Project Planner: Laurie Winter, Associate Planner, Decision Date: December 7, 2021 PROJECT DESCRIPTION: Substantial Conformance determination with Major Use Permit and Coastal Development Permit (Case No. 94-204 MUP/CDP/EIA, Planning Commission Resolution No. PC-96-09 and Case No. 93-173 MUP/MOD, Planning Commission Resolution No. PC-97-23) dated April 25, 1996, to remove six existing panel antennas and replace with six new panel antennas, relocate two existing panel antennas, install new Raycaps, and replace the existing RRUs with new RRUs. This document is to certify that the applicant's proposed plans stamped received by the City of Encinitas on September 29, 2021, have been determined to be in substantial conformance with the original approvals described above and authorized by the City of Encinitas. ITEM NAME: Verizon SUBC PROJECT NUMBER: SUBC-004780-2021 December 7, 2021 The project site is located at 2775 B Caminito Cove and is owned by the San Dieguito Water District. The property consists of two existing buildings utilized for cellular facilities. No changes are proposed to the existing exterior building. The original wireless facility application approved a Major Use Permit and Coastal Development Permit for the construction of a wireless communication facility (Case No. 94-204 MUP/CDP/EIA, Planning Commission Resolution No. PC-96-09). The wireless facility includes a 403 square foot equipment building with a roof -mounted screening enclosure for ten directional antennas and one microwave dish type antenna. The following discretionary applications have been approved: • Case No. 10-007 MUPMOD/CDP (Planning Commission Resolution No. PC-2011-02) was approved on January 20, 2011, to install a new backup generator. • Case No. 11 -0 12 SUBC was approved on March 30, 2011, to all for the replacement of one microwave dish antenna with a new microwave dish antenna. • Case No. 11-184 MUP/CDP (Planning Commission Resolution No. PC-2012-20) was approved on September 6, 2012, to allow upgrades for Long Term Evolution (LTE) technology to be installed within an existing co -location wireless communications facility contained within a faux rock boulder. • Case No. 14-194 SUBC was approved on October 19, 2014, to allow for the removal of two panel antennas (of eight panel antennas) and replace them with two new panel antennas along with four new remote radio units and two new Raycaps. The project proposes to modify the existing wireless facility as summarized below and further described in the Project Description detailed on Sheet T1, including the existing and proposed equipment and antenna layout shown on Sheet Al. 1. Remove six existing panel antennas and replacing with six new antennas and relocating two existing panel antennas mounted on the roof of the existing equipment building. 2. Remove two existing remote radio units (RRUs) and install four new RRUs on the roof of the equipment building. 3. There is no change to the existing equipment building; however, the following accessory and related equipment are proposed to be removed and replaced as summarized below: a. Install one new Raycap surge suppressor unit on roof of equipment building. b. Install one new hybrid cable from from new Raycap on roof into the equipment building. c. Install one new surge suppressor unit in an existing equipment rack inside the equipment building. d. Remove one existing LTE equipment cabinet from the existing equipment building. e. Remove one new EVDO DR equipment rack from the existing equipment building. 2 of 4 ITEM NAME: Verizon SUBC PROJECT NUMBER: SUBC-004780-2021 December 7, 2021 A Noise Impact report was prepared by Helix Environmental Planning, Inc. on July 16, 2021. The report concluded that the site is currently in compliance with the Encinitas Municipal Code and the proposed project would have no operational noise impacts. This determination is based on the following findings for Substantial Conformance with a Major Use Permit: 1. No project condition is changed or deleted; The proposed modification does not affect the original conditions of approval. 2. No feature, facility, or amenity is deleted or substantially altered which had been considered essential to the project's quality, safety, or function by the decision making body; The overall integrity and function of the wireless communications facility would remain unchanged with the antenna modification for Verizon's entire antenna array and accessory equipment. The wireless communications facility as proposed with modifications would operate in full compliance with the standards for Radio Frequency (RF) Emissions as adopted by the Federal Communications Commission (FCC) with adherence to the site compliance recommendations outlined in the RF report prepared by the applicant. Furthermore, Kramer Firm, Inc., the City's Third -Party RF Engineer, through the analysis contained in the applicant's Radio Frequency Emission study about power, antenna height and other elements, confirmed that the proposed telecommunications facility with the proposed changes are in compliance with the Federal Communications Commission (FCC) OET 65 requirements and Section 6409(a) contained within the Middle -Class Tax Relief and Job Creation Act of 2012. All signage shall be in compliance with FCC OET Bulletin 65 or ANSI C95.2 for color, symbol and content conventions. Additionally, all signage shall provide a working local or toll -free telephone number to its network operations center that reaches a live person who can exert transmitter power -down control over this site as required by the FCC. Based on the discussion above, the Development Services Department finds that there are no significant changes that warrant a modification to the original permit. All mitigation measures and required signage are noted on the plans and are a part of this project. 3. No additional lots or dwelling units are added; No additional lots or dwelling units are proposed to be added to the project. 4. No private or public open space is reduced in area or in its potential for use and enjoyment; The proposed project is limited to the existing developed portions within the lease hold area and will not affect any private or public open space. 5. The shape and bulk of structures, exterior building materials, landscaping, parking and access are substantially in conformance with the spirit and intent of the Use Permit decision; The project still maintains the same design appearance, whereby the spirit and intent of the original approval (Case No. 94-204 MUP/CDP/EIA, Planning Commission Resolution 3 of 4 ITEM NAME: Verizon SUBC PROJECT NUMBER: SUBC-004780-2021 December 7, 2021 No. PC-96-09 and Case No. 93-173 MUP/MOD, Planning Commission Resolution No. PC-97-23) are maintained. There is no change to the existing shape, bulk and exterior of the equipment building. This application only concerns the replacement of antennas and accessory equipment. 6. The grading plan will not increase or decrease the final grade on any part of the site by more than three feet over or under the plan approved by the Use Permit decision, unless the Development Services Department finds that the project is substantially altered by the grading change; and No grading is proposed within the scope of work. 7. No significant changes are made which, in the opinion of the Development Services Department should be reviewed by the body which approved the original application. Based on the discussion above, the Development Services Department finds that there are no significant changes that would require an amendment to the original application approvals. Environmental Status: The project has been determined to be exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15303(d), which exempts new construction or conversion of small structures (i.e., electrical and/or other utility extensions) from environmental review. The proposed improvements do not result in any new impacts not previously cleared by the prior approval of Case No. 94-204 MUP/CDP/EIA, Planning Commission Resolution No. PC-96-09. This determination shall be valid 15 days from the date of this Determination, during which time any aggrieved person may, upon payment of necessary fees, file an appeal. Additional permits, including Building Permits, may be required by the Development Services Department or other City Departments. It is the applicant's responsibility to obtain all necessary permits required for the type of project proposed. The applicant may proceed through the plan check process during the appeal period at his/her own risk; plan check fees are non-refundable. Any filing of an appeal will suspend this action as well as any processing of permits in reliance thereon in accordance with Encinitas Municipal Code Section 1.12.020(D)(1) until such time as an action is taken on the appeal.
