This Covenant shall run with the land and be binding upon and inure to the benefit of the future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties. C. OWNER agrees that OWNER's duties and obligations under this Covenant are a lien upon the Property. Upon notice and opportunity to respond, the CITY may add to the tax bill of OWNER any past due financial obligation owing to CITY by way of this Covenant. D. If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party. The CITY may assign to a persons impacted by the performance of this Covenant the right to enforce this Covenant against OWNER. E. Upon the satisfactory completion of the obligations imposed upon OWNER by this Covenant, OWNER may apply for, and upon application of OWNER CITY shall then duly execute and acknowledge, in recordable form, and deliver to OWNER a satisfaction of Covenant and release, and shall return duly endorsed to OWNER the security RM/O3/BPl-97wp5 2(6-19-89-1) 2 . . 1947 provided for herein. At the option of CITY, a partial satisfaction of Covenant can be executed and delivered to OWNER along with a partial release of the security provided for herein so long as there remains security of sufficient value to secure 150% of the cost of the obligations remaining to be performed by OWNER.
