92024 ACCEPTING A PREVIOUSLY REJECTED
OFFER OF DEDICATION OVER A
PORTION OF BUMANN ROAD AND
RANCHO DE MAYO AS SHOWN ON MAP NO. 11809
WHEREAS, on May 18, 1987, the City of Encinitas rejected an
offer of dedication over a portion of Bumann Road and Rancho De %~/
Mayo on Map No. 11809 for use as public streets;
WHEREAS, Section 66477.2 of the Government Code of the State
of California provides that a rejected offer of dedication shall
remain open and subject to future acceptance by the City;
WHEREAS, on April 25, 1989, the Planning Commission approved
Tentative Map No. 88-183, a 31-lot single-family subdivision
located at the Southerly terminus of Rancho De Mayo;
WHEREAS, the developer has requested that the City Council
accept the portion of Bumann Road between Fortuna Ranch Road and
the Northerly prolongation of the Easterly right-of-way line of
Rancho De Mayo and Rancho De Mayo between Bumann Road and the
Southerly lin~ of Map No. 11809.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Encinitas accepts, subject to the completion of the 1" a.c.
overlay as required in Planning Commission Resolution No. 89-17,
those portions of Bumann Road and Rancho De Mayo as described in
Exhibit "A" for use as public streets.
PASSED AND ADOPTED this 21st day of August, 1991, by the
following vote, to wit:

southeasterly of the southerly right-of-way line of Fortuna Ranch
Road and lying westerly of the northerly prolongation of the
easterly right-of-way line of Rancho De Mayo as shown on said Map
No. 11809 TOGETHER WITH that portion of Rancho De Mayo lying
southerly of the southerly right-of-way line of said Bumann Road
and lying northerly of the southerly line of said Map No. 11809.
