WHEREAS, The Developer has requested that the City quit claim the
existing easement for public stormdrain purposes over Lots 17 and
18 of the Sage Canyon Development as dedicated per Final Map No.
13653, recorded October 28, 1998; and
WHEREAS, the easement does not serve to connect or provide access
to other public facilities, and
W-~IEREAS, there are no other public utilities located within the
easement,
NOW BE IT THEREFORE RESOLVED that the City Council of the City of
Encinitas approves a quit claim of the existing easement for
public stormdrain purposes over Lots 17 and 18 of the Sage Canyon
Development as granted per Final Map No. 13653, as shown in
Exhibits 'A' and "B' reserving, said easement as a private
stormdrain easement in favor of the Home Owner's Association.
BE IT ALSO RESOLVED that the City Clerk of the City of Encinitas
shall cause a certified copy of the Resolution of Quit Claim,
attested by the Clerk under seal, to be recorded without
acknowledgement or further proof, in the Office of the County
Recorder. Upon such recordation, the quit claim process shall be
deemed complete.
