OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
"HARTY MONTGOMERY ANNEXATION"
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 5600 et seg.)
preliminary proceedings were commenced by resolution of application
by this Board on April 11, 1989, as Resolution 89-09, for
annexation to the Cardiff Sanitation District (thereinafter
referred to as the District) of certain territory therein
described, which description has been modif ied pursuant to the
directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
-, application was presented to and approved by the Local Agency

Formation Commission of San Diego County on December 4, 1989, and
this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an 'election pursuant to Government Code,

NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seg.;

d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered' to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is developed and/or proposed to be
developed and used for residential and/or commercial
purposes and provision for sewage disposal
facilities for said territory is essential for such
purposes.
e. The terms and conditions of the proposed annexation are:
Payment of annexation and State Board fees.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
. Commission, this Board may adopt its re~olution ordering
the annexation without notice and hearing and without an

g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.

IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government
Code Section 57002, the following described incorporated territory

annexed to and made a part of the Cardiff Sanitation District.

RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
MARTY MONTGOMERY ANNEXATION
WHEREAS, this Board of Directors has received a request from
Marty Montgomery that the hereinafter described territory to be
annexed to the Cardiff Sanitation District (hereinafter referred
to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation
Commission of the County of San Diego for a proposed
change of organization as follows:
¡ A. This proposal is made pursuant to the cortese-Knox
Local Government Reorganization Act of 1985 (S.
56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization
and the names of all districts for which any such
change of organization is proposed as follows: The
annexation of the hereinafter described territory
to the Sanitation District.
C. The names of all other affected counties, cities and
districts are: city of Encinitas.
D. A description of the exterior boundaries of the
territory proposed to be annexed to the Sanitation
District is described in Exhibit "A" hereto
attached.
E. Said territory is uninhabited and comprises
approximately 3.11 acres.
F. It is proposed that said territory be annexed
subject to the following condition: Payment of
district annexation and State Board fees.

H. The reasons for this proposal are as follows:
( 1) The Sanitation District is empowered to and is
engaged in furnishing sewage disposal
facilities.
(2) The territory proposed to be annexed to said
District is developed and/or proposed to be
developed and used for residential and/or
commercial purposes and provision for sewerage
disposal facilities for said territory is
essential for such purposes.
I. It is hereby requested that proceedings be taken for
the annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of
influence of the Sanitation District.
2. pursuant to State CEQA Guidelines section 15303
(California Environmental Quality Act of 1970), the Board
finds that this annexation is not subject to the
\, environmental impact evaluation process because it is

Findinqs:
The city of Encinitas has examined the Initial study and finds
that the proposed project will not have a significant effect on
the environment and that a negative declaration be prepared
pursuant to the City procedures.
proiect Description and Location:
The project is a Tentative Parcel Map for the subdivision of one
lot into four parcels of for the purpose of future
construction of four single family dwelling units in the RR-.5
zone (density of 2 dwelling units per acre).
Grading for the dwelling is not proposed at this time since the
lots will be for sale individually. The only grading proposed
will be that required for the grading for road improvements
required as conditions on the Tentative Parcel Map. The project
is located on Rancho Santa Fe Road between Olive Crest Drive and
Santa Catalina Drive.
Environmental settinq:
The project site presently has a considerable number of horse
stalls, barns and sheds. The site has been developed in this
state for a considerable number of years and there is no natural
vegetation or topography remaining.
The present vegetation consists of at least 100 mature eucalyptus
and other trees fronting on Rancho Santa Fe Road in addition to
low grasses and shrubs.
Potentiallv Wnificant Effects:
The project impacts are associated with grading of the roads and
the standard light and noise generated by single family dwelling
units. No mitigating measures other than standard requirements
for the grading of the roadways to be performed In accordance
with the San Diego County Grading Ordinance are recommended.
Reasons to Support findinq of Neqative Declaration:
Research and review has failed to disclose any environmental
issues not addressed by the design of the project and the
standard requirements for road improvements.

RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
MARTY MONTGOMERY ANNEXATION
WHEREAS, this Board of Directors has received a request from
Marty Montgomery that the hereinafter described territory to be
annexed to the Cardiff Sanitation District (hereinafter referred
to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation
Commission of the County of San Diego for a proposed
change of organization as follows:
A. This proposal is made pursuant to the Cortese-Knox
Local Government Reorganization Act of 1985 (S.
56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization
and the names of all districts for which any such
change of organization is proposed as follows: The

SUBJECT: Adoption of Resolution No. 89-09, Application for
Annexation to the Cardiff Sanitation District of 3.11
Acres Located on the West Side of Rancho Santa Fe Road
Approximately 650' South of Olive Crest Drive. - Marty

BACKGROUND:
This is a request to annex 3.11 acres into the Cardiff Sanitation
District. Annexation is required in order to provide sewer service
to four future single family dwellings.
DISCUSSION:
Tentative Parcel Map 87-108-TPM divides a 3.11 acre parcel into
four (4) lots of .73, .80, .65 and .57 acres, respectively.
Annexation of the above mentioned property is a condition of final
map approval.
This proposed annexation is in conformance with the Cardiff Board's
policy on annexations for single family dwellings on legally sized
lots, conforms with the current zoning (RR-2) and is within the
District's sphere of influence. The parcel is located on the west
side of Rancho Sante Fe Road approximately 650' south of Olive
Crest Drive (see attached vicinity and plat maps).
RECOMMENDATION:
It is recommended that the Board of Directors:
1. Find pursuant to State CEQA Guidelines, Section 15303
(California Environmental Quality Control Act of 1970), that
this project is categorically exempt from evaluation.
2. Adopt resolution of application number 89-09 for annexation
to the district.
