OF THE CARDIFF SANITATION DISTRICT
ANNEXI~G TERRITORY TO WHICH OWNERS HAVE CONSENTED
DANIEL WEIGAND ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government ~

Reorganization Act of 1985 (Govt. Code, Section 5600 et seg.)
preliminary proceedings were commenced by resolution of application
by this Board on December 14, 1988, as Resolution 88-39, for
annexation to the Cardiff Sanitation District (thereinafter
referred to as the District) of certain territory therein
described, which description has been modified pursuant. to the
directions of the Local Agency Formation commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on March 8,1988, and this
District was designated as the conducting district and authorized
by resolution to order said annexation without notice or hearing
and without an election pursuant to Government Code, section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seg.;
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated DA 89-
01 by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as hereinafter
described.
c. The territory proposed to be annexed is uninhabited, and
will be benefited by such annexation as described in
Health and Safety Code section 4330.

d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is developed and/or proposed to be
developed and used for residential and/or commercial
purposes and provision for sewage disposal
facilities for said territory is essential for such
purposes.
e. The terms and conditions of the proposed annexation are:
Payment of annexation and state Board fees.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
commission, this Board may adopt its resolution ordering
the annexation without notice and hearing and without an
election, as provided in Government Code, section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
h. Pursuant to state CEQA Guidelines section' 15074
(California Environmental Quality Act of 1970), the Board
finds that this project would not have a significant
effect on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government
Code section 57002, the following described incorporated territory
in the city of Encinitas, State of California, be and it hereby is
annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board inunediately
transmit a certified copy of this resolution along' with a
remittance to cover the fees required by the Government Code
Section 54902.5 to the Executive Officer of the Local Agency

MITIGATION MEASURES
A. All geotechnical reco..endations for subdivision of. the property shall be ,
adhered to., Site specific geologic and soils investigations shall be
conducted for future developllent of each lot.
B. Custo.grading shall be employed on Lots No.4 and 6 to eliminate, or reduce
to the extent feasible, encroachment on slopes with a gradient of 25 percent
or greater. All graded banks shall be curvilinear. Slope ratios shall be
no steeper than 1.5 to 1 for banks less than 10 feet high and no steeper
than 2 to 1 for banks greater than 10 feet in height. Slope ratios shall be
random on banks and balance out at a 2 to 1 average.

C. Grading, structures, or any activities which could restrict flood flows
within the 100 year floodplain on Lots No.1 and 8 shall be prohibited.
D. The open space easement over riparian woodland shall be dedicated to the
City. Alteration of landform, removal or disturbance of vegetation,
introduction of non-native vegetation, erection of structures of any type,
and vehicle access shall be prohibited. Livestock s~all be prohibited and
fences erected to prevent their encroachment.

A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
DANI'EL WEIGAND ANNEXATION,
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 5600 et seq.)
preliminary proceedings were commenced by resolution of application
by this Board on December 14, 1988, as Resolution 88-39, for
annexation to the Cardiff Sanitation District (thereinafter
referred to as the District) of certain territory therein
described, which description has been modified pursuant, to the
directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on March 8, 1988, and this
District was designated as the conducting district and authorized
by resolution to order said annexation without notice or hearing
and without an election pursuant to Government Code, section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seq.¡
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated DA 89-
01 by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as hereinafter
described.
c. The territory proposed to be annexed is uninhabited, and
will be benefited by such annexation as described in
Health and Safety Code section 4830.

d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is developed and/ or proposed to be
developed and used for residential and/or commercial
purposes and provision for sewage disposal
facilities for said territory is essential for such
purposes.
e. The terms and conditions of the proposed annexation are:
Payment of annexation and state Board fees.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution ordering
the annexation without notice and hearing and without an
election, as provided in Government Code, section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
h. Pursuant to state CEQA Guidelines section 15074
(California Environmental Quality Act of 1970), the Board
finds that this proj ect would not have a significant
effect on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government
Code section 57002, the following described incorporated territory
in the city of Encinitas, state of California, be and it hereby is
annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board immediately
transmit a certified copy of this resolution along' with a
remittance to cover the fees required by the Government Code
section 54902.5 to the Executive Officer of the Local Agency

MITIGATION MEASURES
A. All geotechnical recommendations for subdivision of, the property shall be
adhered to. Site specific geologic and soils :nvestigations shall be
conducted for future development of each lot.
B. Custom grading shall be employed on Lots No. 4 and 6 to eliminate, or reduce
to the extent feasible, encroachment on slopes with a gradient of 25 percent
or greater. All graded banks shall be curvilinear. Slope ratios shall be
no steeper than 1.5 to 1 for banks less than 10 feet high and no steeper
than 2 to 1 for banks greater than 10 feet in height. Slope ratios shall be
random on banks and balance out at a 2 to 1 average.

