A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
MCBRIDE-ELDER ANNEXATION NO. 8711.0
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seg.)
preliminary proceedings were commenced by resolution of
application by this Board on July 1, 1987, as Resolution No.
87-29, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on August 3, 1987,
and this District was designated as the conducting district and
authorized by resolution to order said annexation without
notice or hearing and without an election pursuant to
Government Code, Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seg.;
a. The. manner in which and by whom preliminary
proceedings were commenced .was by resolution of
application by this Board as stated above.
b. The territory to be annexed has been designated 8713
by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as
hereinafter described.
c. The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described
in Health and Safety Code Section 4830.

are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used
for residential and/or commercial purposes and
provision for sewage disposal facilities for
said territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: . None.
f. All the owners of land within such territory have
given their written consent to such annexation, as
provided in Government Code, Section 56837; and
therefore, as approved and authorized by the Local
Agency Formation Commission, this Board may adopt its
resolution ordering the annexation without notice and
hearing and without an election, as provided in
Government Code, section 57002.
g. The regular County assessment role will be utilized
and the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to State CEQA Guidelines section 15074
(California Environmental Quality Act of 1970), the
Board finds in accordance with the Negative
Declaration dated November 17, 1986, prepared with
respect to the proposed annexation and the project
designated TM 4606, Log No. 86-8-47, dated November
17, 1986, that the project would have no significant
impact on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described
unincorporated territory in the County of San Diego, State of

California, be and it hereby is annexed to and made a part of
the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government
Code Section 54902.5 to the Executive Officer of the Local
Agency Formation Commission of San Diego County, so that the

OF THE COUNTY OF SAN DIEGO
MAKING DETERMINA TIONS AND APPROVING THE
"MCBRIDE/ELDER ANNEXA TION" TO THE CARDIFF SANIT A TION DISTRICT
On motion of Commissioner Hostler, seconded by Commissioner Mahr, the
following resolution is adopted: .
WHEREAS, a resolution of application was submitted to this Commission, for
annexation of territory to the Cardiff Sanitation District, which resolution was )
adopted by the Board of Directors of said District as Resolution No. 87-29, dated July
I, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that it has reviewed and considered the
information contained in the original Negative Declaration and later amendment
prepared by the City of Encinitas.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district. -
(6) The territory includes 21.8 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the
"McBride/Elder Annexation" to the Cardiff Sanitation District.

(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
MCBRIDE-ELDER ANNEXATION NO. 8711.0
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on July 1, 1987, as Resolution No.
87-29, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on August 3, 1987,
and this District was designated as the conducting district and
authorized by resolution to order said annexation without
notice or hearing and without an election pursuant to
Government Code, section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code section 57025 et seq.;
a. The manner in which and by whom preliminary
proceedings were commenced was by resolution of
application by this Board as stated above.
b. The territory to be annexed has been designated 8713
by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as
hereinafter described.
c. The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described
in Health and Safety Code section 4830.

1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used
for residential and/or commercial purposes and
provision for sewage disposal facilities for
said territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have
given their written consent to such annexation, as
provided in Government Code, section 56837; and
therefore, as approved and authorized by the Local
Agency Formation Commission, this Board may adopt its
resolution ordering the annexation without notice and
hearing and without an election, as provided in
Government Code, section 57002.
g. The regular County assessment role will be utilized
and the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to state CEQA Guidelines section 15074
(California Environmental Quality Act of 1970), the
Board finds in accordance with the Negative
Declaration dated November 17, 1986, prepared with
respect to the proposed annexation and the proj ect
designated TM 4606, Log No. 86-8-47, dated November
17, 1986, that the project would have no significant
impact on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code section 57002, the following described

IT IS FURTHER ORDERED that the Clerk of this Board

Agency Formation Commission of San Diego County, so that the
Executive OffiCer~ay make the filings requ.ed by Chapter 8
(commencing with section 57200), Part 5, Division 1, Title 6 of
the Government Code and by Chapter 8 (commencing with section
54900), Part 1, Division 2, Title 5 of the Government Code.

The following filings to be made after the conducting authority has
ordered the change(s) of organization (boundary change(s)) must be pro-
cessed by the LAFCO office:

3. County Surveyor
4. County Auditor
5. State Board of Equalization
Any other filings remain the responsibility of the conducting authority.
Proceedings must be initiated within 35 days after adoption of the Com-
mlssion's resolution, and completed within one year after LAFCO approval,
or the proposal must be considered abandoned (Calif. Govt. Code Sects.
57001 and 57002).
If your Board/Council adopts a resolution/ordinance ordering the boundary
change (s), the following materials must be forwarded to the LAFCO office:

