A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
"DANNY WAY ANNEXATION"
WHEREAS, pursuant to the Cortese-Knox Local Government Reorganization Act of
1985 (Govt. Code, Section 5600 et seq.) preliminary proceedings were commenced by resolution
of application by this Board on October 25, 2000, as Resolution No. 2000-16, for annexation to
the Cardiff Sanitation District (thereafter referred to as the District) of certain tenitory therein
described, which description has been modified pursuant to the directions of the Local Agency
Fonnation Commission; and
WHEREAS, the annexation proposed by said resolution of application was presented to
and approved by the Local Agency Fonnation Commission of San Diego County on February 5,
2001 and this District was designated as the conducting District and authorized by resolution of

order said annexation without notice or hearing and without an election pursuant to Government
Code, Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to
Govemmen~ Code Section 57025 et seq.;
a. The manner in which and by whom preliminary proceedings were commenced
was by resolution of application by this Board as stated above.
b. The tenitory to be annexed has been designated DA 00-27 by the Local Agency
Fonnation Commission, and the exterior boundaries of such territory are as
hereinafter described.
c. The territory proposed to be annexed is uninhabited and will be benefited by such
annexation as described in Health and Safety Code Section 4830.
d. The reasons for the proposed annexation as set forth in the resolution of .
application referred to above are:
1. The District is empowered to and is engaged in furnishing sewage
disposal facilities.
2. The territory proposed to be annexed to said District is developed and/or
proposed to be developed and used for residential and/or commercial
purposes and provision for sewage disposal facilities for said territory is
essential for such purposes.

e. The terms and conditions of the proposed annexation are: Payment of State
Board of Equalization fees.
f. All the owners of land within such tenitory have given their written consent to
such annexation, as provided in Government Code, Section 56837; and therefore,
as approved and authorized by the Local Agency Formation Commission, this
Board may adopt its resolution ordering the annexation without notice and
hearing and without an election, as provided in Government Code, Section
57002.
g. The regular County assessment role will be utilized and the affected tenitory will
not be taxed for existing bonded indebtedness.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government Code
Section 57002, the following described incorporated tenitory in the City ofEncinitas, State of
California, be and it hereby is annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board immediately transmit a certified
copy of this resolution along with a remittance to cover the fees required by the Government
Code Section 54902.5 to the Executive Officer of the Local Agency Formation Commission of
San Diego County, so that the Executive Officer may make the filings required by Ch~pter 8
(commencing with Section 57JOO), Part 5, Division 1, Title 6 of the Government Code and by
Chapter 8 (commencing with Section 54900), Part 1, Division 2, Title 5 of the Government
Code.

MAKING DETERMINATIONS, APPROVING, AND ORDERING THE
"WAY ANNEXATION" TO THE
CARDIFF SANITATION DISTRICT

On motion of Commissioner Pocklington, seconded by Commissioner Davis, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation Distriet, which resolution was adopted by
the Board of Directors of said District as Resolution No. 2000-16, dated Oetober 25,2000,
pursuantto Title 5, Division 3, commeneing with Section 56000 of the Government Code;
and
WHEREAS, the reason~ for the proposed annexation as set forth in the resolution
of application are:
(a) The Sanitation Distriet is empowered to and is engaged in furnishing
sewage disposal faeilities.
(b) The territory proposed to be annexed to said District is developed
and/or proposed to be developed and used for residential and/or
eommereial purposes and provisions for sewerage disposal facilities
for said territory is essential for sueh purposes.
WHEREAS, the territory proposed for annexation is as described in the application
on file with the Local Ageney Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed his report on said
annexation, whieh report was received and considered by the Commission; and
WHEREAS, it has been determined that the proposal area is uninhabited, that all
owners of land have consented in writing to the annexation, that any registered voters have
reeeived written notification, and that all affected ageneies have eonsented in writing to a
waiver of condueting authority proceedings;
NOW THEREFORE, pursuant to the Cortese/Knox/Hertzberg Local Government
Reorganization Act of 2000 (Government Code Seetion 56000, et seq.), the Local Agency
Formation Commission of the County of San Diego does hereby resolve, determine, and
order as follows:

(1 ) The Commission certifiee that the determination by the Cardiff Sanitation
District that this annexation is exempt by Seetions 15319(b) and 15303(a) of the State
CEQA Guidelines has been reviewed and considered.
(2) The Commission hereby approves the annexation with boundaries as
described in Exhibit A attached hereto for the reasons set forth in the Exeeutive Officer's
report, waives the conducting authority proeeedings, and orders the following aetion:
Annexation of the territory described in Exhibit A to the Cardiff
Sanitation District.
(3) The territory to be annexed is hereby designated the 'Way Annexation" to the
Cardiff Sanitation District. The exterior boundaries of sueh territory, as approved by the
Commission and described in Exhibit A attaehed hereto, are definite and eertain.
(4) The territory includes .67 aere and the boundaries do eonform to lines of
assessment and ownership.
(5) The terms and eonditions of the proposed annexation as approved by the
Commission are as follows:
Payment by the property owner of District annexation fees and State
Board of Equalization charges.
(6) The distriet is a registered-voter district.
(7) The regular County assessment role is utilized by this distriet.
(8) The affected territory will not be taxed for existing general bonded
indebtedness of any ageneies whose boundaries are ehanged.
(9) The effective date for this annexation shall be the date of recordation but not
before Mareh 5, 2001.
(10). The Executive Officer is hereby authorized and directed to mail copies of this
resolution as provided in Section 56882 of the Government Code.
(11 ) The Executive Officer is further authorized and directed to prepare, execute,
and record a Certificate of Completion, make the required filings with the County Assessor,
County Auditor, and the State Board of Equalization as required by Section 57200, et seq.,
of the Government Code.
