OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
MICHAEL MAHON ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on May 20, 1987, as Resolution No.
87-23, for annexation to the cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local, Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Aqency
Formation commission of San Diego County on September 14,1987,

: and this District was designated as the conducting district and
authorized by resolution to order said annexation without
notice or hearing and without an election pursuant to
Government Code, Section 56837¡

a. The manner in which and by whom preliminary
proceedings were commenced was by resolution of
application by this Board as stated above.
b. The territory to be annexed has been designated the
Michael Mahon Annexation by the Local Aqency
Formation commission, and the exterior boundaries of
such territory are as hereinafter described.
c. The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described
in Health and Safety Code section 4830.

d. The reasons for the proposed annexati . as set forth
in the resolution of application referred to above
are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The terri tory proposed to be annexed to said
District is proposed to be developed and used
for residential and/ or commercial purposes and
provision for sewage disposal facilities for
said territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have
given their written consent to such annexation, as
provided in Government Code, Section 56837; and
therefqre, as approved and authorized by the Local.
Agency Formation commission, this Board may adopt its
resolution ordering the annexation without notice and
hearing and without an election, as provided in
Government Code, section 57002.
q. The regular County assessment role will be utilized
and the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to State CEQA Guidelines section 15074
(California Environmental Quality Control Act of
1970), the board finds in accordance with the
Negative Declaration dated November 21, 1985,
prepared with respect to the proposed annexation and
the project designated TPM 18572 Log No. 85-8-79 that
the project would have no significant impact on the
environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described
incorporated territory in the City of Encinitas, State of
California, be and it hereby is annexed to and made a part of
the Cardiff Sanitation District.
IT. IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution alone¡
with a remittance to cover the fees required by the Government
Code Section 54902.5 to the Executive Officer of the Local
Agency Formation Commission of San Diego County, so that the

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF THE COUNTY OF SAN DIEGO
MAKING DETERMINA TIONS AND APPROVING THE
"MICHAEL MAHON ANNEXATION" TO THE CARDIFF SANITATION, DISTRICT
On motion of Commissioner Hersom, seconded by Commissioner Mahr, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was
adopted by the Board of Directors of said District as Resolution No. 87-23, dated May
20, 1987, pursuant to TitleS, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that it has reviewed and considered the
information contained in the Negative Declaration prepared by the County of San
Diego.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 3.83 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "Michael
Mahon Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby design~tes the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

1. The subdi vider shall furni sh to the Department of Pub'ic Works
recorded documentation 51101l/il19 that the land division is connected to
a publicly maintained road hy an easement for road purposes. This
easement shall be forty feet (401) wide as specified in Section
81.703(a)(2) and (b)(l), unless proof is furnished that a lesser width
is applicable under Sectiøn U1.703(1)(1) of the County Code, and shall
be for the benefit and use of the property being divided. Recordat i on

requirement applies to offsite access to all proposed parcels.
2. The developer shall relinqu-ish access rights into El Camino Del Norte

B. ULTINATE ROAD HIDTHS
Prior to preparation of the Pi'H'cel l1ap, the engineer 0/' surveyor preparing
the map shall contact the Department of Public Works (565~5673) to

(SC 1521) which is sho1t/ll on the Circulation Element of the County General

1. The location of the centerline of the road as approved by the Director

2. The width of the riyht-of-I'/ay which is thirty-five feet (351) from the
centerline and identified by a line drawn at the appropriate location
and labeled "limit of Proposed Street Widening." (The additional five
feet (51) is for a bicyclp. facility.)
3. 1\ building line which is fifty feet (501) from the centerline of the
road, identified by a line drawn at the appropriate location and
labeled "Limit of Building Line."
Show the ultimate drainage and slope 1 imits on the Parcel Map. A profi 1 e
and cross-section sufficient: to verify these limits shall be submitted to
the Advanced Engineering Dp.sign Group (565-5673) of the Department of
Publ ic ~/orks for review and ilpproval.

wide one-half right-of-way width plus the right to construct and maintain
slopes and drainage improvements as required beyond the thirty foot (301)

