RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNBXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
SHERK ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seg.)
preliminary proceedings were commenced by resolution of

application by this Board on April 1, 1987, as Resolution No. 87-
15, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission: and

WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency

Formation Co1ll111ission of San Diego County on September 14, 1987,
and this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an election pursuant to Government Code,
Section 56837;
NOW THEREFORE, BE IT RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seg.:
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated the
Sherk Annexation by the Local Agency Formation
Commission, and the exterior boundaries of such
territory are as hereinafter described.
c. The territory proposed to be annexed is uninhabited and
will be bene f i ted by such annexation as described in
Health and Safety Code Section 4830.

d. The reasons for the proposed annexation as set forth in
the resolution of apPlitåtion referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial purposes and
provision for sewage disposal facilities for said
territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided
in Government Code, Section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution
ordering the annexation without notice and hearing and
without election, as provided in Government Code,
Section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.

h. Pursuant to State CEQA Guidelines Section 15303
(California Environmental Quality Act of 1970), the
Board finds that this annexation is not subject to the
environmental impact evaluation because it is
categorically exempt as a proj~ct initiated for the
purpose of making sewer serV1.ce available to new
construction or conversion of small structures.
IT IS FtrRTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described territory
in the City of Encinitas,State of California, be and it hereby
is annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover fees required by the Government Code
Section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"SHERK ANNEXATION" TO THE CARDIFF SANITATION DISTRICT
On motion of Commissioner Hersom, seconded by Commissioner Mahr, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was
adopted by the, Board of Directors of said District as Resolution No. 87-15, dated
April I, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government' Code; and
WHEREAS, the territory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that the determination by the County of San
Diego that this annexation is exempted by State CEQA Guidelines Section 15303 from
the requirements of CEQA has been reviewed and considered.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is ,a registered-voter district.
(6) The territory includes 0.38 acre and is uninhabited.
(7) The territory proposed 'to be annexed is hereby designated the "Sherk,
Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting' authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
SHERK ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on April 1, 1987, as Resolution No. 87-
15, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on September 14, 1987,
and this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an election pursuant to Government Code,
section 56837;
NOW THEREFORE, BE IT RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seq.:
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated the
Sherk Annexation by the Local Agency Formation
Commission, and the exterior boundaries of such
territory are as hereinafter described.
c. The territory proposed to be annexed is uninhabited and
will be benefited by such annexation as described in
Health and Safety Code section 4830.

1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial purposes and
provision for sewage disposal facilities for said
territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided
in Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution
ordering the annexation without notice and hearing and
without election, as provided in Government Code,
section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to state CEQA Guidelines section 15303
(California Environmental Quality Act of 1970), the
Board finds that this annexation is not subject to the
environmental impact evaluation because it is
categorically exempt as a project initiated for the

the property to be annexed crosses the floodplain. She
questioned whether the pr:Jperty should be annexed to Cardiff
Sanitation District or to Solana Beach Sanitation District.
District Manager Shafer stated he had spoken to LAFCO and to
the property owner who indicated that he would be willing to

Discussion:
This proposed annexation is in conformance with your Board's policy on annex-
ations. as a future single family dwelling or duplex on a legal lot-'Condition 4).
On Apri 1 1. 1987, your Board adopted a Resolution of Application for annex-
ation of territory to the Sanitation District. On,§eptember 14, 1987, the
Local Agency Formation ComITission adopted a resolution approving this annex-
ation and authorizing your Board to initiate 'proceedings in compliance with
their resolution, without notice or heá~ing (DA87-18).

Patricia Wanket. 4.17 Acres.
Board Manager Shafer stated that the Patricia Wanket petition for
annexation to Cardiff Sanitation District was consistent with Board
policy.
Dan Peterka asked what today's proposed action by the Board meant.
Board Manager Shafer explained that LAFCO had asked that before
they processed petitions for annexation, the Cardiff Sanitation
District Board first adopt a resolution approving each application.
They would then know, in light of the capacity issue, that this
Board did approve of the proposed annexation. Mr. Peterka stated
he would appreciate any action to expedite the annexation.

Resolution 87-16.
D. Approval of Purchase and Installation of San Eliio Influent
Meter in the Amount of $35.000.
Interim City Engineer Hoffland stated this meter would measure all
flow into the plant from all angles. He said he was sure the
Regional Water Quality Control Board would accept its readings of
the effluent even though it would be on the influent side of the
plant. In addition there was a contract for the Olivenhain pump
station, which it was hoped would be installed in a matter of
months, which would add another meter so that each separate line
would then be also metered, providing a check. Board Manager
Shafer stated when enough information had been gathered for an
accurate report as to what had happened a report back to the Board
would be made.
Omsted moved, Gaines seconded, carried unanimously to approve
purchase and installation of an influent meter at San Elijo at a
cost of $35,000.
E. Consideration of Increasing Enqineering Services Contract from
$90.007 to $145.007 to Perform Emerqency Repairs to San Eliio Ocean
Outfall.
Interim City Engineer Hoffland stated that prior to a contract with
Atkinson Co. for major repairs to the ocean outfall, there was a
contract with Engineering Sciences Co. for engineering services
which provided diving and minor rock repair to support the ocean

Environmental Quality Control Act of 1970), that this project is
categorically exempt from evaluation.
2) Adopt the resolution of application of the Board of Directors of
the Cardiff Sanitation District for annexation to the District.
Discussion:
This proposed annexation is in conformance with your Boardts policy
on annexations, as a future single family dwelling or duplex on a legal
lot (Condition 4). Zoning is RV-11 which allows 10.9 dwelling units
per acre (DUA). The ComITunity Plan is Residential 7 which also allows
10.9 DUA.

OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY

Omsted , following resolution is adopted:
WHEREAS, this Board of Directors has received a request from
Jerry Sherk (Document No. ) that the hereinafter described
territory to be annexed to the Cardiff Sanitation District
(hereinafter referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code Sections 56800 and 56700,
application is hereby made to the Local Agency Formation Commission
of the County of San Diego for a proposed change of organization as
follows:
A. This proposal is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985 ($56000, et. seq., Govt.
Code).
B. The nature of the proposed change of organization and the
names of all districts for which any such change of organization is
proposed as follows:

0.34 acres.

G. All the owners of land within such territory have given
their written consent to such annexation subject to the
aforementioned terms and conditions.
H. The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and is
engaged in furnishing sewerage disposal facilities.
(2) The territory proposed to be annexed to said
District is proposed to be developed and used for residential
and/or commercial purposed and provision for sewage disposal
facilities for said territory is essential for such purposes.
1. It is hereby requested that proceedings be taken for the
annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of influence
of the Sanitation District, which is the only affected city or
district.
2. The Board finds, pursuant to Article 19, section 15303 of
the State EIR Guidelines, that this annexation is not subject to
the environmental impact evaluation process because it is
categorically exempt as a project initiated for the purpose of

of small structures.
3. The Clerk of the Board of Directors is hereby authorized
and directed to file a certified copy of this resolution with the
Executive Officer of the Local Agency Formation Commission of the
