access easement and emergency access easement, over and across that certain real property in the

HEREOF BY THIS REFERENCE,
The improvements within said right of way as shown on City of Encinitas engineering
drawings number 6442-G and 6442-1 are to be maintained by the Grantor and/or it's
successors.
The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all
damages to Grantor's remaining property contiguous to the right-of-way hereby conveyed by reason
of the location, construction, landscaping or maintenance of said right of way.