1. RIDING AND HIKIt~G TRAILS
If dedicated, or reserved as the result of satisfying Condition C. improve
the Riding and Hiking Trail System to tilt: following design standards to the
satisfaction of the Director of the Department of Public Works: '

J. FLOODING/DRAINAGE
The subdivider shall contribute $7/4.00 to the San Diego County Flood
Control District, Zone 1 (49 H). as his/her share of future area flood
control/drainage improvements per Ordinance No. 5856 (N.S.).
K. SEWERAGE /~IA TER
1.. The applh:ant shall cause all of the land Hithin the subdivision to be
annexed to the Cardiff Sanitation D ¡strict.
2. Prior to .:ipproval of the Parcel nap the plans and specifications for
the installation of a sewer system ser'ving each lot must be approved
by the Director of the Department of Public Works. The subdivider
shall dedícate all necessary eaSèl\Iénts for that portion of the sewer
system which is to be public sewer.
3. The develuper shall install the se\'¡er system and dedicate the portion
of the sewer system which is to he public sewer as shown on the
approved plans and specifications,
4. Prior to recordation, the existing dwelling on proposed Parcel 1 shall
be connected to the Cardiff Sanitation District sewer system, and the
existing septic tank be pumped by a licensed pumper truck and properly
backfilled.

5. A commitment to serve each parcel must be obtained from the Cardiff
Sanitation District. No sewer commitment shall be issued until all
conditions in this Resolution of Approval have been satisfied, the
final map or parcel map, grading plan and improvement plans have been
approved by the Department of Public Works and all fees and deposits
paid and improvement security posted.
6. A commitment to serve each parcel must be obtained from the 01ivenhain
Municipal Water District should recordation occur after September 30,
1987.
L. FIRE PROTECTION
The developer shall provide a letter from the Rancho Santa Fe Fire
Protection District stating that the required development impact fees have
been pafd to the satisfaction of said District.
M. SOLAR ACCESS '
The fo11 owi ng note shall appear on the Parcel Map:
All parcels within this subdivision have a minimum of one hundred (100)
square feet of solar access for each future dwelling unit allowed by this
Subdivision as required by Section 81.401(n) of the Subdivision Ordinance.
N. OTHER REQUIREMENTS
1. The subdivider shall comply with Section 66436 of the Government Code
by furnishing to the County Department of Public Works a certification
from each public utility and each public entity owning easements
within the proposed subdivision stating that: (a) they have received
from the developer a copy of the proposed final map; (b) they object
or do not object to the filing of the map without their signature.
2. Zoning regulations require that each parcel shall contain a minimum
net area of one-half (1/2) acre. If, as a result of survey
calculations, required easements or for any other reason, the area of
any parcel shown on this Tentative Parcel Map is determined by the
Department of Public Works to be below the zoning minimum, it becomes
the responsibility of the subdivider to meet zoning requirements by
lot redesign, variance or other applicable technique. The subdivider
shall comply with the zoning area requirements in full before the
Department of Public Works may file a Parcel Map with the County
Recorder.
3. All owners of record for subject property shall provide authorization
for the proposed land division to the Department of Planning and Land
Use prior to recordation of the Parcel Map.

4. Prior to the approval of the Parcel Map by the Department of Pub1ic
Works the subdivider shall provide the Department of Pubiic Works with
a copy of the deed by which the sub,ject property was acquired and a
Parcel t1ap report fro," a qualified it1e insurance company.
5. At the time of recordation of the Parcel Map, the name of,the person
authorizing the map and whose name appears on the SURVEYOR1S
CERTIFICATE as the person ~/ho requested the map, shan be the name of
the owner of the sunject property ond shall he the same party or
parties as shown on the Tentative Parcel Map unless the Director of
the Oepartlnent of Planning and Land Use has approved the substitution
of a successor-in-interest to such party or parties.
Conditions 6-1, I, K-3 and J may be complied with either prior to or after the
approval of a Parcel Map. If the conditions listed above have not been complied
with prior to approval of the Parcel t1ap by the Department of Public \/orks, such
conditions shall be noticed on the Parcel nap by a certificate ac;ceptable to the
Department of Public Horks. In addition, the subdivider shall execute a
"Covenant of Improvement Requirements" listing the conditions noticed on the
Parcel Map that have not been complied with. This Covenant shall be recorded by
the Department of Public Works prior to the approval of .the Parcel Map. The
Covenant shall be noted on the Parcel nap.
Conditions 6-1 and k-3 shall be comp' ied \,¡jtll prior to tile issuance of a
building permit or other grant of approval fur development, including further
division, for any pörcel created by the Parcel Map. If a Covenant has been
recorded for conditiuns not compl ied with prior to recordation of the Parcel

