RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TBRRITORY TO WHICH OWNERS HAVE CONSENTED
RICHARD TRACI ANNEXATION NO. 8728.0
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seg.)
preliminary proceedings were commenced by resolution of
application by this Board on July 1, 1987, as Resolution No. 87-
28, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the LoCal Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency

pursuant to Government Code Section 57025 et seg.:
a. The manner in which and by whom preliminary proceedings

b. The territory to be annexed has been designated 8732 by
the Local Agency Formation commission, and the exterior
boundaries of such territory are as hereinafter
described.
c. The territory proposed to be annexed is uninhabited and
will be benefited by such annexation as described in
Health and Safety Code Section 4830.

d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial purposes and
provision for sewage disposal, facilities for said
territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided
in Government Code, Section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution
ordering the annexation without notice and hearing and
without election, as provided in Government Code,
Section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.

existing sewer line will not be extended.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described territory
in the City of Encinitas, State of California, be and it hereby
is annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this, Board
immediately transmit a certified copy of this ,resolution along
with a remittance to cover fees required by the Government Code
Section 54902.5 to the Executive Officer of the Local Agency

MAKING DETERMINATIONS AND APPROVING THE
"RICHARD TRACI ANNEXATION" TO THE
CARDIFF SANITATION DISTRICT
On motion of Commissioner MacDonald, seconded by Commissioner Hersom, the
following resolution is adoPted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was
adopted by the Board of Directors of said District as Resolution No. 87-28, dated July.
1, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission finds, pursuant to Section 15319(a) of the State CEQA
Guidelines, that this annexation is not subject to the environmental impact evaluation
process because the proposal area contains existing structures and is developed to the
density allowed by the current zoning/prezoning of either the gaining or losing
governmental agency (whichever is more restrictive), and any utility extensions would
only have the capacity to serve existing structures.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto. ' ,
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 0.62 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "Richard
Traci Annexation" to the Cardiff Sanitation District.

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
RICHARD TRACI ANNEXATION NO. 8728.0
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on July 1, 1987, as Resolution No. 87-
28, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on October 5, 1987, and
this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an election pursuant to Government Code,
section 56837;
NOW THEREFORE, BE IT RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code section 57025 et seq.:
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated 8732 by
the Local Agency Formation Commission, and the exterior
boundaries of such territory are as hereinafter
described.
c. The territory proposed to be annexed is uninhabited and
will be benefited by such annexation as described in
Health and Safety Code section 4830.

. d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial purposes and
provision for sewage disposal facilities for said
territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided
in Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution
ordering the annexation without notice and hearing and
without election, as provided in Government Code,
section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to state CEQA Guidelines section 15319
(California Environmental Quality Act of 1970), the
Board finds that this annexation is not subject to the
environmental impact evaluation because it is
categorically exempt as an annexation of property
containing an existing private structure developed to
the density allowed by current zoning and where the
existing sewer line will not be extended.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described territory
in the City of Encinitas, State of California, be and it hereby
is annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover fees required by the Government Code
Section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive

the property owner who indicated that he would be willing to

This is a request to aITnex 0.62 acres into the Cardiff Sanitation Dis-
trict. Annexation is required i~.order to provide sewer service for
a single family dwelling.
RECOMMENDATIONS: That your Board
1) Adopt the resolutionöf the Board of Directors of the Cardiff

Sanitation District annexing territory to the District.
Discussion:
This proposed annexation is in conformance with your Board's policy
on annexations, as a single family dwelling on a legal lot (condition 4).
Zoning is R-R-2 which allows 2 dwelling units per acre (DUA). The
Community Plan is Residential 3 which also allows 2 DUA.
On July 1, 1987, your Board adopted a Resolution of Application for
annexation of territory to the Sanitation Di~trict and approved a con-
nection agreement. On October 5, 1987; the Local Agency Formation
Commission adopted a resolution. approving this annexation and authorizing
your Board to initiate proceedings in compliance with their resolution,

Charqes, Jim Hutchinson and Bob Dulich.
City Manager Shafer stated that, upon adoption of the lncrease in
sewer permit charges, the Board went through much deliberation
regarding the time frame in which to impose the fee. At that
time the Board felt the cut-off dates were fair anè reasonable to
ensure that those people who were in the process of applying for
sewer connection would be exempt from the l_ncrease. This
particular case did not fall into the criteria set for
exemptions. He therefore recommended not to hold a hearing on
this appeal and requested Council to find that the connection
fees charged were appropriate.
city Manager Shafer stated that Mr. Hutchinson had a commitment
letter which only guaranteed that he would get a discharge permit
but he was responsible for the fee charged at the time of
issuing the permit.
Luke moved, Steel seconded to deny consideration of the appeal of
Jim Hutchinson and Bob Dulich without prejudice based on no
apparent basis for the appeal with the stipulation that if Mr.
Hutchinson could provide further written evidence to substantiate
his claim within 30 days, the Board may reconsider. Motion

Environmental Review Board on February 27, 1986.
Member Steel questioned the merits of bonding versus letters of
credit. Mr. August stated that bonding is more desirable to the
developer. Board Attorney Krauel stated that the format of the
agreeme~t was one used by the County but in the fu:.-¡Jre, the Board
would use a different format uslng covenants specifically
articulated to address each phase of the improvement.

RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
RICHARD M. TRACI ANNEXATION
WHEREAS, this Board of Directors has received a request from
Richard M. Traci (Document No. ) that the hereinafter
described territory to be annexed to the Cardiff Sanitation
District (hereinafter referred to as the Sanitation District);
and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation
Commission of the County of San Diego for a proposed change of
organization as follows:
A. This proposal is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985 ($56000, et. seq., Govt.
Code).
B. The nature of the proposed change of organization and
the names of all districts for which any such change of
organization is proposed as follows:
The annexation of the hereinafter described territory to the
Sanitation District.
C. The names of all other affected counties, cities and
districts are: The City of Encinitas
D. A description of the exterior boundaries of the

E. Said territory is uninhabited and comprises
approximately 0.51 acres.
F. It is proposed that said territory to be annexed subject
to the following conditions:
None.
G. All the owners of land within such territory have given
their written consent to such annexation subject to the
aforementioned terms and conditions.
H. The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and is
engaged in furnishing sewerage disposal facilities.
(2) The territory proposed to be annexed to said
District is proposed to be developed and used for residential
and/or commercial purposed and provision for sewage disposal
facilities for said territory is essential for such purposes.
I. It is hereby requested that proceedings be taken for the
annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of
influence of the Sanitation District and the city of Encinitas.
2. The Board finds, pursuant to section 15319, Class 19 (a)
of the State CEQA Guidelines, that.this annexation is not subject
to the environmental impact evaluation process because it is
categorically exempt as an annexation of an area having an
existing private structure developed to the density allowed and
where the extended utilities will have the capacity to serve only
the existing facility.

and directed to file a certified copy of this resolution with the

CONNECTION AGREEMENT
Cardiff Sanitation District, a sanitation district in the
County of San Diego, hereinafter called the District, and Y\Lchø..veÁ H ~(). c. ~
hereinafter called the Owner, agree as follows:
1. The Owner represent that he is the Owner of the following
described real property in the County of San Diego, State of California:
A portion of Block 3, Map No. 326, also being Parcel 2 of Parcel Map No. 3653
(APN 259-210-28)
2. That said real property is located outside of the boundaries of the
District and adjacent to the Manchester Avenue Sewer line.
3. That the Owner shall have the privilege of connecting the sewer line
from a single family dweling located on said real property to
the District's sanitary sewers known as the Manchester Avenue Sewer line.
4. That the connection to the District's sanitary sewer shall be made
under the direction of the Department of Public Works of the County of San Diego,
in accordance with the ordinances and regulations of the County of San Diego and
the District, and shall be made at such place on the District's sanitary sewer
and in such manner as the Director of Public Works of the County of San Diego
shall specify. The cost of such connection shall be paid by the Owner
of said dwelling.
5. At the time of execution of this Agreement, the Owner shall pay, to

the District the sum of $150.00. The sum is in addition to the normal District
capacity, to be determined at a later date, for the privilege of connecting to
the District's sewer, said capacity fee is to be paid at the time of issuance
of the Wastewater Discharge Permit.
6. The Owner, his executors, administrators, heirs, successors and assigns
shall pay to the District through the Department of Public Works of the County
of San Diego on the first day of each calendar month following the connection
of said dwelling to the sanitary sewer of the District a monthly service charge
of $19.00 or $228.00 per year payable in advance. Said fee shall be paid pursuant
to this Agreement until such time as the property upon which said dwelling is
located is annexed to the District.
7. The District shall have the power to increase the amount of the monthly
service charge prescribed in Paragraph 6 from time-to-time in proportion to any
increased cost or expenses of operating the District.
8. The Owner of said property consents to the commencement of proceedings
by the District to annex said property to the District. The Owner agrees that
upon annexation of the above described real property to the District said property
shall become subject to any and all regulations, fees, taxes and assessments appli-
cable to the property within the District.
9. The District agrees that upon connection of said property to the Dis-
trict1s sanitary sewer, the District shall accept the domestic sewage from such
building discharged into its sewer lines, which obligation of the District shall
continue under the Agreement until such time as the above described real property
upon which such dwelling is located is annexed to the District, or

until this Agreement is terminated as hereinafter specified, whichever first
occurs.
10. This Agreement may be terminated by the Owner, his executors,
administrators, heirs, successors or assign by giving to the District ninety
(90) days written notice of intention to terminate by serving such notice on
the Clerk of the Board of Directors of the District.
11. This Agreement may be terminated by the District by giving ninety

12. 'This Agreement is entered into pursuant to authority granted to
the District in the Health and Safety Code, Section 4742.1, and the parties

13. This Agreement shall take effect when executed by the parties.

The zoning is R-S-2 which allows 2 dwelling units per acre (DUA). The Community
Plan is Residential 3 which also allows 2 DUA.

4265 MANCHESTER AVENUE, OLIVENHAIN (APN 259-210-28)
This memo is a request that the dwelling at 4265 Manchester Avenue, Olivenhain,
be allowed to connect to the public sewer in the Cardiff Sanitation District.
The septic system has failed causing effluent to back up into the house.
The dwelling is owned by Richard and Melanie Traci and is approximately 10
years old. The septic tank has been pumped frequently to prevent the sewage
effluent from backing up into the house. Abbott Plumbing cleared the lines
to verify the problem was not a blocked connection between the septic tank
and leach 1 ines. The owners have stated that sewage surfaces on the ground
during the rainy season. There is very limited area available to make a
repair. Connection to the adjacent sewage system would be a permanent solution
for sewage disposal at the dwelling.