MAKING DETERMINATIONS AND APPROVING THE
"MCBRIDE/ELDER ANNEXATION" TO THE CARDIFF SANITATION DISTRICT
On motion of Commissioner Hostler, seconded by Commissioner Mahr, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sani ta tion District, which resol u tion was
adopted by the Board of Directors of said District as Resolution No. 87-29, dated July
I, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation IS as described In the
application on file with the Local Agency Formation Commission; and
WHEREAS, the' Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that it has reviewed and considered the
inf orma tion contained In the original Negative Declaration and later amendment
prepared by the City of Encinitas.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory incl udes 21.8 acres and is uninha bi ted.
(7) The territory proposed to be annexed IS hereby designa ted the
"McBride/Eider Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation Distriet as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

RECOMMENDATIONS: That your Board
Adopt the resolution of the Board of Directors of the Cardiff Sanitation

Discussion:
On November 17. 1986, your City Council granted a ~ajor Use Permit P86-043
and adopted a resolution approving a Tentative ~1ap (TM 4606) for this
project.
On July I, 1987, your Board adopted a Resolution of Application for
the Annexation of Territory to the Sanitation District.

AttorrJey Krauel said the Notice of Intention by the Board starts
the process and that is when a person can come in and address the
Board stating his/her side. Mr. Krauel was asked to write
language into the Notice of Hearing which would give a good
explanation to the property owner and to bring the draft notice
to the next Board meeting for the Board's consideration.

A. Discussion Reaardinq Environment<3.1 Determination for
McBride-Eld~r Annexation.
Pat Murphy explained that the initial Resolution submitted to
LAFCO was found to have several flaws (incorrect verbiage) which
required an amended application for Annexation of McBride/Elder
Property.
Scott Englehorn, representing J. L. Elder Corp., requested the
Board's continued support of McBride-Elder Annexation. He also
addressed concerns of the Board regarding several environmental
issues i. e., displacement of habitat of the black-tailed
gnatcatchers. According to a recent biological study of the area
involved, only one pair was found. This species has no trouble
relocating its habitat.
Board Member Gaines requested that, in the future, a report be
given to the Board regarding habitat displacement that may occur
because of annexation.
Gaines moved, Luke seconded to adopt Resolution 87-29 amending
the McBride-Elder Application for Annexation. Motion carried:

B. Request by Terral Investment Co. for District to

WHEREAS, this Board of Directors has received a request from
ALLISON BURNS McBRIDE, H. LESLEY McBRIDE, JERRY ELDER that the

FINDINGS:
The Cardiff Sanitation District Board of Directors has examined
the initial study and finds that the proposed project will not
have a significant effect on the environment and that an
environmental impact report need not be prepared pursuant to the
city Procedures for Environmental Impact Review.
INITIAL STUDY SUMMARY
PROJECT DESCRIPTION AND LOCATION
This project is a division of 21.8 acres into twenty-eight lots,
including annexation to the Cardiff Sanitation District and
installation of a 1000' extension of an 8" sewer line. project
is located north of Manchester Avenue, west of Trabert Ranch
Road, and east of El Camino Real in the City of Encinitas.
Tentative Map 4606 received conditional approval requiring
annexation to the Cardiff Sanitation District.

ENVIRONMENTAL SETTING:
The project site is a deep canyon of Torrey Sandstone which has
steep slopes covered with Inland Sage Scrub. Scenic bluffs
characterize the highlands to the west and are visible for
several miles. Black-tailed Gnatcatcher exist on the property
and in the surrounding area. Manchester Road passes to the
south.
POTENTIALLY SIGNIFICANT EFFECTS:
Scenic bluffs and Inland Sage Scrub habitat characterize the west
third of the property and are visible throughout the surrounding
area. Black-tailed Gnatcatchers utilize the site for nesting and
feeding. These resources are protected by the Local Coastal Plan
and the Conservation Element at the General Plan. Traffic along
Manchester Road could impact lot 28. A comment has been received
regarding the growth inducing impacts associated with the

MITIGATING MEASURES PROPOSED BY APPLICANT:
Prior to approval of the Final Map, the applicant shall to the
satisfaction of the Director of the Department of Planning:
1. Dedicate an Open Space Easement over Lot 28, which will be
extinguishable when satisfactory noise attenuation barriers
or other attenuation measures have been approved on the
grading plan.
2. Dedicate an Open Space Easement over the steep slopes of
Lots 1-17 and all of Lots 31 and 32. The Open Space
Easement on all but Lot 31 shall remain in native vegetation
with no brush removal, trenching for utilities, vehicular
access, or disturbance of biological or scenic resources
allowed.
3. Submit a landscape plan for Lot 31 which is compatible with
the surrounding native vegetation.
4. Submit a maintenance plan for the siltation basins which can
be maintained during and after each seasonal storm.
REASONS TO SUPPORT FINDING OF NEGATIVE DECLARATION:
Research and review failed to disclose any environmental issues
not mitigated by project design.
GROWTH INDUCING COMMENTS:
The connection to the sewer line was a requirement of the project
approval. The proj ect is at a density of a little more (1. 3
du/ac) than one dwelling per acre. Under current zoning
regulations (Ordinance No. ) density for other parcels
within the area is at a density of 2 units per acre. Sewering
limitation to the east may occur due to topography constraints.
without this 6-8" sewer line (the minimal acceptable size
required), alternate connections could be made off of the
Olivenhain trunk.
In addition, it is not unfeasible that any future project along
Manchester could finance the construction of a sewer line
extension for greater than 1000 feet. The extension of a 6-8"
sewer line does not appear to be growth inducing when it is not
cost prohibitive for a future project to provide sewer
connections other than to the project.

