WHEREAS, pursuant to the Cortese-Knox Local Government

preliminary proceedinqs were commenced by resolution of
application by this Board on April 7,1989, as Resolution No. 89- :
15, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Aqency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
. application was presented to and approved by the Local Aqency
Formation Commission of San Dieqo County on December 3, 1991( and
. this District was desiqnated as the conductinq District and
authorized by resolution of order said annexation without notice
or heari~q and without an election pursuant to Government Code,
Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,

2. The territory proposed to be annexed to said
District is developed and/or proposed to be
developed and used for residential and/or

e. The terms and conditions of the proposed annexation
, are: Payment of annexation and State Board fees.
f. All the owners of land within such territory .have given
their written consent to such annexation, as provided
in Government Code, Section 56837; and therefore, as

On motion of Commissioner Keller Childs, seconded. by Commissioner MacDonald,
the following resolution is adopted:
WHEREAs, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was adopted by
the Board of Directors of said District as Resolution No. 89-15, dated June 13, 1989,
pursuant to TIde 5, Division 3, commencing with Section 56000 of the Government Code;
and
WHEREAs, the territory proposed for annexation is as described in the application
on file with the Local Agency Formation Com",!ssion; and
WHEREAS, the Executive Officer of the Commission has filed her report on said
annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW nIEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that the determination by the Cardiff Sanitation
District that this annexation is exempted by State CEQA Guidelines Section 15303 from the
requirements of CEQA has been reviewed and considered.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto, subject to the following condition:
Payment by the property owner of district annexation fees and State Board of
Equalization charges.
(3) The boundaries of the territory as described in Exhibit A are definite and
certain.

ownership.
(5) The district is a registered-voter district.
(6) The territory includes 4,30 acres and is uninhabited.

(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authori~ and authorizes the Board of Directors to conduct proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail. certified
copies of this resolution as provided in Section 56853 of the Government Code.

WHEREAS, this Board of Directors has received a request from
Mark Zimdars that the hereinafter described territory to be annexed
to the Cardiff Sanitation District (hereinafter referred to as the
Sanitation District); and
WHEREAS,

SUBJECT:
Adoption of Resolution No. 89-15, Application for
Annexation to the Cardiff Sanitation District of 4.30
acres located approximately 1600' northwest of Lone Jack
Road on Copper Crest Road - Mark Zimdars.
BACKGROUND:
This is a request to annex 4.30 acres into the Cardiff Sanitation
District. Annexation is desired in order to provide public sewer
service to one future single family dwelling.
DISCUSSION:
Due to an increasing number of homeowners on Copper Crest Drive
with failing underground sewage disposal systems, Mr. Zimdars has
concluded that it would be prudent to connect his future home to
the public sewer system.
This proposed annexation is in conformance with the Cardiff Board's
policy on annexations for single family dwellings on legally sized
lots, conforms with the current zoning (R) and is within the
district's sphere of influence. The parcel is located
approximately 1600' northwest of Lone Jack Road on Copper Crest
Road (see attached vicinity and Plat maps).
RECOMMENDATIONS:
That the Board of Directors of the Cardiff Sanitation District:
1.
Find pursuant to State CEQA Guidelines, section 15303
(California Environmental Quality Control Act of 1970), that
this project is categorically exempt from evaluation.
2.
Adopt Resolution of application number 89-15 of the Board of
Directors of the Cardiff Sanitation District for annexation
to the District.
