A RESOLUTION OF THE CITY COUNCIL OF THE, CITY OF ENCINITAS APPROVING
THE DESIGN AND PLANS FOR CONSTRUCTION OF THE LEUCADIA STREETSCAPE
SEGMENT C WEST SIDE IMPROVEMENTS PROJECT, PURSUANT TO GOVERNMENT
CODE SECTION 830.6
NOW, THEREFORE, the City Council of the City of Encinitas does resolve as follows:
SECTION 1: The City Council finds and declares as follows:
The City retained Michael Baker International ("Consultant") as the engineering firm to
design and prepare the plans and specifications for the construction of the Streetscape Segment
C West Side Improvements project ("Project").
Consultant informed the City Engineer that the design and plans are complete and that
construction of the Project may begin.
The City Engineer or designee reviewed the completed design and plans for the Project
and agrees that the design and plans are complete and the Project may be constructed.
The City Council wishes to obtain the immunities set forth in Government Code section
830.6 with regard to the design, plans and construction of the Project.
SECTION 2: Design Immunity; Authorization.
The design and plans for the Project are determined to be consistent with the City's
standards and is approved.
The design and plan approval set forth in this Resolution occurred before actual work on
the Project construction commenced.
The approval granted by this Resolution conforms with the City's General Plan.
The City Engineer, or designee, is authorized to act on the City's behalf in approving any
alterations or modifications of the design and plans approved by this Resolution.
The approval and authorization granted by this Resolution is intended to avail the City of
Encinitas of the immunities set forth in Government Code section 830.6.
SECTION 3: The City Clerk shall certify as to the adoption of this Resolution.
PASSED, APPROVED AND ADOPTED this 24th day of August, 2022 by the City Council
of the City of Encinitas, State of California, by the following vote:
