had been approved by thé Joint
Powers Authority. He said it was anticipated that the
implementation schedule dates would be met.

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
LIVENICK ANNEXATION
WHEREAS, pursuant to the Cortese -Kno>: Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on April 1, 1987 as Resolution No.
8714, for annexation to the Cardiff sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation commission of San Diego county on september 14, 1987,
and this District was designated as the conducting district and
authorized by resolution to order said annexation vli thout notice
or hearing and without an election pursuant to Government Code,
section 56837;
NOW THEREFORE IT IS RESOLVED, ORDERED AND DETER!1INED,
pursuant to Government Code section 57025 et seq.;
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
(b) The territory to be annexed has been designated the
Livenick Annexation by the Local Agency Formation
Commission, and the exterior boundaries of such
territory are as hereinafter described.

(d) The reasons for the proposed annexation as set forth ~,
the resolution of application referred to above are:
1. The District is empowered to and 1S engaged 1n
furnishing sewage disposal facilities.
2. The terri tory proposed to be annexed to said
District 1S proposed to be developed and used for
residential and/or commercial purposes and
provision for sewage disposal facilities for said
territory is essential for such purposes.
(e) The terms and conditions of the proposed annexation
are: None.
(f) All owners of land within such territory have given
their written consent to such annexation, as provided
in Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
commission, this Board may adopt its resolution
ordering the annexation without notice and hearing and
wi thout an election, as provided in Government Code,
section 57002.
(g) The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
(h) pursuant to state CEQA Guidelines section 15303
(California Environmental Quality Act of 1970), the
Board finds that this annexation 1S not subject to the
environmental impact evaluation because it 1S
categorically exempt as a proj ect initiated for the
purpose of making sewer service available to nev!
construction or conversion of small structures.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code section 57002, the following described territory
1n the city of Encinitas, State of California, be and it hereby
is annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government
Code section 54902.5 to the Executive Officer of the Local Agency

Annexation is required in order to provide sewer service for a single family

RECOMMENDATIONS: That your Board
1. Adopt the resolution of the Board of Directors of the Cardiff Sanitation
District annexing territory to the District.
Discussion:
This proposed annexation is in conformance with your Board's policy on annex-
ations, as a future single family dwelling on a legal lot (Condition 4).
Zoning is R-R-2 which allows 2 dwelling units per acre (DUA). The Community
Plan is Residential 3 which also allows 2 DUA.
On April 1, 1987, your Board adopted a Resolution of Application for annex-
ation of territory to the Sanitation District. On September 14, 1987, the
local Agency Formation ComITission adopted a resolution approving this annex-
ation and authorizing your Board to initiate proceedings in compliance with
their resolution, without notice or hearing (DA87-17).

OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"LIVENICK ANNEXATION" TO THE CARDIFF SANITATION DISTRICT
On motion of Commissioner Hersom, seconded by Commissioner Mahr, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was
adopted by the Board of Directors of said District as Resolution No. 87-14, dated
April 1, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that the determination by the City of Encinitas
that this annexation is exempted by State CEQA Guidelines Section 15303 from the
requirements of CEQA has been reviewed and considered.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 0.75 acre and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "Livenick
Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

This is a request to annex 0.75 acres into the Cardiff Sanitation District.
Annexation is required in order to provide sewer service for a single family
dwelling.
RECOMMENDATIONS: That your Board
1) Find pursuant to State CEQA Guidelines, Section 15303 (California Envir-
onmental Quality Control Act of 1970), that this project is categorically
exempt from evaluation.
2) Adopt the resolution of application of the Board of Directors of the
Cardiff Sanitation District for annexation to the District.
Discussion:
This proposed annexation is in conformance with your Board's policy on annexations,
as a future single family dwelling on a legal lot (Condition 4). Zoning
is R-R-2 which allows 2 dwelling units per acre (DUA). The Community Plan
is Residential 3 which also allows 2 DUA.

FOR THE ANNEXATION OF TERRITORY

WHEREAS, this Board of Directors has received a request from
Edward Livenick (Document No. ) that the hereinafter described
territory to be annexed to the Cardiff Sanitation District
(hereinafter referred to as the Sanitation District): and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District:
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation Commission
of the County of San Diego for a proposed change of organization as
follows:
A. This proposal is made pursuant to the Cortese-Knox Local

Code).
B. The nature of the proposed change of organization and the
names of all districts for which any such change of organization is

their written consent to such annexation subject to the
aforementioned terms and conditions.
H. The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and is
engaged in furnishing sewerage disposal facilities.
( 2) The territory proposed to be annexed to said
District is proposed to be developed and used for residential
andlor commercial purposed and provision for sewage disposal
facilities for said territory is essential for such purposes.
1. It is hereby requested that proceedings be taken for the
annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of influence
of the Sanitation District, which is the only affected city or
district.
2. The Board finds, pursuant to Article 19, section 15303 of
the State EIR Guidelines, that this annexation is not subject to
the environmental impact evaluation process because it is
categorically exempt as a project initiated for the purpose of
