AN URGENCY ORDINANCE
.) OF THE CARDIFF OF THE CARDIFF SANITATION DISTRICT
AMENDING THE CARDIFF SANITATION DISTRICT CODE
RELATING TO ANNEXATION FEES AND CONNECTION FEES
The Board of Directors of the Cardiff Sanitation District
does ordain as follows:
SECTION ONE:
That Section 3.12.020 of the Cardiff Sanitation District
Code is amended to read as follows:
3.12.020 Connection Fee. A connection fee of
$2260.00 is established for each dwellinq unit or equivalent
dwellinq unit connected to the sewer system of the Cardiff
Sanitation District. The number of equivalent dwellinq units
prescribed in this Code shall be used to compute the amount of
the connection fee. The Board of Directors shall review the
propriety of the fee amount durinq the month of April of each
year.
SECTION TWO:
, That Section 3.04.030, Subsection A of the Cardiff
Sanitation District Code is amended to read as follows:
3.04.030 Annexat~on Use Fee.
A. An annexation use fee for all properties annexinq to
the District shall be $830 for each equivalent dwellinq unit
which could be constructed on the property in conformity with
existinqzoninq regulations. If the property is not subj ect
to the zoninq regulations of the City of Encinitas, then the
City of Encinitas will be asked to prezone the property before
annexation. The Board of Directors shall review the propriety
of the fee amount durinq the month of April of each year.
B. Equivalent dwellinq units .for commercial and
industrial users to be annexed shall be estimated based upon
the data available at the time the annexation is final. After
bUildinq permits have been issued the District Manaqer or the
permittee may request that a determination of actual
equivalent dwellinq units be made based upon metered water
usaqe or metered sewaqe flow. The estimated annexation fee
collected will then be corrected by the number of EDUs so
determined, times the fee in effect at the time of final'
annexation. If the permittee has overpaid, then the district
shall refund the difference within 90 days. If the fees were
. insufficient then the permittee shall pay the difference to
the District within 90 days.

SECTION THREE.i..
.) The increases imposed by this Ordinance shall not be
applicable to annexation applications which are complete prior to
July 8, 1987.
SECTION FOUR..i..
Havinq received five affirmative votes, this ordinance shall
take effect immediately as necessary for the immediate preservation
of the public health safety and welfare in that:
A. Sufficient revenues are necessary to provide facilities
that will safely collect and transport sewaqe.
B. Current fees will not qenerate sufficient revenues to
provide adequate facilities.
C. Immediate increase in fees is necessary to qenerate
sufficient revenues to provide adequate facilities.
This ordinance shall have no further force and effect when
" Ordinance 87-06 becomes effective.
SECTION FIVE:
The district Clerk is directed to post/publish this ordinance
within 15 days followinq adoption.