Backqround
The Board of Directors of the Cardiff Sanitation District
approved the above-referenced annexation on March 18, 1987.
However, the adopted resolution and environmental issues
incorrectly described the project, resulting in the necessity to
return to the Board for action.
The previous Resolution to annex the property did not correctly
identify the subj ect parcel acreage (5.7 acres instead of 21.8
acres). The Resolution also confused the issue of the
appropriate environmental determination.
The County prepared negative declaration failed to discuss the
entire project; specifically, that of annexation and the 1,000
foot extension of an 8" sewer lines.
Discussion
Attached is the revised Resolution and documents amending the
negative declaration to identify the 1,000 foot extension of an
8" sewer line and annexation.
A letter of comment was received from the Encini tas Taxpayers
Association stating that the 8" line extension is growth inducing
and a full EIR (Environmental Impact Report) should be required.
Staff did not agree with this in that an EIR (if appropriate)
should have been required at the project stage (Tentative Map
4606) and not at annexation to the District, such annexation
being a condition of the map.
In addition, staff did not feel that other (future) projects are
blocked from developing should the McBride project not extend the
sewer line. other developments could extend the sewer line the
entire length along Manchester Avenue without the McBride
extension. Staff, therefore, did not consider this sewer line
extension as being growth inducing.

Staff did discuss this with Mr. Bonde. Mr. Bonde stated his
concerns were resolved.
Recommendation
Staff recommends to the Board to adopt Resolution No. 87-29 which
certifies a negative declaration and approves the annexation.

Dear Chairman Shea and Members of the Board of Directors:
It is respectfully requested that you conduct a thorough
environmental asse~sment of the proposed 21.8 acre McBride/Elder
annexation to the Cardiff Sanitation District (87-12). We are
concerned that there may be major growth inducing impacts
associated with this project and the installation of
approximately 1000 feet of 8 inch sewer main. The community
needs to know what other developments will flow from this project
and what the overall impact will be on th~ San Elijo Treatment
facility.
The community should be told if a full E.I.R. has been conducted
on this project and if not, why not, considering the location and
steep terrain? They should know if persons associated with the
development of the adjacent Chin 125 acres are involved in the
planning of and payment for the oversized 8 inch sewer main?
It is requested that the annexation process for this property be
deferred until all ,requested information has been provided and
questions resolved.

A. Consideration of Resolution 87-09 Annexinq Terral

omsted moved, Luke seconded to adopt Resolution 87-09 annexing
Terral Subdivision.
Board Member Gaines stated she would like to see the plans for the
layout of the sewer lines.
Board Member Luke stated he was unsure whether his firm had worked
on this project and he would, therefore, disqualify himself from
voting.
Motion carried with Gaines, Omsted, steel voting aye, Luke
abstaining.
B. Consideration of Applications for Annexation
1. Resolution 87-10, H.G. Frankland, 2.68 Acres
Omsted moved, Luke seconded to adopt Resolution 87-10 applying for
annexation of territory to the Cardiff Sanitation District, with
the finding that the project was categorically exempt from
environmental quality review. Staff was asked to direct to the
Planning Department information that this property is pronG to
landslides. Motion carried unanimously.
2. Resolution 87-11, Georqe smith, 0.37 Acres
Luke moved, Omsted seconded, carried unanimously to adopt
Resolution 87-11, applying for annexation to the Cardiff
Sanitation District, with the finding that it would have no
significant effect on the environment and meets the requirements
for a negative declaration.
3. Resolution 87-12, McBride-Elder, 21. 67 Acres
Omsted moved, Luke seconded, carried unanimously to adopt

Hippert and Cardiff Sanitation District and Introduction of

Attorney Krauel noted that the section number in the ordinance
should be changed from 3.16.260 to 3.16.268.

As requested by the Board, Board Manager Shafer had submitted a
report showing 282 EDUs of outstanding sewer capacity commitments
as of January 31, 1987, and a total of 6704 EDUs of waste discharge
permits.
B. Interim city Enqineer's Report: Replv to Cardiff Chamber
Question Reqardinq Several Adlacent Areas Not in Cardiff Sanitation
District
Interim City Engineer Hoffland explained that on the map which was
displayed there were areas shown in orange. Those adjacent to
Solana Beach are in the Solana Beach Sanitatio:J District but
outside the City of Solana Beach. Those adjacent to Encinitas are
in Cardiff Sanitation District but outside the city of Encinitas.
Betty Knutson, representing the Cardiff by the Sea Chamber of
Commerce, asked why Seaside Park is not in the City and v;as told
that it is in the City but in the Solana Beach Sanitation District.

