No. : DA01 -07 RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN DIEGO MAKING DETERMINATIONS, APPROVING, AND ORDERING THE "MENKO ANNEXATION" TO THE CARDIFF SANITATION DISTRICT On motion of Commissioner Nygaard, seconded by Commissioner Menshek, the following resolution is adopted: WHEREAS, a resolution of application was submitted to this Commission for annexation of territory to the Cardiff Sanitation District, which resolution was adopted by the Board of Directors of said District as Resolution No. 2001 -04, dated February 28, 2001 , pursuant to Title 5, Division 3, commencing with Section 56000 of the Government Code; and WHEREAS, the reasons for the proposed annexation as set forth in the resolution of application are: (a) The Sanitation District is empowered to and is engaged in furnishing sewage disposal facilities; and (b) The territory proposed to be annexed to said District is developed and/or proposed to be developed and used for residential and/or commercial purposes and provision for sewerage disposal facilities for said territory is essential for such purposes; and WHEREAS, the territory proposed for annexation is as described in the application on file with the Local Agency Formation Commission; and WHEREAS, the Executive Officer of the Commission has filed his report on said annexation, which report was received and considered by the Commission; and WHEREAS, it has been determined that the proposal area is uninhabited , that all owners of land have consented in writing to the annexation, that any registered voters have received written notification , and that all affected agencies have waived conducting authority proceedings; NOW THEREFORE, pursuant to the Cortese/Knox/Hertzberg Local Government Reorganization Act of 2000 (Government Code Section 56000, et seq.) the Local Agency Formation Commission of the County of San Diego does hereby resolve, determine, and order as follows: 00'7 '739 (1 ) The Commission certifies that it has reviewed and considered the determination by the Cardiff Sanitation District that this annexation is exempt by Sections 15319(b) and 15303 of the State CEQA Guidelines. Page 1 of 1 ,s CONSENT ITEM 6 LOCAL AGENCY FORMATION COMMISSION EXECUTIVE OFFICER'S REPORT FOR MEETING OF: August 6, 2001 Prod "Menko Annexation" to the Cardiff Sanitation District (DA01-07) Proponent District, by resolution Description/Justification Proposed is annexation of 1.05 acres to the Cardiff Sanitation District for the provision of public sewer service. The proposed annexation territory is within the City of Encinitas and is developed with one single-family residence that is experiencing septic system failure. In a letter dated February 5, 2001, the County of San Diego, Department of Environmental Health, requested that the parcel be connected to a public sewer agency. Temporary extension of sewer service was administratively approved by the LAFCO Executive Officer on.March 26, 2001. The proposed annexation area is within the Cardiff Sanitation District's sphere of influence and district facilities are available within 90 feet. The parcel is within the Olivenhain Municipal Water District for provision of public water service. Surrounding territory is developed with single-family residences. The Board of Supervisors has adopted a Master Enterprise District Resolution stating that no property tax transfer would be required as a result of this jurisdictional change. The parcel currently is vacant and proposed for development with a single-family home. Encinitas is partnering with Habitat for Humanity to construct this affordable housing unit. Although Encinitas provides public sewer rvice to city territory, topography in the annexation area would allow sewage to gravity flo to the Leucadia County Water District (CWD) sewage system. Capacity is available to se a the site from a sewer pipe located adjacent to the property. Surrounding land uses include existing residential development to the north, east, and south, and a hotel located to the west. Water service already is furnished by the San Dieguito Water District. The Board of Supervisors has adopted a Master Enterprise District Resolution stating that no property tax transfer would be required as a result of this jurisdictional change. Because the property is not within Leucadia CWD's adopted sphere of influence, an amendment to include the territory within the sphere must be adopted prior to annexation. General Plan/Zoning City General Plan: Residential City zoning: Residential (3.01 - 5.0 du/acre) Location North of Puebla Street, east of Interstate 5, west of Clark Avenue, and south of Leucadia Boulevard in the City of Encinitas (Thos. Bros. pg. 1147/C4). i Executive Officer Recommendation 1. Certify that the determination by the City of Encinitas that this sphere amendment and annexation are exempt by Section 15319(b) of the State CEQA Guidelines has been reviewed and considered; and 2. Amend the sphere of influence for the Leucadia County Water District to include the territory as shown on the attached map, and adopt the written Statement of Determinations as proposed in Exhibit A; and 3. Adopt the form of resolution approving this sphere amendment and annexation for the reasons set forth in the Executive Officer's Report, waiving the Conducting Authority proceedings according to Government Code Section 56663(c), and ordering the annexation, subject to the following condition: Payment of Local Agency Formation Commission processing fees, and State Board of Equalization charges. (1) The present and planned land uses in the area, including agricultural and open space lands. The sphere amendment is necessary to allow provision of public sewer service to a .12-acre, vacant parcel located in the City of Encinitas and the San Dieguito Water District. Due to topographic constraints, Encinitas cannot provide sewer service to the site. Instead, annexation is to Leucadia CWD is being proposed because sewage can gravity flow to a District sewer line located adjacent to the property. The subject parcel is a one of several lots being developed with single-family homes as the result of a partnership between the City and Habitat for Humanity to construct affordable housing units. The City of Encinitas General Plan designation is Residential; City zoning is Residential (3.01 - 5.0 du/acre). (2) The present and-probable need for puNic facilities and services in the area. The proposed sphere amendment area is vacant, but one single-family home is planned to be constructed on the site. A hotel is located to the west of the territory, which is surrounded by existing residential development on the other three sides. (3) The present capacity of public facilities and adequacy of public services which the agency provides or is authorized to provide. The Leucadia CWD has a sewer line located adjacent to the property, and has sufficient capacity to serve the site subsequent to annexation. Water already is provided by the San Dieguito WD. (4) The existence of any social or economic communities of interest in the area if the commission determines that they are relevant to the agency. Social and economic communities of interest are not relevant in considering this sphere amendment.
