poor percolation. No apparent sensitive habitats are on the site
or on adjac~t land. The project site is characterized by gently
sloping topography with 75' - 225' elevations. Drainage tro. the
site flows southeasterly into Escondido Creek and Lake Val
Sereno. Surrounding land uses are single-family residential.

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
REVA NO. 2 ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on January 21, 1987 as Resolution No.
87-04, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of Diego County on April 6, 1987, and this
District was designated as the conducting district and authorized
by resolution to order said annexation without notice or hearing
and without an election pursuant to Government Code, Section
56837; NOW THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to Government
Code Section 57025 et seq.:
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this Board as
stated above.
(b) The territory to be annexed has been designated the
Reva No. 2 by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as hereinafter
described.

(c) The territory proposed to be annexed ios uninhabited,
and will be benefited by such annexation as described in Health
and Safety Code section 4830.
(d) The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in furnishing
sewage disposal facilities.
2. The territory proposed to be annexed to said District is
proposed to be developed and used for residential and/or
commercial purposes and provision for sewage disposal
facilities for said territory is essential for such
purposes.
(e) The terms and conditions of the proposed annexation are:
None
(f) All the owners of land within such territory have given
their written consent to such annexation, as provided in Government
Code, Section 56837; and therefore, as approved and authorized by
the Local Agency Formation Commission, this Board may adopt its
resolution ordering the annexation without notice and hearing and
without an election, as provided in Government Code, Section 57002.
(g) The regular County assessment roll will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
(h) Pursuant to State CEQA Guidelines section 15074
(California Environmental Quality Act of 1970), the Board finds
in accordance with the Negative Declaration dated March 16, 1987,
prepared with respect to the proposed annexation and the project

designated Reva No.2 Annexation, that the project would have no
significant impact on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government
Code Section 57002, the following described incorporated
territory in the City of Encinitas, State of California, be and
it hereby is annexed to and made a part of the Cardiff Sanitation
District.
IT IS FURTHER ORDERED that the Clerk of this Board immediately
transmit a certified copy of this resolution along with a
remittance to cover the fees required by the Government Code
section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing with
section 57200), Part 5, Division 1, Title 6 of the Government Code
and by Chapter 8 (commencing with section 54900), Part 1, Division
2, Title 5 of the Government Code.

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
REVA NO. 2 ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on January 21, 1987 as Resolution No.
87-04, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of Diego County on April 6, 1987, and this
District was designated as the conducting district and authorized
by resolution to order said annexation without notice or hearing
and without an election pursuant to Government Code, Section
56837; NOW THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to Government
Code Section 57025 et seq.:
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this Board as
stated above.
(b) The territory to be annexed has been designated the
Reva No. 2 by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as hereinafter
described.

(c)o The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described in Health
and Safety Code section 4830.
(d) The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in furnishing
sewage disposal facilities.
2. The territory proposed to be annexed to said District is
proposed to be developed and used for residential and/or
commercial purposes and provision for sewage disposal
facilities for said territory is essential for such
purposes.
(e) The terms and conditions of the proposed annexation are:
None
(f) All the owners of land within such territory have given
their written consent to such annexation, as provided in Government
Code, section 56837; and therefore, as approved and authorized by
the Local Agency Formation Commission, this Board may adopt its
resolution ordering the annexation without notice and hear ing and
without an election, as provided in Government Code, section 57002.
(g) The regular County assessment roll will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
(h) Pursuant to State CEQA Guidelines section 15074
(California Environmental Quality Act of 1970), the Board finds
in accordance with the Negative Declaration dated March 16, 1987,
prepared with respect to the proposed annexation and the project

designated Reva No. 2 Annexation, that the project would have no

significant impact on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government
Code section 57002, the following described incorporated
territory in the City of Encinitas, State of California, be and
it hereby is annexed to and made a part of the Cardiff Sanitation
District.
IT IS FURTHER ORDERED that the Clerk of this Board immediately
transmit a certified copy of this resolution along with a
remittance to cover the fees required by the Government Code
section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing with
section 57200), Part 5, Division 1, Title 6 of the Government Code
and by Chapter 8 (commencing with Section 54900), Part 1, Division
2, Title 5 of the Government Code.
ADOPTED this 1st day of July , 1987 by the

Cardiff Sanitation District
proiect Description and Location Field Check: Yes

The proposed project involves annexation of one parcel consisting
of 5.7 acres to the Cardiff Sanitation District. The purpose of
the annexation is to provide sewer service to 'one single-family
dwelling planned for construction. The annexation site can be
subdivided into four parcels (15 additional dwelling units) under
the city's general plan and zoning regulations.' The County
Department of Public Works determined that the proposed annex-
ation is exempt from CEQA (exemption 15303); however, the
exemption cited does not apply to this project. Location:
within the City of Encinitas, north of 14th Street, east of
Rancho Santa Fe Road, south of Carlsbad, and west of Desert Rose
Way (Thos. Bros. pg. 25/D3).
Environmental settinq
The proposed annexation is currently vacant and has been iden-
tified by the county Department of Public Works as an area with
poor percolation. No apparent sensitive habitats are on the site
or on adjacent land. The project site i£ characterized by gently
sloping topography with 75' - 225' elevations. Drainage from the
site flows southeasterly into Escondido Creek and Lake Val
Sereno. Surrounding land uses are single-family residential.
Potentially Siqnificant Environmental Effects
None have been identified. The existing general plan and zoning
allows 2.9 du/acre, which would permit approximately 15 dwelling
units to be built upon subdivision. The proponent plans on
extending sewer service to one dwelling unit planned for con-
struction. If additional dwellings are built, further environ-
mental review would be required during the subdivision process.

