ORGANIZED AND EXISTING UNDER THE LAWS OF THE STATE OF CALIFORNIA
hereinafter designated Grantor(s) do(es) hereby grant, bargain, convey and release unto
R.E.L.S., INC., A CALIFORNIA CORPORATION herein designated Grantee, its successors and
assigns, a perpetual easement and right-of-way upon, through, under, over and across the
hereinafter described real property for the installation, construction, maintenance, repair,
replacement, reconstruction and inspection of an enclosed WATER CONVEYANCE FACILITY
and all structures incidental thereto, and for the flowage of any waters in, over, upon or through
said channel, together with the perpetual right to remove buildings, structures, trees, bushes,
undergrowth, and any other obstruction interfering with the use of said easement and right-of-way
by the Grantee, its successors or assigns. To have and to hold said easement and right-of-way
unto itself and unto its successors and assigns forever.
The real property referred to hereinabove and made subject to said easement and right-of-way by
this grant is situated in the City of Encinitas, County of San Diego, State of California, and is
particularly described as follows:
See Exhibit "A' and Exhibit "B" attached hereto and made a part hereof by this reference.
There is reserved to the Grantor, his successors and assigns, the right and privilege to use the
above described land of the Grantor at any time, in any manner and for any purpose not
inconsistent with the full use and enjoyment by the Grantee, its successors and assigns, of the
rights and privileges herein granted.
This Offer of Dedication shall be irrevocable and shall run with the land and be binding upon and
inure to the benefit of future owners, encumbrancers, successors, heirs, personal representatives,
transferees and assigns of the respective parties.

PRIVATE EASEMENT FOR WATER LINE PURPOSES
Easements for waterline purposes in the City of Encinitas, County of San Diego, State of
California, over a portion of Lot 57 of Tract No. 94-066 as per Map Number 13356 filed in the
office of the County Recorder of said County, described as follows:
PARCEL 1:
That certain easement for private waterline purposes reserved and shown on said lot as "~ ".
PARCEL 2:
A strip of land 10.00 feet w/de lying 5.00 feet on each side of the following described centerline:
Beginning at the Easterly terminus of the centerline of hereinabove described Parcel 1; thence
along its Easterly prolongation North 84o06'25'' East 58.00 feet.
PARCEL
A strip of land 10.00 feet wide, the Westerly line of which is described as follows:
Beginning at the intersection of the centerline of hereinabove described Parcel 1 with the
Easterly right-of-way of Quail Gardens Drive as shown on said Tract, said intersection being a
point on a non-tangent curve concave Westerly having a radius of 586.00 feet, a radial line to
said point bears South 73°2?24" East; thence Southwesterly 25.00 feet along said Easterly right-
of-way through a central angle of 2026'40''.
Excepting therefrom that portion lying within hereinabove described Parcel 1.
