WHEREAS, pursuant to the Cortese-Knox Local Govermnent
"/l;;::,;;;Reorganization Act of 1985 (GoVt. ,Code, section 5600 et seq.)
" preliminary, proceed~~gs were ccmnenced by resolution of application by
this Board on March 7,1989, as Resolution 'No. 89-04, for annexation
the Cardiff Sanitation District (thereinafter referred to as the
District) of certain territory therein described, which description
has been lOOdified pursuant to the directions of the Local Agency
Formation Cœmission; and
WHEREAS,the annexation proposed by said resolution of
) application was presented to and approved by the Local Agency
Formation Cœmission of San Diego County on December 3,1990, and this
District was designated as the conducting District and authorized by
resolution of order said annexation without notice or hearing and
without an election pursuant to Government Code, Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED, pursuant
to Government Code Section 57025 et seq.;
a. The manner in which and by whan preliminary proceedings
were ccmnenced was ,by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated DA 89 -14
by the Local Agency Formation Ccmnission, and the exterioJ:'
boundaries of such territory are as hereinafter described.
c. The territory proposed to be annexed is uninhabited, and
will be benefited by such annexation as described in Health
and Safety Code Section 4830.

IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government
Code Section 57002, the following described incorporated territory in
the City of Encinitas, State of California, be and it hereby is
annexed. to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board imrediately
transmit a certified. copy of this resolution along with a remittance
to cover the fees required. by the Government Code Section 54~02. 5 to
the Executive Officer of the Local Agency Formation Comnission of San
Diego County, so that the Executive Officer may make the filings
required by Chapter 8 (ccmnencing with Section 57200), Part 5,
Division 1, Title 6 of the Government Code and by Chapter 8
(cœmencing with Section 54900), Part 1, Division 2, Title 5 of the
Govermnent Code.

MAKING DETERMINATIONS AND APPROVING THE
-LOUIS SCHOOLER ANNEXATION- TO THE
CARDIFF SANITATION DISTRICT
On motion of Commissioner Hersom, seconded by Commissioner Loscher, the
followinl resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the. Cardiff Sanitation District, which resolution was adopted by
the Board of Directors of said District as Resolution No. 89-04, dated March 7, 1989,
pursuant to Title 5, Division 3, commencing with Section 56000 of the Government Code;
and
WHEREAS, the territory proposed for annexation is as described in the application
on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on said
annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commissicn certifies that it has reviewed and considered the information
contained in the Negative Declaration prepared by the Cardiff Sanitation District.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto, subject to the following condition:
Payment by the owner of district annexation fees and State Board of
Equalization charges.
(3) The boundaries of the territory as described in Exhibit A are definite and
certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 1.24 acres and is uninhabited.

(7) The territory proposed for annexation is hereby designated the "Louis
Schooler Annexation" to the Cardiff Saóitation District.
(8) The CommissiOil hereby designates the Cardiff Sanitation District as the

FOR THE ANNEXATION OF TERRITORY
WHEREAS, this Board of Directors has received a request from
Louis Schooler that the hereinafter described territory to be
annexed to the Cardiff Sanitation District (hereinafter referred
to as the Sanitation District); and

WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation
Commission of the County of San Diego for a proposed
change of organization as follows:

DECISION:
1. It is found that the proposed project will not have a significant effect on
the environment and the Negative Declaration dated May 16,1985 has been
considered and is approved.
2. Grant, in substantial accord with the approved plot plan, a variance for a.
reduction in minimum building site area from 0.5 acre to 0.45 acre on
proposed Parcels 1 and 2 in connection with a proposed division of land,
with the condition that the variance not become effective until such time
as the Tentative Parcel Map is recorded.
REASONS: An offsite curve realignment associated with another subdivision has
resulted in the existing private access to this variance applicant's property,
as well as an adjacent lot, having inadequate sight distance to enter Manchester
Avenue safely. The granting of this variance will correct this existing public
safety hazard. The property contains the required gross acreage but due to
necessa1"Y access easement acreage deduction, the net acr~ag~ becomes
subs t and ard.
FINDINGS PURSUANT TO SECTION 7107 OF THE ZONING ORDINANCE IN SUPPORT OF GRANTING
A VARIANCE:
1. That there are except ional or extraordinary circllßstances or conditions

vicinity and zone.
Facts In Support: The property contains the required gross acreage but due

occurs at the present access point to this and the adjacent property.

other properties in the same vicinity and zone, and denied to the property
for which the variance is sought.
Facts In'Support: Other properties in this same vicinity possess adequate
sight distance and safe access to and from Manchester Avenue. Granting of
this variance will alleviate an existing serious sight distance problem,
thereby resulting in the enjoyment of a right presently not experienced.
3. That granting the variance or its modification will not be materi~ly
detrimental to the public health, safety or welfare, or injurious to the
property or improvements in such vicinity and zone in which the property is
located.
Facts In Support: The granting of this variance will reduce, if not
eliminate, an existing and serious sight distance problem on Manchester
Avenue.
Because the proposed division of land must meet all health and safety
requirements imposed by the County, granting the vari ance will not be
materially detrimental to public health and safety.
4. That granting the variance or its modification will not be incompatible
with the San Diego County General Plan.
Facts In Support: As granted, the variance will not be incompatible with
the San Dieguito Community Plan as the proposed subdivision meets the gross
lot area requirement of the plan.