This is a request to annex 21.67 acres into the Cardiff Sanitation
District. Annexation is required in order to provide sewer service
for a 28 unit, single family dwelling, subdivision project.
RECOMMENDATIONS: That your Board
1) Adopt the resolution of application of the Board of Directors of
the Cardiff Sanitation District for annexation to the District.
2) Find pursuant to State CEQA Guidelines, Section 15074 (California
Environmental Quality Control Act of 1970), that this project would
have no significant effect on the environment (Negative Declaration
dated November 17, 1986, TM 4606, Log No. 86-8-47).
Discussion:
On November 17, 1986, your City Council granted a Major Use Permit
P86-043 and adopted a resolution approving a Tentative Map (TM 4606)
for this project.
The zoning is R-R-2 which will allow 2 dwelling units per acre (DUA).
The Community Plan Designation is Residential 3 which also allows 2
DUA.

WHEREAS, this Board of Directors has received a request from
ALLISON BURNS MCBRIDE, H. LESLEY MCBRIDE, JERRY ELDER (Document
No. ) that the hereinafter described territory to be
annexed to the Cardiff Sanitation District (hereinafter
referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code Sections 56800 and 56700,
application is hereby made to the Local Agency Formation Commission
of the County of San Diego for a proposed change of organization as
follows:
A. This proposal is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985 ($56000, et. seq., Govt.
Code).
B. The nature of the proposed change of organization and the
names of all districts for which any such change of organization is

(1) The Sanitation District is empowered to and is
engaged in furnishing sewerage disposal facilities.
( 2) .The territory proposed to be annexed to said
District is proposed to be developed and used for residential
and/or commercial purposed and provision for sewage disposal
facilities for said territory is essential for such purposes.

annexation of territory as hereinabove proposed.

J. This annexation is consistent with the sphere of influence
of the Sanitation District, which is the only affected city or
district.

respect to the proposed annexation on project designated TM 4606,

The City of Encinitas City Council has examined the Initial Study and finds that
the proposed project will not have a significant effect on the environment, and
that an Environmental Impact Report need not be prepared pursuant to the City of
Encinitas Procedures for Environmental Impact Review, adopted from the County of
San Diego in October 1,1986.
INITIAL STUDY SUMMARY
PROJECT DESCRIPTION AND LOCATION:
This project is a division of 21.8 acres into twenty-eight lots north of
Manchester Avenue west of Trabert Ranch Road, and est of El Camino Real in the
City of Encinitas.

ENVIRONMENTAL SETTING:
The project site is a deep canyon of Torrey Sandstone which has steep slopes
covered with Inland Sage Scrub. Scenic bluffs characterize the highlands to the
west and are visible for several miles. Black-tailed Gnatcatcher exist on the
property and in the surrounding area. Manchester Road passes to the south.
POTENTIALLY SIGNIFICANT EFFECTS:
Scenic bluffs and Inland Sage Scrub habitat c~aracterize the west third of tre
property and are visible throughout the surrounding area. B1 ack-tõ.i1 ed
Gnatcatchers utilize the site for nesting and feeding. These resources are
protected by the Local Coastal Plan and the Conservation Element at the General
P1 an. Traffic along Manchester Road could impact lot 28.

MITIGATING MEASURES PROPOSED BY APPLICANT:

Prior to approval of the Final Map, the applicant shall to the satisfaction of
the Director of the Department of Planning:
1. Dedicate an Open Space Easement over lot 28, which will be extinguishable
when satisfactory noise attenuation' barriers or other attenuation measures
have been approved on the grading plan.
2. Dedicate an Open Space Easement over the steep slopes of lots 1-17 and all
of lots 31 and 32. The Open Space Easement on all but lot 31 shall remain
in native vegetation with no brush removal, trenching for utilities,
vehicular access, or disturbance of biological or scenic resources allowed.
3. Submit a landscape plan for lot 31 which is compatible with the surrounding
native vegetation.
4. Submit a maintenance plan for the siltation basins which can be maintained
during and after each seasonal storm.
REASONS TO SUPPORT FINDING OF NEGATIVE DEClARATIßN:
Research and review failed to disclose any environmental issues not mitigated by
project design.

