RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS APPROVING THE
DESIGN AND PLANS FOR CONSTRUCTION OF THE SOUTH COAST HIGHWAY 101
SIDEWALK TO SOLANA BEACH PROJECT, PURSUANT TO GOVERNMENT CODE
SECTION 830.6.
WHEREAS, The City Council of the City of Encinitas (“City”) does resolve as follows:
SECTION 1: The City Council finds and declares as follows:
WHEREAS, the City retained Dokken Engineering ("Consultant") as the engineering firm
to design and prepare the plans for South Coast Highway 101 Sidewalk to Solana Beach project
(CS22D) ("Project"); and
WHEREAS, the Consultant informed the City Representative that the plans are complete
and that construction of the Project may begin; and
WHEREAS, the City Engineer or designee reviewed the completed design and plans for
the Project and agrees that the plans are complete and the Project may be constructed; and
WHEREAS, The City Council wishes to obtain the immunities set forth in Government
Code §830.6 with regard to the plans and construction of the Project.
SECTION 2: Design Immunity; Authorization.
WHEREAS, the design and plans for the Project are determined to be consistent with the
City's standards and are approved; and
WHEREAS, the design approval set forth in this Resolution occurred before actual work
on the Project construction commenced; and
WHEREAS, the approval granted by this Resolution conforms with the City's General
Plan; and
WHEREAS, the City Engineer, or designee, is authorized to act on the City's behalf in
approving any alterations or modifications of the design and plans approved by this Resolution;
and
WHEREAS, the approval and authorization granted by this Resolution is intended to avail
the City of the immunities set forth in Government Code § 830.6.
PASSED, APPROVED and ADOPTED on this 17th day of January 2024, by the City
Council of the City of Encinitas, State of California.