WHEREAS, Louis V. Schooler applieã for a Variance from
sections 4810, 4006 and 4200 of the Zoning Ordinance to allow a
reduction in lot size below the required .50 minimum net acres
requir~d in the RS-2 zone for Parcell from .582 gross acres to
.459 net acres, and for Parcel 2 from .585 gross acres to .482
net acres; and for a reduction in the required 40. from
centerline front yard setback from a less than 40' easement to
23' on Parcel 2 for property of:

NOW, THEREFORE, BE IT RESOLVED by the Olivenhain
Community Advisory Board of the city of Encinitas that:
1. The appl icant 's property is physically special in
contrast to some of the existing lots in the vicinity, since
one of the parcels proposed is enclosed on three sides by
either public or private roads or easements requiring greater
setbacks for structures, and the access easement running east
and west through Parcel 1 and Parcel 2 which resulted in the
reduction of the lot sizes for both parcels was requested by
the County of San Diego to relieve a potentially hazardous
access onto Manchester Avenue from the adjacent easterly
property;
2. The privilege sought by the applicant is consistent
with the limitation upon other properties in the vicinity and
zone, since other properties in the vicinity do not have
streets or easements on three sides of the property and
therefore, may have less restrictive setbacks;
3. The granting of this variance would not authorize a
use that lS not expressly authorized by the zoning
regulations, since the existing triplex on Parcel 2 lS an
existing non-conforming use and structural non-conformity and
a covenant is required to be recorded agreeing to convert the
existing triplex to a single family dwelling unit prior to
issuance of a building permit to construct a single family
dwelling unit on Parcel 1, thereby ensuring that the existing
non-conforming situation is only allowed to remain until a
building permit is requested on Parcel 1, at which time only
one single family dwelling unit will be allowed on each
parcel;.

of the property; the situation was not self-induced since the

RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
WHEREAS, this Board of Directors has received a request from
Louis School&r that the hereinafter described territory to be
annexed to the Cardiff Sanitation District (hereinafter referred
to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation
Commission of the County of San Diego for a proposed
change of organization as follows:
A. This proposal is made pursuant to the Cortese-Knox
Local Government Reorganization Act of 1985 (S.
56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization
and the names of all districts for which any such
change of organization is proposed as follows: The
annexation of the hereinafter described territory
to the Sanitation District.
C. The names of all other affected counties, cities and
districts are: city of Encinitas.
D. A description of the exterior boundaries of the
territory proposed to be annexed to the Sanitation
District is described in Exhibit "A" hereto

E. Said territory is uninhabited and comprises
approximately 1.23 acres.
F. It is proposed that said territory be annexed
subject to the following condition: Payment of
district annexation and State Board fees.

H. The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and is

District is developed and/or proposed to be
developed and used for residential and/or
commercial purposes and provision for sewerage
disposal facilities for said territory is
essential for such purposes.
I. It is hereby requested that proceedings be taken for
the annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of
influence of the Sanitation District.
2. Pursuant to State CEQA Guidelines Section 15074
(California Environmental Quality Act of 1970), the Board
finds that this annexation would not have a significant
effect on the environment (Negative Declaration Log No.
85-8-25).
3. The Clerk of the Board of Directors is hereby authorized
and directed to file a certified copy of this resolution
with the Executive Officer of the Local Agency Formation
Commission of the County of San Diego.

BACKGROUND:
This is a request to annex 1.23 acres into the Cardiff Sanitation
District. Annexation is required in order to provide sewer service
for two future single-family residences.
DISCUSSION:
There is currently one triplex on the existing 1.23 acre lot which
is served by a subsurface sewage disposal system. Tentative Parcel
Map 18431 divides this lot into two parcels of 0.56 and 0.60 acres
gross, each, and requires the existing triplex to be converted to
a single-family dwelling on parcel two. The remaining parcell is
zoned for one future single family dwelling. Annexation to the
Cardiff Sanitation District is a condition of final map approval
and it is staff's consensus that the above mentioned abatement
(triplex conversion) be completed prior to final annexation.
This parcel is within the district sphere of influence and is
located on the north side of Manchester Avenue, approximately 985
ft. east of El Camino Real (see attached vicinity and district
boundary map).
RECOMMENDATIONS:
It is recommended that the Board of Directors:
1. Certify pursuant to State CEQA Guidelines, section 15074
(California Environmental Quality Control Act of 1970), that
this project would not have a significant effect on the
environment (Negative Declaration Log No. 85-8-25).
2. Adopt Resolution of Application Number 89-04 for annexation
to the district.
3. Require conversion of existing triplex to a single family
dwelling prior to final annexation of property to the
district.