1. Find that the proposed pro~ect will not have a significant effect on the
environment. Consider and approve the Negative Declaration.
2. Grant major use permit P86-043 which makes the appropriate findings and
includes those requirements and conditions necessary to ensure that the
project is implemented in a manner consistent with the Zoning Ordinance
and State Law.
3. Adopt Resolution approving TM4606 which makes the appropriate findings
and includes those requirements and conditions necessary to ensure that
the project is implemented in a manner consistent with the Zoning
Ordinance and State Law.
MAJOR ISSUES:
Can the City Council adopt this resolution with provisions for permanent
school facilities to be constructed with collected school fees?
DISCUSSION:
The City of Encinitas adopted the County of San Diego Ordinances on October
1, 1986. The County's school facilities ordinance provides for interim
facili ties only upon certification by the school district that overcrowding
exists. There are no provisions for collection of school fees for permanent
facili ties. Recent changes in state law will prohibit the City of Encinitas
from levying fees for permanent school facilities (AB2926).

GRANT, (as per plot plan dated September 4, 1986, consisting of 1 sheet, as
amended and approved concurrently herewith,) a major use permit, pursuant to
Section 6600 of The Zoning Ordinance, for a Planned Development as covered by
Tentative Map Number TM4606, or a subsequent revision thereof which provides for
a maximum of 28 dwelling units and related recreation fac'ilities.
The following conditions are imposed with the granting of this major use
permit:
A. Prior to issuance of any permit excluding any grading permit pursuant to
this major use permit, the applicant shall:
1. File and receive approval of a final subdivision map of the property
pursuant to TM4606 or subsequent revision thereof.
2. Dedicate an Open Space Easement over Lot 28, which will be
extinguishable when satisfactory noise attentuation barriers or other
attenuation measures have been approved on the grading plan.
3. Dedicate an Open Space Easement over the steep slopes of Lots 1-17 and
~ll of Lots 31 and 32. The Open Space Easemen~ on all bu~ Lot 31
shall remain in native vegetation with no brush removal, trenching for
util ities, vehicul ar access, or disturbance of biological or scenic
resources allowed.
4. Deposit with the Department of Public Works sufficient funds to cover
the cost of inspection of the private improvements.
5. Submit to and receive approval from the Director of Planning a
complete and detailed landscape plan. Landscape plans shall be
prepared by a California licensed landscape architect. The landscape
plans and review fee shall be submitted to the Planning Department.
Plans shall include:
a. Indication of the proposed width of any adjacent public right-of-
way, and the locations of any required improvements and any
proposed plant materials to be installed or planted therein. The
applicant shall also obtain a permit from the Department of
Public Works approving the variety, location and spacing of all
trees proposed to be planted within said right(s)-of-way.
b. A c~~plete planting plan including the names, sizes and locations
of all plant materials, including trees, shrubs and ground cover.
Include details, notes and specifications for plant materials.
Wherever appropriate, native or naturalizing plant materials
shall be used which can thrive on natural moisture other than
such irrigation as is necessary to establish the plantings.

c. A complete watering system including the location, size and type
of all backflow prevention devices, pressure and nonpressure
waterlines, valves and sprinkler heads in those areas requiring a
permanent irrigation system. Include details, notes and
specifir.ations for irrigätion s~.~t~;.~. For areas of nat;~e or
naturalizing plant material, the landscape plan shall show a
method of irrigation adequate to assure establishment and growth
of plant material through two growing seasons.
d. Finished elevation of proposed grading.
e. Location and type of walls, fences, walkways and lighting to be
i nstall ed.
f. The following specific items shall be addressed as part of the
landscape plan:
1) Submit a lanqscape plan for Lot 31 which is compatible with
the surrounding native vegetation.
2) Submit a maintenance plan for the siltation basins which can
be maintained during and after each seasonal sto rm.
B. Prior to any occupancy of any dwelling units (within any construction
phase) of the development or use of the premises pursuant to this Major Use
Permit, the following shall be accúmplished:
1. Submit a statement from a licensed landscape architect that all
landscaping has been installed as shown on the approved landscape
planting and irrigation plans.
2. All parking areas shall be improved with a minimum of two inches of
asphaltic concrete or concrete. The base and surface of all private
streets shall conform to City of Encinitas Standards for public
streets.
3. Finished grading shall be certified by a registered Civil Engineer and
inspected by the City Engineer for drainage clearance. Approval of
the rough grading does not certify finished grading because of
potential surface drainage problems that may be created by landscaping
accomplished after rough grading certification. If a gradi ng permit
is not required for the project, a registered Civil Engineer's
certification for the drainage clearance shall still be required.
4. Property owners shall agree to preserve and save harmless the County
of San Diego and City of Encinitas and each officer and employee
thereof front any liability or responsibility for any accident, loss,
or damage to persons or property happening or occuring as the
proximate result of any of the work undertaken to complete this work,
and that all of said liabilities are hereby assumed by the property
owner.