None are anticipated.

On motion of Commissioner Nagel, seconded by Commissioner
Mahr, the following resolution is adopted:
WHEREAS, a resolution of application was submitted to this
Commission for annexation of territory to the Cardiff Sanitation
District, which resolution was adopted by the Board of Directors
of said District as Resolution No.4, dated January 21, 1987,
pursuant to Title 5, Division 3, commencing with Section 56000 of
the Government Code; and
WHEREAS, the territory proposed for annexation is as
described in the application on file with the Local Agency
Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed
her report on said annexation, which report was received and
considered by the Commission; and
! WHEREAS, all owners of land have consented in writing to the
annexation; .
NOW THEREFORE, BE IT ~SOLVED, that this Commission hereby
finds, determines, and orders as follows:
(1) The Commission finds, in accordance with the Negative

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"REVA NO. 2 ANNEXATION" TO THE
CARDIFF SANITATION DISTRICT
On motion of Commissioner Nagel, seconded by commissioner
Mahr, the following resolution is adopted:
WHEREAS, a resolution of application was submitted to this
commission for annexation of territory to the Cardiff Sanitation
District, which resolution was adopted by the Board of Directors
of said District as Resolution No.4, dated January 21, 1987,
pursuant to Title 5, Division 3, commencing with section 56000 of
the Government Code; and
WHEREAS, the territory proposed for annexation is as
described in the application on file with the Local Agency
Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed
her report on said annexation, which report was received and
considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the
annexation; .
NOW THEREFORE, BE IT ~SOLVED, that this Commission hereby
finds, determines, and orders as follows:
(1) The Commission finds, in accordance with the Negative
Declaration dated March 16, 1987, that this proposal will have no
significant effect on the environment.
(2) The Commission hereby approves the annexation with
modified boundaries, as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in
Exhibit A are definite and certain.
(4) The boundaries of the territory do conform to lines of
assessment and ownership.
(5) The district is a registered-voter district.
(6) The territory includes 5.7 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby
designated the "Reva No. 2 Annexation" to the Cardiff Sanitation
District.

(8) The Commission. hereby designates the Cardiff Sanitation
District as the conducting authority and authorizes the Board of
Directors to initiate proceedings in compliance with this
resolution without notice and hearing.

RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
FRED M. REVA ANNEXATION
On motion of Director Luke, seconded by Director Gaines, the
following resolution is adopted:
WHEREAS, this Board of Directors has received a request from Fred
H. Reva (Document No. ) that the hereinafter described
territory to be annexed to the Cardiff Sanitation District
(hereinafter referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate proceedings
to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code Sections 56800 and 56700,
application is hereby made to the Local Agency Formation Commission of
the County of San Diego for a proposed change of organization as
follows:
A. This proposal is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985 ($56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization and the
names of all districts for which any such change of organization is
proposed as follows:

territory is essential for such purposes.
1. It is hereby requested that proceedings be taken for the
annexation of territory 88 hereinabove proposed.
J. This annexation is consistent with the sphere of influence of
the Sanitation District, which is the only affected city or district.
2. The Board finds, pursuant to Article 19, Section 15303 of the
State EIR Guidelines, that this annexation is not subject to the
environmental impact evaludt1on process because it is categorically
exempt as a project initiated for the purpose of making sewer service
available for new construction or conversion of small structures.

Whether to approve a petition for annexation for a vacant 5.70 acre parcel
to the Cardiff Sanitation District.
RECOMMENDATIONS: That your Board:
1 .) Adopt the resolution of application of the Board of Directors of
the Cardiff Sanitation District for annexation to the District.
2.) Find pursuant to State CDQA Guidelines, Section 15303 (California
Environmental Quality Control Act of 1970), that this project is
categorically exempt from evaluation.
BACKGROUND INFORMATION
This proposed annexation is in conformance with your Board's policy on
annexations, as a single family dwelling on a legal lot (condition 4).
This is a request to annex a 5.70 acre parcel to the Cardiff Sanitation
District. Annexation is required in order to provide sewer service for a
proposed single family dwelling. This property is large enough to be
spli t; however, the owner has no plans to subdivide at this time. The
zoning is R-R-1 which allows one dwelling unit per acre (DUA). The
Community Plan is Residential Four which allows 2.9 DUA.
This project is located in the vicinity of Desert Rose Way, Olivenhain.

Costs incurred, if any, will be paid by the proponent.

1. Population, density, land area and land use, per capita
assessed valuation, topography, natural boundaries. drainage
basins, proximity to populated areas, likelihood or significant
growth during next ten years.
2. Need for organized community services, present cost and
adequacy of government services and controls, probable future
needs, probable effect of change of organization and of alter-
native courses of action on the cost and adequacy of services
and controls in the area and adjacent areas.
3. The effect of the proposed action and of alternative actions
on adjacent areas, on mutual social and econ~ic interests
and on the local governmental structure of the county,
4. Conformity of the proposal and its effects with cacmission
policies on providing planned, orderly, efficient patterns of
urban development and with state policies and priorities on
conversion of open-space lands to other uses,
