The undersigned, the owner of Assessor's Parcel Number: 256-340-32&33, and further
described as a portion of Parcel 3, of Parcel Map 00-184TPM/CDP in
Attachment A (Legal Description) and Attachment a '(Plat Map)
in the City of Encinita~, County of San Diego, State of California, in the consideration of the grant of
permission by the City of Encinitas to install and maintain an Uncontrolled Embankment for the use and
benefit of owner's property, and agrees with the City of Encinitas, as follows:
1, The Owner acknowledges that as an Uncontroiied Embankment, the site is not eligible for a buiiàing
permit unless special soils analysis and foundation design are approved.
2. The Uncontrolied Embankment wili be maintained in a safe and sanitary manner at the sale cost, risk
and responsibility of the property owner and his succe$$ors in interest, who shall hold the City of
Encinítas harmless with respect thereto. In accordance with section 23.24.0400fthe City of Encinitas
Municipal Code the City Engineer will in$truct removal of the Uncontrolled Embànkment if it is not
maintained in a safe and sanitary manner.
