The Owner acknowledges that as an Uncontrolled Embankment, the site is not eligible for a building permit unle s special soils analysis and foundation design are approved, 2. The Uncon rolled Embankment will be maintained in a safe and sanitary manner at the sale cost, risk and respon ibility of the property owner and his successors in interest, who shall hold the City of Encinitas h rmless with respect thereto, In accordance with section 23.24.0400f the City of Encinitas Municipal ode the City Engineer will instruct removal of the Uncontrolled Embankment if it is not maintain 'a safe and sanitary manner.
