Horton San Diego Holding Company, Inc., a California corporation hereinafter called GRANTOR(S), do(es) hereby grant, convey and dedicate to the City if Encinitas, State of California, hereinafter called GRANTEE, the fight of way and incidents thereto for a public access and landscape maintenance easement, over and across that certain real property in the City of Encinitas, County of San Diego, State of California, described as follows: SEE EXHIBITS "A" and "B" ATTACHED HERETO AND MADE A PART HEREOF BY THIS REFERENCE, The Grantor hereby grants to the City of Encinitas (CITY, hereinafter) the privilege and right to extend drainage structures and excavation and embankment slopes beyond the limits of the herein described right-of-way where required for the construction and maintenance of said public access and landscape maintenance facilities. Reserving unto the GRANTOR of the above described parcel of land, his successors or assigns, the fight to eliminate such slopes and/or drainage structures or portions thereof, when in the written opinion of the City Engineer of Grantee, the necessity therefore is removed by substituting other protection, support and/or drainage facility, provided such substitution is first approved in xvriting by the City Engineer. The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all damages to Grantor% remaining property contiguous to the right-of-way hereby conveyed by reason of the location, construction, landscaping or maintenance of said highway. SEPT. 14 ~ ~ EXHIBIT "A" LEGAL DESCRIPTION FOR LANDSCAPE MAINTENANCE AND PUBLIC ACCESS EASEMENT Strips of land 3.00 feet wide, over those portions of Lot 67 of Tract No. 94-066 in the City of Encinitas, County of San Diego, State of California filed as Map No. 13356, Records of said County, the Easterly lines of which are described as follows: Strip No. 1: Beginning at the intersection of the Westerly right-of-way of Quail Gardens Drive and the Northerly line of said Lot 67, as shown on said map, said intersection being a point on a curve concave Westerly having a radius of 514.00 feet, a radial line to said intersection bears North 78o18'07'' East; thence along said Westerly right-of-way line the following courses: Southerly 66.07 feet along said curve through a central angle of 7°21'53'', and tangent from said curve, South 4o20'00'' East 6.27 feet. The Westerly line of said strip shall be prolonged or shortened Northerly so as to terminate on the Northerly line of said Lot 67.