C. Grading, structures, or any activities which could restrict flood flows
within the 100 year floodplain on Lots No. 1 and 8 shall be prohibited.
D. The open space easement over riparian woodland shall be dedicated to the
City. Alteration of landform, removal or disturbance of vegetation,
introduction of non-native vegetation, erection of structures of any type,
and vehicle access shall be prohibited. Livestock shall be prohibited and
fences erected to prevent their encroachment.

MAKING DETERMINATIONS AND APPROVING THE
"DANIEL WIEGAND ANNEXATION" TO THE
CARDIFF SANITATION DISTRICT
On motion of Commissioner Hostler, seconded by Commissioner Mahr, the following
resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was adopted by
the Board of Directors of said District as Resolution No. 88-39, dated December 14, 1988,
pursuant to Title 5, Division 3, commencing with Section 56000 of the Government Code;
and
WHEREAS, the territory proposed for annexation is as described in the application
on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on said
annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that it has reviewed and considered the information
contained in the Negative Declaration prepared by the City of Encinitas.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto, subject to the following condition:
Payment by the property owner of district annexation fees and State
Board of Equalization charges.
(3) The boundaries of the territory as described in Exhibit A are definite and
certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 24.88 acres and is uninh:lbited.

BACKGROUND:
At the regularly scheduled meeting of the Cardiff Sanitation
District on December 14, 1988, the Board of Directors adopted a
resolution of application to annex 24.32 acres, 8 lots total, to
the District (Daniel Wiegand Annexation). Annexation is required
in order to provide sewer service to eight future single family
dwellings (88-115 TM).
DISCUSSION:
On March 8, 1989, the Local Agency Formation Commission adopted
Resolution D.A. 89-01 approving the application for annexation to
the Cardiff Sanitation District. The proposed annexation is in
conformance with the Board's policy on annexations for single
family dwellings on legal sized lots and complies with current
zonlng (R). The parcel fronts the west side of Lone Jack Road
opposite Fortuna Ranch Road (see attached vicinity and plat maps).
RECOMMENDATIONS:
It is recommended that the Board of Directors:
1. Certify pursuant to state CEQA Guidelines, Section 15074
(California Environmental Quality Control Act of 1970), that
this proj ect would not have a significant effect on the
environment (Negative Declaration dated September 15, 1988).

WHEREAS, this Board of Directors has received a request
from DANIEL WIEGAND that the hereinafter described territory to
be annexed to the Cardiff Sanitation District (hereinafter
referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;

FINDING:
Based upon information provided in the Initial Study, along with Comments and
Responses to the Notice of Preparation of a Negative Declaration which have
been presented to the City Council/Pl anni ng Commi ss ion/Community Advi sory
Board, City of Encinitas, at a duly called meeting on July 26,1988 ,
the Council/Commission/Board finds that the ~roject will not have a
significant effect on the environment.
MITIGATION MEASURES:
Mitigation measures included in the project as a condition of project approval
to avoid potentially significant effects include:

MITIGATION MEASURES
A. All geotechnical recommendations for subdivision of, the property shall be
adhered to. Site specific geologic and soils investigations shall be
conducted for future development of each lot.
B. Custom grading shall be employed on Lots No. 4 and 6 to eliminate, or reduce
to the extent feasible, encroachment on slopes with a gradient of 25 percent
or greater. All graded banks shall be curvilinear. Slope ratios shall be
no steeper than 1.5 to 1 for banks less than 10 feet high and no steeper
than 2 to 1 for banks greater than 10 feet in height. Slope ratios shall be
random on banks and balance out at a 2 to 1 average.

C. Grading, structures, or any activities which could restrict flood flows
within the 100 year floodplain on Lots No. 1 and 8 shall be prohibited.
D. The open space easement over riparian woodland shall be dedicated to the
City. Alteration of landform, removal or disturbance of vegetation,
introduction of non-native vegetation, erection of structures of any type,
and vehicle access shall be prohibited. Livestock shall be prohibited and
fences erected to prevent their encroachment.
