MINUTES OF INITIAL MEETING OF CARDIFF SANITATION DISTRICT BOARD OF
DIRECTORS, OCTOBER 1, 1986 9:00 A.M., 531 SOUTH WLCAN AVENUE
. 1. CALL TO ORDER/ROLL CALL
The meeting was called to order by Acting Chairman Gaines following
adjournment of the Encinitas City Council meeting at approximately
4:45 P.M.
2. ADMINISTRATION OF OATH OF OFFICE
Charles Nares, Interim Manager of the Cardiff Sanitation District,
administered the Oath of Office to Board Members Marjorie Gaines,
Greg Luke, Anne Omsted, Richard P. Shea and Gerald Steel.
3. REPORT ON STATUS OF SEWER TREATMENT CAPACITY OF THE CARDIFF
SANITATION DISTRICT
Charles Nares gave a Staff report that if all projects which were
under way were connected and produced the projected sewage flow the
Cardiff Sanitation district would exceed its capacity rights by
160,000 gpd. He suggested that additional capacity might be
negotiated from Solana Beach Sanitation District. 160,000 gpd,
however, would only be enough for current commitment, not future
growth.
Ordinance 86-55 relating to annexations to the Cardiff Sanitation

Ordinance 86-55
Charles Nares informed the Board that there wère commitments for
345 Equivalent Dwelling Units equating to 100,000 gpd. Approved
developments which have their final map amounted to 40 EDUs or
11,600 gpd. Temporary parcel maps in process which would be
, affected by the ordinance were 93 EDUs or approximately 27,000 gpd.
" In other words, the moratorium would be stopping 27,000 gpd for
EDUs "in the pipeline". '
Discussion developed further facts indicating that if people who
already had building permits and those who had capacity commitment
letters were allowed toconn~ct, the plant would be 160,000 gpd
over c~pacity.
Gaines moved, Steel seconded to amend the ordinance to provide that
there would be no waste discharge permits issued. Motion failed.
Ayes: Gaines, Steel; Nays: Luke, Oms ted, Shea.
Luke moved, Omsted seconded that Ordinance 86-55 be adopted as
prepared by Staff.
Urgency Ordinance 86-55 relating to annexations to the Cardiff
~ Sanitation District and Sewer Capacity Commitments was again read

state that the matter would be scheduled for reconsideration on
October 27, 1986. Council directed that the ordinance be reworded
-~' to state that the district would refuse to accept applications for
a waste discharge permit or for a sewer capacity commitment letter
and that those applications which are in the process for a sewer
capacity letter or for a waste discharge permit requiring capacity
that isn't accompanied by a capacity commitment letter would be
denied. That would mean the only projects going forward would be
those with a sewer capacity commitment letter to support them.
Motion to adopt the ordinance carried. Ayes: Luke, Omsted, Shea,
Steel; Nays: Gaines.
Shea moved, Omsted seconded that Gerald Steel and Greg Luke be
appointed as a subcommittee to negotiate with Solana Beach for a
final solution. Motion carried. Ayes: Luke, omsteð, Shea, Steel;
Nays: None; Abstain: Gaines.
4. APPOINTMENT OF BOARD ATTORNEY
Gaines moved, Omsted seconded to appoint Roger Krauel as Counsel
for Cardiff Sanitation District with the same terms and conditions
under which he was appointed to represent the City of Encini tas.
Xotion carried. Ayes: Gaines, Luke, omsted, Shea, Steel; Nays:
None.
5. ADJOURNMENT