5. The penTIittee shall make suitable provisions as outlined in lIall and
IIbll following, to assure the continued maintenance and operation of
open space, recreational facilities and improvements specified
herein:
a. The pennittee and all persons, finns or corporations, owning the
property subject to this major use permit at the time of the
recording of the final map or maps, their heirs, administrators,
executors, successors, and assigns shall operate, maintain and
repair all common open ,space, recreational f ac i 1 it i es and
improvements shown on the ~ot ~an primarily for the benefit of
the residents of the subject development and shall continue to
operate, maintain and repair said open space, facilities and
improvements until such time as the operation and maintenance of
said recreational facilities and improvements is assured by some
public agency, district, corporation or legal entity approved by
the City Council.
b. The maintenance and operation of said open space, recreational
facilities and improvements shall be assured by the granting of
an undivided interest in said open space, recreational facilities
and improvements to the purchasers of each of the individual
dwelling units in said subject development and inclusion in the
deeds conveying said individual units of provisions, such as
covenants running with thi land, requiring the owners, their
heirs, administrators, successors and assigns to participate in
the cost of such maintenance and operation, and the creation of
legal entity with the right to assess all owners, in the costs of
maintenance and operation of said facilities and improvements, or
be assured by some other device creating a legal entity capable
of maintaining and operating said open space, facilities and
improvements and providing for the participation by the owners of
all dwelling units in the cost of maintenance and operation and
the enforcement of such participation.
Upon certification,by the Director of Planning for occupancy or establishment of
use allowed by this major use permit, the following conditions shall apply:
c. All features shown on the approved plot plan shall be located substantially
where they are shown, and shall be constructed in accordance with
appropriate City of Encinitas Code Sections.

D. No exterior radio or television antennas shall be permitted. The developer
shall make the necessary arrangements for the installation of licensed
cable television service to all dwelling units. If such service is
unavailable (no licensed operator is found to be willing and able to

a common central antenna and underground cable to all dwelling units. The
Master Antenna system shall be maintained and ultimately conveyed to the
purchasers of the dwelling units in the same manner provided for open
space, recreational facil ities and other improvements that are al so a part
of thi s maj or use permit. '
E. All utility distribution facilities within the boundaries of the subject
development shall be placed underground in accordance with Section
81l403(e) of the City of Encinitas Code.
F. All light fixtures shall be designed and adjusted to reflect light
downward, away from any road or street, and away from any adjoining
premises and shall otherwise conform to Section 6324 of the Zoning
Ordinance.
G. The roads, parking areas and driveways shall be well maintained.
H. All 1 andscapi ng shall be adequately watered and well mai ntai ned at all
times.
1. The terms and conditions of this major use permit shall be binding upon the
permittee and all persons, firms and corporations having an interest in the
property subject to this major use permit and the heirs, executors,
administrators, successors and assigns of each of them, including municipal
corporations, public agencies and districts.
J. This Major Use Permit shall expire concurrently with TM4606 unless
construction and/or use of the property in reliance on this permit is
established prior thereto. Recordation of a final map pursuant to TM4606
and completion of (or entry into agreements to construct where permitted)
all required improvements shall be deemed to establish such construction
and/or use in reliance. If a moratorium is imposed pursuant to Section
66452.6(b) of The Subdivision Map Act which precludes recordation of
TM4606. Thi s permit shall expi re on the same date as TM4606. (unl ess a
time extension is granted for said tentative map).
Pursuant to Section 7358 of the Zoning Ordinance, the following findings in
support of the granting of the major use permit are made:

The proposed development consists of single family homes on .5 acre
1 ot s. The scale, bulk, coverage and density will be in harmony with
the zoning to the east and will serve as a transition between the
clustered development to the west and homes to the east.
2. The availability of public facilities, services, and utilities
The facts supporting Finding (a-2) are as follows:
All services will be available concurrent with need. The development
. will need to annex to the Cardiff Sanitation District and provisions
for the annexation are included in the Resolution of Approval for
TM4606. Annexation proceedings may commence when deemed suitable by
the Board of Directors of the Cardiff Sanitation District.

The site consists of steep areas along the north and west boundaries;
development is restricted to the flatter areas with the steep areas
being reserved as permanent open space.

The East half of the Northeast Quarter of the Southwest Quarter of Section 24,
Township 13 South, Range 4 West, San Bernardino Meridian, in the County of San
Diego, State of California, according to the official plat thereof and the
Easterly 250.00 feet of that portion of the East half of the Southwest Quarter
in said Section 24, lying Northerly of the centerline of County Road Survey No.
426, filed in the Office of the County Surveyor of said County, all in the
County of San Diego, State of California.
WHEREAS, on November 17,1986, the City Council of the City of Encinitas
pursuant to Section 81.304 of the City of Encinitas Subdivision Ordinance held a duly
advertised public hearing on said tentative map and received for its consideration,
documentation, written and oral testimony, recommendations from all affected public

