1997-04-09 . MINUTES OF CARDIFF SANITATION DISTRlCT ADJOURNED REGULAR MEETING, APRlL 9, 1997, 6:00 P.M, 505 SOUTH VULCAN AVE. Chairperson Bond called the meeting.to order at 6:13 P.M. Present: Chairperson James Bond, Board Members Lou Aspen, Sheila Cameron, and Chuck DuVivier. Absent: Board Member Davis. Also Board M~r Wasserman, Board Attorney Krauel, Board Clerk Cervone, Present: Assistant Board Manager Benson, Public Works Director Nelson, Engineering Services Director Archibald, Management Apalyst Orozco, Management Assistant Vinocur, and Deputy Board Clerk Greene. There being a quorum present, the meeting was in order. . None. Cl. Management Analyst Orozco stated that on January 10, 1996, the Council approved Ordinance 95- 16, which adopted Title 18 of the Encinitas Municipal Code regarding sanitary sewer. In preparing the ordinance, Ms. Orozco stated the sewer codes of Encinitas Sanitary District (ESD), Cardiff Sanitation District (CSD), Leucadia County Water District, and the cities of Carls bad, Del Mar, and Poway had been reviewed and the proposed Ordinance incorporated relevant sections of the former ESD regulations and the best of the other two districts and three cities. She stated that in reorganizing the code, staff was making 5 changes to include numbering, format and language, EDU determination for apartments/accessory units, elimination of annexation fees . and elimination of water reclamation fees. On March 27, 1996, the CSDBoard awarded a contract for a sewer rate study for CSD and ESD. She said the study was still. in the process of being finalized, however, the study did recommend the fonowing: - Decrease .the number of equivalent dwelling units (EDU) charged for apartments/accessory units ftomO.9 EDU to 0.8EDU. The decrease was recommended in order to more accurately reflect the amount and strength of discharge ftom this type of use and is consistent with the County of San Diego. The change could result in an overall decrease of approximately $10,000 in annual sewer service charges for CSD. In addition, the sewer connection/capacity fee for new apartment/accessory units would be decreased by $390 ftom $3, 150/unit to $3,120/unit. - Eliminate annexation.and water reclamation fees. This recommendation would eliminate the $830ÆDU annexation fee and the $1,OOOÆDU water reclamation fees. -. Ms. Orozco stated that since the passage of Proposition 218, staff had spent considerable time examining how to conform with its requirements as they pertain. to "fees" currently charged by the District. By lowering apartments fÌ'Om 0.9 to 0.8 EDU's, there could be an approximate $10,000 decrease in annual sewer service charge revenue fÌ'Om existing apartments/accessory units. The $830 ÆDU annexation fee could result in an estimated annual loss of revenue of $13,000 in annexation fees and $28,500 in water reclamation fees for a total loss of $41,500 in fees, based upon actual revenues received for fiscal year 1995/96. The staff recommendation was to introduce Ordinance 97-01 amending the Cardiff Sanitation District Code by reorganizing the Code to become similar to Title 18 of the Encinitas Municipal Code regarding sanitary sewer. Chairperson Bond opened the Public Hearing. Since there were no speakers, Mr. Bond closed the Public Hearing The Board Clerk read the Ordinance by title.
