Witness my hand this 2200 day of September, 1999, MICHAEL D, on Executive Officer San Diego Local Agency Formation Commission ,.: !o' 8 8 Minute Item: 9 Ref, No.: R099-7 RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN DIEGO MAKING DETERMINATIONS AND APPROVING THE "TORREY PACIFIC CORPORA TICN REORGANIZA TICN" (CITY OF ENCINITAS) On motion of Commissioner Nygaard, seconded by Commissioner Mathis, the following resolution is adopted: WHEREAS, a resolution of application was submitted to this Commission for a reorganization of territory including annexation to the City of Encinitas and the Cardiff Sanitation District with detachment from County Service Area No, 83 (San Dieguito Local Parks), which resolution was adopted by the City Council of said City as Resolution No. 99- 01 dated February 11, 1999, pursuant to Title 5, Division 3, commencing with Section 56000 of the Government Code; and WHEREAS, the proposal was modified to include annexation of additional territory to the City of Encinitas with detachment from County Service Area No, 83 (San Dieguito Local Parks); and WHEREAS, the territory proposed for reorganization is as described in the application on file with the Local Agency Formation Commission; and WHEREAS, the Executive Officer of the Commission has filed his report on said reorganization, which report was received and considered by the Commission; and WHEREAS, all owners of land have consented in writing to the reorganizatiòn; NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds, determines, and orders as follows: (1) The Commission adopts the findings included in the resolution of approval of the City of Encinitas for the impacts identified in the Environmental Impact Report, and certifies that the mitigation is within the jurisdiction of the City and not LAFCO because the affected resources and services will be within the city limits upon annexation. (2) The Commission hereby approves the reorganization with boundaries as described in Exhibit A attached hereto for the reasons set forth in the Executive Officer's report, subject to the following condition: (a) Payment of Cardiff Sanitation District, Local Agency Formation Commission, and State Board of Equalization processing fees, ..., ,,' 8 8 (3) The boundaries of County Service Area -No, 17 (San Dieguito Paramedics) shall not be changed as a result of this reorganization, Pursuant to Government Code §56375(p), the Commission waives the application of Government Code §2521 0,90 and finds that the application of this section would deprive the residents of the affected area of a service needed to ensure their health, safety, and welfare, and that this waiver will not affect the ability of the City of Encinitas to provide services, (4) The boundaries of the territory as described in Exhibit A are definite and certain, (5) The boundaries of the territory do conform to lines of assessment and ownership, (6) The districts are registered-voter districts, (7) The territory includes 112,65 acres and is uninhabited. (8) The territory proposed for reorganization is hereby designated the "Torrey Pacific Corporation Reorganization" (City of Encinitas), (9) The Commission hereby designates the City of Encinitas as the conducting authority and authorizes the City Council to conduct proceedings in compliance with this resolution without notice and hearing.
