Subject: AB 1234 Mandatory Ethics Training Requirements; Notice of Options

A new law effective January 1, 2006 requires specified local officials to receive two hours of
ethics training.1 For those officials who were in service as of January 1, the deadline for
receiving the first round of training is January 1, 2007.2 The requirement applies to local
officials who either receive compensation for their service to the city or are reimbursed for their
expenses.3 The Encinitas City Attorney has opined that this requirement applies to the Housing
Authority Board members.
The training must cover both ethics laws and ethics principles.4 There are a number of options
for complying with this requirement.
. The San Diego County Water Authority will be offering a training on August 23 from
9:30 am to 11 :45 am at their Escondido training room. Board members from other
agencies are welcome but space is limited. Contact Doria Lore at (858) 522-6614 or e-
mail dlore@sdcwa.onz. by August 7th (see attached flyer for additional dates and times).
. Self-study materials are available from the League of California Cities Institute for Local
Government at www.ca-illz.orgfabI234comDliance. The materials require that you read
two articles on public service ethics laws and principles, take a self-assessment test and
then submit it to the Institute for Local Government with a $25 processing fee for each
test (there are two). The Institute will review your test, provide you the correct answers
to the questions and a proof of participation certificate. The processing fee will be
reimbursed by the City.

Once you receive your proof of participation in the required AB 1234 training, please make a
copy of the certificate for your records and provide the original to the Encinitas City Clerk's
office.s These records will be retained as public records for at least five years.6

As with all ethics laws, AB 1234 creates a minimum for ethics education-not a maximum. We
encourage you to take advantage of additional training in ethics-related topics and document
those efforts as well.

Certain local agency officials are required to take two hours of training in
ethics principles and laws every two years. On August 23 and 31 and
September 14, the Water Authority will provide training Regarding AB 1234
including:
. General ethics principles relating to Public Service and Ethic Laws
included in AB 1234
. Laws pertaining to personal financial gain by public officials
. Laws related to limitations on receipt of gifts, honoraria, travel
restrictions, personal and political use of public resources
. Governmental transparency laws including financial disclosure
requirements and open government laws
. Laws relating to fair processes including contracting requirements,
competitive bidding requirements, and du~ process
. Laws regarding conflict of interest under the Political Reform Act
. Laws regarding Public Records Act compliance

AS 1234 Self-Study
The Institute offers two, one-hour self-study exercises as an option for local officials to satisfy AS 1234
requirements, or to make up for time missed at in-person sessions if the official either arrived late or left early. In
each instance, local officials need to:
Print out and read the substantive materials;
Print out and take the test; and
Mail the test to the Institute with the $25 processing fee for each segment.
The Institute will then send you your corrected test with the correct answers and explanations, along with your proof
of participation certificate(s).
The two segments are:
Hour One: Financial Interests and Perks Self-Studv Materials + Test and Transmittal Instructions
Hour Two: Transoarencv and Faimess Self-Studv Materials + Test and Transmittal Instructions
Proceeds from the processing fees help cover the Institute's costs in developing these materials, grading the test
and providing the proof of participation certificate(s). Thank you in advance for supporting the Institute's work in