Conditions I and J should be complied with prior to approval of the Parcel Map
or within a reasonable time following such approval pursuant to findings by the
Director of the Dépürtment of Planning and Land Use that they are prerequisite
to the orderly development of the surrounding al'ea and that publ ic safety

A lien contract may also be used for Condition J; however, if a lien contract is
used, it must be superior to all other liens and encumbrances against the
property being divided. It is required that Condition J be satisfied prior to
the earliest of the following occurrences:
1. Issuance of a building permit;
2. All required improvements are completed and accepted by the County;
3. Construction commences on any portion of a master planned flood control
facility within the local drainage area;
4. Execution of ~ reimbursement agreement for facilities constructed within

A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
MICHAEL MAHON ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on May 20, 1987, as Resolution No.
87-23, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on September 14, 1987,
and this District was designated as the conducting district and
authorized by resolution to order said annexation without
notice or hearing and without an election pursuant to
Government Code, section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seq.;
a. The manner in which and by whom preliminary
proceedings were commenced was by resolution of
application by this Board as stated above.
b. The territory to be annexed has been designated the
Michael Mahon Annexation by the Local Agency
Formation Commission, and the exterior boundaries of
such territory are as hereinafter described.
c. The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described
in Health and Safety Code section 4830.

in the resolution of application referred to above
are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used
for residential and/or commercial purposes and
provision for sewage disposal facilities for
said territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have
given their written consent to such annexation, as
provided in Government Code, Section 56837; and
therefore, as approved and authorized by the Local
Agency Formation commission, this Board may adopt its
resolution ordering the annexation without notice and
hearing and without an election, as provided in
Government Code, section 57002.
g. The regular County assessment role will be utilized
and the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to State CEQA Guidelines Section 15074
(California Environmental Quality Control Act of
1970), the board finds in accordance with the
Negative Declaration dated November 21, 1985,
prepared with respect to the proposed annexation and
the project designated TPM 18572 Log No. 85-8-79 that
the project would have no significant impact on the
environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described
incorporated territory in the City of Encinitas, State of
California, be and it hereby is annexed to and made a part of
the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government
Code Section 54902.5 to the Executive Officer of the Local
Agency Formation Commission of San Diego County, so that the

OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"MICHAEL MAHON ANNEXATION" TO THE CARDIFF SANITATION DISTRICT
On motion of Commissioner Hersom, seconded by Commissioner Mahr, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexa tion of terri tory to the Cardiff Sani ta tion Dis tr ict, which resolution was
adopted by the Board of Directors of said District as Resolution No. 87-23, dated May
20, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation IS as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexa tion;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that it has reviewed and considered the
information contained in the Negative Declaration prepared by the County of San
Diego.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.

(4) The boundaries of the territory do conform to lines of assessment ~
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 3.83 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "Michael
Mahon Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified

This is a request to annex 3.83 acres into the Cardiff Sanitation District.
Annexation is required in order to provide sewer service for a 4 lot, single
family dwelling, subdivision project.
RECOMMENDATIONS: That your Board
Adopt the resolution of the Board of Directors of the Cardiff Sanitation
District annexing territory to the District.
Discussion:
On January 10, 1986, the Department of Planning & land Use approved Tentative
Parcel Map No. 18572 making annexation to the sanitation district a condition
of approval.
On May 20, 1987, your Board adopted a Resolution of Application for annex-
ation of territory to the Sanitation District. On September 14, 1987, the
local Agency Formation ComITission adopted a resolution approving this annex-
ation and authorizing your Board to initiate proceEdings in compliance with
their resolution, without notice or hearing (DA87-28).