General Plan and with the land use designation of the San Dieguito Community
Plan because it proposes a single family residential use type at a density of
1.27 dwellings per acre in the Rural Residential Use Regulation;
2. The design and improvements of the proposed subdivision are consistent with all
elements of the San Diego County General Plan and with the San Dieguito
Community Plan and comply with the provisions of the State Subdivision Map Act

to cause substantial environmental damage or substantially and avoidably
injure fish or wildlife or their habitat based upon the findings of
Negative Declaration dated September 18, 1986;
7. The design of the subdivision or the type of improvements do not conflict
with easements, acquired by the public at large, for access through, or use
of property within the proposed subdivision, as defined under Section 66474
of the Government Code, State of California; and
The division and development of the property in the manner set forth on the
approved tentative map will not unreasonably interfere with the free and
complete exercise of the public entity or public utility right-of-way or
easement; and
8. The discharge of sewerage waste from the subdivision into the Cardiff
Sanitation District sewer system will not result in violation of existing
requirements prescribed by-the California Regional Water Quality Control
Board pursuant to Division 7 (commencing with Section 13000) of the Water
Code, as specified by Government Code Section 66474.6; and
9. Because adequate facilities and services have been assured and adequate
environmental review and documentation have been prepared, the regional
housing opportunities afforded by the subdivision outweigh the impacts upon
the public service needs of City residents and fiscal and environmental
resou rces;
IT IS FURTHER FOUND, DETERMINED AND DECLARED that the Negative Declaration on
file in the Department of Planning and land Use as log No. 86-8-47 has been
completed in compliance with the California Environmental Quality Act (CEQA) and
State, County and City CEQA Guidelines, that the decision-making body has
reviewed and considered the infonnatiC'n contained therein prior to approving the

of 34 feet and surfaced to a radius of 30 feet with A.C. pavement eyer
approved base with P.C.C. curb and gutter at 30 feet from the radius
point.
e. Improve intersection of Manchester Drive and Sand Canyon Drive to a
full standard intersection.

a. Emergency erosion control measures shall be provided to control soil
movement satisfactory to the Department of Public Works in the event
the site is exposed to erosion during the period between November 1 to
Ap ri 1 15. (If coastal permit~ are requirt:d, the period shall be
October 1 to April 15). Erosion control measures shall include but
not be limited to, slope protection, installation of jute matting or
approved equivalent, desi1ting basins, energy dissipaters, silt
control sand bagging and storm drains.
b. All building pads to be diked and the dikes maintained to prevent
water from flowing from the pad until the streets and driveways are
paved and water can flow from the pads without causing erosion, or
construct drainage facilities to the satisfaction of the Department of
Public Works that will allow water to drain from the pad without
causing erosion.
c. Tops of all slopes to be diked or trenched to prevent water from
flowing over the crest of slopes.
d. Manufactured slopes and pads shall be rounded vertically and
horizontally as appropriate to blend with the surrounding topography.
e. As soon as cuts or embankments are completed, but not later than
November 1, (if coastal permits are required, no lat~r than October-I)
all cut and fill slopes shall be stabilized with a hydromu1ch mixture
of an equal treatment approved by the Department of Public Works.
Between November 1 (or October 1 if coastal permits are required) and
April 15, approved slope protection measures shall proceed immediately
behind the exposure of cut slopes and/or the creation of embankment
slopes.

f. Sand bag check dams to be placed in a manner approved by the
Department of Public Works in unpaved streets with gradients in excess
of 2% and on or in other graded or excavated areas as required by the
Department of Public Works. The l.ocation and details on the sand bags

g. Catch basins, desilting basins and storm drain system shall be
installed to the satisfaction of the Department of Public Works.
h. At or near every point where concentrated flow leaves the development,
a desilting basin and an energy dissipater may be required to be
constructed to remove silt from the water and release the water at a
non-erosive velocity.
i. The developer to maintain the plantings and erosion control measures
described above until relieved of same by the Department of Public
Works. The developer to remove all soil intercepted by the sand bags,
catch basins and desilting basins and keep these facilities clean and
free of silt and sand as directed by the Department of Public Works.
The developer shall repair any eroded slopes as directed by the
Department of Public Works.
j. All of the work described above pertaining to erosion control, irrigation
system, slope protection, drainage systems, desilting basins, energy
dissipaters and silt control snall be secured by an Instrument of Credit in
a form satisfactory to the City Attorney for an amount equal to the cost of
this work as determined by the Department of Public Works. An agreement in
a form satisfactory to the City Attorney shall accompany the Instrument of
Credit to unilaterally withdraw any part of or all the Instrument of Credit
to accomplish any of the work agreed to if it is not accomplished to the
satisfaction of the Department of Public Works by the date agreed. The
cash deposit collected for grading per the grading ordinance will be used
for emergency erosion measures. If said deposit collected for grading is
less than $5,000.00, the developer will supplement the deposit to equal
$5,000.00. The developer shall submit a letter to the Department of Public
Works authorizing the usè of this deposit for emergency measures.

