ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED

WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 5600 et seq.)
preliminary proceedings were commenced by resolution of application
by this Board on February 8, 1989, as Resolution 89-03, for
annexation to the Cardiff Sanitation District (thereinafter
referred to as the District) of certain territory therein
described, which description has been modified pursuant to the
directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of

MAKING DETERMINATIONS AND APPROVING THE
"WILCSEK ANNEXATION" TO THE

CARDIFF SANITATION DISTRICT
On motion of Commissioner Hostler, seconded by Commissioner Loscher, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was
adopted by the Board of Directors of said District as Resolution No. 89-03, dated
February 8, 1989, pursuant to Title 5, Division 3, commencing with Section 56000 of
the Government Code; and
WHEREAS, the territory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT ~ESOL VED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that the determination by the Cardiff
Sanitation District that this annexation is exempted by State CEQA Guidelines Section
15303 from the requirements of CEQA has been reviewed and considered,
(2) The Commission hereby approves the annexation with modified
boundaries, as described in Exhibit A attached hereto, subject to the following
condition:
Payment by the owners of district annexation fees and State
Board of Equalization charges,
(3) The boundaries of the territory as described in Exhibit A are definite
and certain,
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district,
(6) The territory includes 2.93 acres and is uninhabited.

(7) The territory proposed for annexation is hereby designated the "Wilcsek
Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing,
(9) The Executive Officer is hereby authorized and directed to mail
certified copies of this resolution as provided in Section 56853 of the Government
Code.

BACKGROUND:
At the regularly scheduled meeting of the Cardiff Sanitation
District on February 8, 1989, the Board of Directors adopted a
Resolution of Application to Annex 2.35 acres to the District. On
May 3, 1989, the annexation was approved by the Local Agency
Formation Commission (DA89-6). Annexation is required in order to
provide sewer service for one existing and three (3) future single
family dwellings.
DISCUSSION:
There is currently one house on the existing 2.35 acre lot which
is served by a subsurface sewage disposal system. The proposed
Tentative Parcel Map (88-110-TPM) divides the 2.35 acre parcel into
4 lots of .54, .55, .56, and .56 and acres respectively.
This proposed annexation is in conformance with the Cardiff Board's
policy on annexations for single family dwellings on legally sized
lots and conforms with the current zoning (R-2-2). The parcel is
located in the vicinity of Rancho Santa Fe Road and Whisper Wind
Drive (See attached vicinity and district boundary maps).

WHEREAS, this Board of Directors has received a request from
Mike Wilcsek that the hereinafter described territory to be annexed
to the Cardiff Sanitation District (hereinafter referred to as the
Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,

Commission of the County of San Diego for a proposed
change of organization as follows:
A. This proposal is made pursuant to the Cortese-Knox