Omsted moveð, Luke seconded to adopt Resolution 87-23. Motion
carried. Ayes: Gaines, Luke, Omsted, Shea, Steel; Nays: None.
B. Review of Initial Joint Powers Aqreement.
In answer to a question from Member Gaines, Board Manager Shafer
stated that the Joint Powers Authority would be a separate legal
enti+-.y with authority and power separate from the two sanitation
district boards. They would have the ability to make decisions
v-'Ì thin the framework of the joint powers document and generally
would not take questions bac}~ to their boards before voting. They
could not make decisions such as the size of a plant, annual sewer
charges, etc. They have responsibility to manage the assets of the
J oint Powers Authority. They would not have authority to make
decisions as to expansion, but could make recommendations to the
boards. Member Gaines asked questions about specific sections of
tre agreement and those which were not answered at this time, staff
was directed to research and provide the answers.
Gaines moved, Omsted seconded to approve the agreement in concept
with the provisions that the questions she asked be answered
to the Board's satisfaction.
~ Betty Knutson, of the Cardiff Chamber oî Commerce, said members of
the Chamber and the Town Council had askzd that some sort of
workshop on this agreement be held which they could sit in on.
Board Manager Shafer stated he would work with them to arrange the
information session.
Motion carried: Ayes: Gaines, Luke, Omsted, Shea, Steel; Nays: None.
7. STAFF REPORTS
A. Status Report: Capacity Letters and Waste Discharqe Permits
Issued and Remaininq.
The report was included in the agenda packet. Member Steel stated
the data showed that as prudent policy maybe the Board should think
about reserving capacity of 280 gallons per EDU since April data
shows a flow of 243 gallons per EDU. If so, there are only 113,000
gallons left to commit for 404 new connections. He suggested the
matter go on the next agenda for a policy decision whether to
reserve 280 gallons per EDU. Board Manager Shafer stated '.-- was

RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
MICHAEL MAHON ANNEXATION
WHEREAS, this Board of Directors has received a request from
Michael Mahon (DoCument No. ------) that the hereinafter
described territory to be annexed to the Cardiff Sanitation
District (hereinafter referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation
commission of the County of San Diego for a proposed
change of organization as follows:
A. This proposal is made pursuant to the Cortese-Knox
Local Government Reorganization Act of 1985 (S ec.
56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization
and the names of all districts for which any such
change of organization is proposed as follows:
The annexation of the hereinafter described
territory to the Sanitation District.
C. The names of all other affected counties, cities and
districts are: City of Encinitas.
D. A description of the exterior boundaries of the
territory proposed to be annexed to the Sanitation
District is described in Exhibit II A" hereto
attached.
E. Said territory is uninhabited and comprises
approximately 3.22 acres.
F. It is proposed that said territory to be annexed
subject to the following conditions: None.
G. All owners of land within such territory have given
their written consent to such annexation subject to

H. The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and is
engaged in furnishing sewage disposal
facilities.
(2) The territory proposed to be annexed to said
District is proposed to be developed and used
for residential and/or commercial purposes and
provision for sewage disposal facilities for
said territory is essential for such purposes.
I. It is hereby requested that proceedings be taken for
the annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of
influence of the Sanitation District and the city of
Encinitas.
2. Pursuant to state EIR Guidelines section 15074
(California Environmental Quality Act of 1970), the Board
finds in accordance with the Negative Declaration dated
November 21, 1985, prepared with respect to the proposed
annexation and the project designated TPM 18572 Log No.
85-8-79 that the project would have an insignificant
impact on the environment.
3. The Clerk of the Board of Directors is hereby authorized
and directed to file a certified copy of this resolution
with the Executive Officer of the Local Agency Formation
Commission of the County of San Diego.