a. The applicant shall, prior to final map processing, have adequate fire
department access r~quirements approved to the satisfaction of the
Encinitas Fire Protection District. The requirements may include
turnaround facilities at the western terminus of the private road
serving proposed lots 6, 7 and 8.

c. Prior to the issuance of a grading permit the subdivider shall obtain
approval from the Director of Planning of a detailed landscaping plan
for lot 31. The landscape plan and review fee shall be submitted to
the Planning Department. Said plan shall show the types and locations
of all landscaping features including planting and irrigation. The
landscape plan shall show vegetation which is compatible with the

DEVELOPMENT IMPACT FEES
11. Specific Conditions:
a. The subdivider shall deposit fees in the amo~nt of no less than Five
Thousand Dollars Six Hundred ($5,600) with the City of Encinitas, or
guarantee payment of those fees as may be required pursuant to
Sections 810.106 and 810.107 of the Park Lands Dedication Ordinance or
subsequent changes as authorized by the City Council; said fees
refl ect a 0 percent credit for private recreation areas to be used for
park and recreation purposes for this proposed subdivision which will
consist of 2~ units ~~ the RR2 Zone. Said feE's may be paid on a
prorated basis of no less than $200 per lot as individual units or

b. The developer shall partici pate in the cost of a traffic signal
install at i on at the i ntersecti ons of Manchester Avenue wi th (1)
Encinitas Boulevard, and (2) El Camino Real. The amount of the
developer1s portion of the cost of the signals shall be $970.00 and
~1,790.00, respectively.
c. The subdivider shall contribute $10,800.00 to the City of Encinitas
Flood Control District, Zone 1, as his/her share of future area flood
control/drainage improvements.
FINAL MAP RECORDATION
Final Map requirements shall be shown on the final map or otherwise accomplished
to the satisfaction of the Director of the Department of Public Works prior to
submittal for approval by the City Council:

12. Specific Conditions:
a. Dedicate Manchester Avenue onsite and on the project side to a width
of 35 feet from the centerl i ne.
b. Provide private road easement onsite to a width of 40 feet for Sand
Canyon Drive.
c. Provide a cul-de-sac terminus with a radius of 34 feet at the northern
end of Sand Canyon Drive.
d. Provide a private access road easement from Lots 5 through 8 to a
width of 24 feet.
e. Because private roads are approved as a condition of this subdivision,
the following shall apply:
1. Maintenance shall be provided through a private road maintenance
agreement satisfactory to the Director, Department of Public
Works.
2. The Director, Department of Public Works shall be notified as to
the final disposition of title (ownership) to the private streets
and place a note on the final map as to the final title status of
said streets.
3. Access to each lot shall be provided by private road easement not
less than 40 feet wide. Lots 5 through 8 may have access by
private road not less than 24 feet wide.

a. By separate document prior to the recording of the final subdivision
map, or on the final subdivision map, there shall be granted to the
City an open space easement over Lots 30 and 32 and the steep slopes
of the portions of Lots 1-17 to the satisfaction of the Director of
Pl anni ng. Said easement(s) shall be approved as to form by the City
Attorney and shall:
Limit the uses within the easement to landscaping and recreation
purposes, including buildings, structures and improvements approved by
Planned Development Permit P86-043 and subsequent permits or
modifications that may be issued pursuant to the Zoning Ordinance.

b. Lots No. 30 and 32 shall be labeled "NOT A BUILDING SITE" on the final
map and an open space easement shall be granted to the City, over and

c. The applicant shall execute a covenant that shall be recorded and
secured by a lien on the subJect property, by which the property owner
agrees to pay whatever fees are thereafter, lawfully imposed by the
City of Encinitas which would have been applicable to the subject
property had the application for the permit or approval been
processed after the adoption of such fees. The property owner shall
agree to pay the established fees or file a written objection as to
the amount of the fee wi th the Ci ty Council wi thi n thi rty (30) days of
the date that notice is mailed to the address contained in the
covenant as to the amount of the fees calculated in accordance with
the Ordinance that imposes the fees. The City Council's determination
of the obj ection shall be fi nal. The property owner shall agree that
a failure to pay the fees shall entitle the City, without further
notice, to add the fee to the property tax bill for the subject
property. The fees which are the subject of this provision shall be
those fees expressly imposed to deal with the problems identified in
the Ordinance 14. The applicant shall pay the recording fee.
d. The conditions pertaining to the circumstances as noted in Ordinance
14 (Development Moratorium) may be modified prior to recordation of
final map or issuance of building permit in order to mitigate
identified circUMstances.
e. Applicant acknowledges that an existing moratorium declared by the
Cardiff Sanitation District and the existing moratorium declared by
the City of Encinitas may preclude Applicant from satisfying one or
more of the conditions imposed upon the tentative map and may preclude
obtai ni ng other approval s and permits.
